well, pete williams joins us now with details from outside the supreme court. this trial gets started perhaps as early as next week what can we expect to see from chief justice john roberts? >> not much is the simple answer. his role is master of ceremonies rather than a judge. here's a key difference. in a trial, the jurors decide the facts. the judge decides the law. questions of admissibility of evidence and questions to witnesses and so forth. that's the judge's province. in the senate, the chief presiding officer can make rules on those and then any senator can call for a vote and under the senate rules there's immediately a rule with no debate. so if fact is the chief justice does not have the last word. the senators will act as both conventional trial jurors and judges. they decide what the evidence will be. as a matter of fact they'll resolve this question about whether there will be any witnesses. so obviously he has a role to play. one curious thing about impeachment trials senators cannot ask questions of the witnesses or the managers or the prosecut

as we watch this, i'm going to bring in pete williams to talk more about the chief justice's role here. he immediately took charge. he's presiding over this trial. but as we noted, this is not a criminal criminal trooil. so his powers are somewhat limitedcertainly open to challenge. >> first of all, number one, this whole thing has a sort of steam era quality to it with the house having to go across the capitol to tell the senate what's going on. and the are reason some of this seems rather musty is a that the senate is basically following the rules for the first impeachment trial, which have been largely unchanged since 1868. so formally today at 9:30 in the morning, the chief justice was, for the first time, formally told that he had to come over to the senate and preside over the impeachment. and then you also heard him, again, perhaps underscore iing fact that this doesn't happen very often. chuck grassley as the presiding officer had his script that he was reading. and roberts came in and you may have heard him say, i have a little announcement that i want to make. and we were tol

joining me now for more on this move, pete williams. ory here and let you tell me why it is wrong. if this feels like the most open and shut case on these faithless electors as there is. if they've agreed to take up the case, it means the binding of electors is gone. tell me why i might be overreacting on that. >> because we don't know. there are two cases here. you might say that if there was just one but two cases with different outcome. a faithless elector's case was thrown out. he sued and won in the tenth circuit. in washington state, three sued and lost. the washington state supreme court says yes, you have to vote as the popular vote does. the tenth circuit said no. the supreme court took both cases. so which case did it take to overturn? you can't do it that way. as a practical matter, you would say, yeah, the supreme court will not say that any elector can vote however he wants and just create chaos in thecollege. that seems unlikely as a practical matter. as a legal matter, there is a pretty convincing argument that the founder

pete williams is at the court.o be overruled by a majority of senators. >> i'm not sure he can break a tie. first, any decision he makes can be overturned by a simple vote of the senate. but on this question of breaking a tie, yes, it's true, sam chase did it twice, but these were minor procedural questions and after the senate objected he stopped doing it. the rules say the senate votes. and there's no need to break a tie. a 50/50 vote means whatever the proposal was fails. it's true he's residing. the constitution gives them the authority to break ties. it doesn't give the chief justice the authority to break ties. there's a lot of talk about whether john roberts is going to break ties, but that would require him to follow the act of a salmon chase model, not the rehnquist model. i don't expect roberts to try to break ties. i think the expectation at the senate is he's not going to and he can't. >> the vice president doesn't have a role in this, so his tie-breaking role would be irrelevant to an impeachment trial

our understanding reported by our pete williams is, of course, that a tie loses.some have raised the question about he chief justice john roberts role in that, again, pete williams saying it's extremely unlikely that he would weigh in in that scenario. i'm wondering, are house democrats thinking through that or trying to do something to try and change that realtor do you feel your hands are tied in those circumstances? >> well, our role is to present the case. our role is not to lobby or to try to twist the arms of senators. i don't know whether that is or is not being done by the democratic senators on our side. we believe in the fair process. we believe in making sure that this is done right and it's not the job of the prosecutors to be lobbying or docking the jurors in this case. our role is well defined here. we have to bring the case. that's what we continue to do. and i think what you're seeing is the american people are responding to what we're doing. they're seeing that we're doing this the right way. they're seeing that we're telling the truth and that's

pete williams and i were talking about -- sole power to try a case. what that does -- it also seems to imply is that the judiciary branch has no say whatsoever over how the senate conducts its trial. and that the executive privilege question is going to be decided by a majority of the united states senate. >> this is going to be ugly, messy, long, nobody wants that. mitch mcconnell is a pragmatic person. he will turn on a dime if there are 51. the legal interest is a tough one. because we're in a congressional tribunal type trial, they are in charge, which means if they decide something like this person comes in, if you appeal that to the court, which they have the right to do. the court is, i would say, historically more inclined to say, we don't do tie breakers on this, you and chief justice roberts figure it out, which means you could get bolton quickly, the courts aren't going to want to settle a political question. >> not only that, do the courts even have jurisdiction here, that'sed point that the word sole eliminates the judiciary branch. >> th

pete williams joins me now. pete, this is about health care.me court declined to put the obamacare case on a fast track. just as a reminder, a federal appeals court struck down the individual mandate but then said the lower court didn't do a good enough job deciding what parts of the law can be salvaged, sent it back to district court. california and other states that support the obamacare law came right to the supreme court and said look, don't go through all that, take the case now, get this case decided. today, the supreme court said no. that means it is obviously cleared, the supreme court is not going to hear this case this year. that means no decision on obamacare during the presidential campaign, and also means obamacare is going to stay on the books because the effect of the appeals court ruling was put on hold while it goes through lower courts. so obamacare will have an extended lease on life for at least i would guess the next perhaps year or so, and maybe until the end of next supreme court term because undoubtedly whatever the lowe

pete: "the last full measure" tells the true story of a vietnam war hero who personally saved more than 60 men and the desperate fight to see that heroism recognized. william out of the combat zone, he stayed behind, choosing instead to save the lives of his wounded soldiers and sacrifice, ultimately, his own. joining us now, writer and director of "the last full measure," todd robinson. thanks for being here, congratulations on this film telling the story of an american hero. after all that heroism though, he couldn't -- it took many years for it to be recognized. why? >> yeah. so his, the men that he saved on the ground were actually of the army. he was air force, they were army. put him up for the medal of honor on april 11, 1966. and it went all the way up the chain of command to the white house and was kicked back down as an air force cross. and these men, who had all been badly wounded, were all sort of pit out to hospitals across the globe really, and they lost touch with each other. 32 years later, with the advent of the internet, they began to have these sort of virtual reunions. and they discovered that he had not gotten the medal. and what the m
