earlier today judge peter cahill denied a motion for a new trial and floyd's family members are expectedthe sentencing. joining me now from minneapolis, nbc correspondent shaquille brewster and melissa murray and civil rights attorney david henderson. the judge said there were aggravated factors like chauvin abusing his position as a cop, doing what he did in front of children. how is that likely to impact the sentence? >> well, it could possibly increase that sentence, andrea. derek chauvin is facing up to 40 years in prison and legal analysts say you can ignore that number because sentencing guidelines have him serving something significantly lower than that. he could be facing 10 1/2 to 15 years, but with the judge agreeing to those aggravating factors it is likely that they can exceed that 15-year mark. prosecutors are asking for 30 years in prison. the defense prison is asking for probation and time served. so you have a wide gap there and when you listen to why the defense team is asking for that probation. they bring up factors like derek chauvin's age. he's 45 years old. law enfo

yesterday's sentencing of derek chauvin for his murder, and how many others believe that judge peter cahill should've considered the leniency of parole after 15 years versus the 30-year maximum that chauvin was facing. but i also wonder if there's any part of you that at the same time feels vindicated as you stood up in heroic fashion to really stand for justice for your brother. >> it's -- it's a lot of stuff just always just running through my head. i think about my brother every day. you know, my mother, she passed before him, so all we had was each other. and for him to be murdered like that in broad daylight, tortured to death in front of kids, i'm talking about human beings, they're visible and watching a man tortured, an african-american man to death, the things that went through my head was automatic, the maximum. it was no slap on the wrist like he received. he should receive the maximum because if i would have did it, they would have put me in jail the same day. i wouldn't have had the opportunity to go home and be in my bed and be around my kids. they would have put me in prison

judge peter cahill is expected to go higher than sentencing guidelines recommend some experts believelvin will get 20 to 25 years. judge cahill is indicated he is appalled by what mr shelvin did, and he's willing to hold him responsible in a significant way. few minutes to answer shelvin will also be given the opportunity to make a statement during his sentencing hearing tomorrow, but defense attorneys say it's unlikely that he will speak in court. he is still waiting to stand trial in federal court, and any statements could be used against him now to washington, where president biden announced he has struck a deal on an infrastructure plan that key members both parties agree on it is half the size of his original $2 trillion pitch, and his fox news chad programme tells us some democrats think the scaled back plan is too small financial direct question. we have a deal reaction pouring in after a bipartisan senate accord on an infrastructure bill, a group of 10 democrats and 11 republicans forged the pact that signal that it sends to the country again that we actually can work that we

judge peter cahill has been interesting to watch throughout this process.ople that thought he might make a statement during the trial. he might take the stand. he has that opportunity today as well. if there's anything that derek chauvin wants to say at this moment, today would be the opportunity to to do that. we don't know yet whether or not he will take that opportunity. the family has said that they would rather not hear from him today but it's his right to do that if he decides to makes a statement. >> gillian: you listed the aggravating factors here. some of the things counting against chauvin in the judge's eyes. on the flip side of that, there's these mitigating factors as well. i spoke to an attorney last night that said one of the mitigating factors that may work to reduce chauvin's sentence is the conditions under which he's being held. he's been isolated since he was arrested. he's been essentially in solitary confinement 23 hours a day in a 10 by 10 cell. they take him outside an hour a day to exercise. he's alone. they say that won't change. h
