with us for the hour, joer erj, stephanie and pete stocks poised some say for a bigger move. eric is here with that evidence. >> that's right, scott take a look at the chart behind me it shows the trading days between 5% drops going back to 1950 in the s&p 500 an if you discount what happened here in the '70s don't worry about that. the patterns we're right here around 2,000 trading days since the 5% drop and that happened a few years ago and it happened a few years ago, and it happened many decades ago in the 1950s, so this pattern happens over and over and over again, and we're due for a big drop it's very different than the markets we've seen so far. we are due for a 5% drop but if you look at the flipside, the other side of this chart we're due for a 5% move in the positive direction it's the same thing i can delete these circles start again, but here you go, right here, almost 3,000 trading days since the 5% rise in the market and that's a pattern again and again and again that you see it's like a earthquake seismograph, the behavioral patterns in the markets repeat them

[ gunfire ] [ sirens ] >> reporter: video of the skyline. that is the sound of those gunshots being fired. according to sfp, they say the shooting took place near 18th and diamond. the officers are working the area on halloween night. they were flagged down for suspicious car in that area. when police approached that car, that's when the gunfire was exchanged. that's when you heard those gunshots in the video. they are told by sfpd the officer and suspect were both shot, both sent to the hospital. their conditions are unknown at this point, but it resulted in a number of street closures from market to 19th and castro to

pete, what do you have? >> well, craig, the judge has now declared a mistrial in the bribery charge of -- the bribery trial of robert menendez and a florida eye doctor who menendez was accused of bribery, accepting thousands of dollars of gifts and favors. the trial has been going on for more than two months. but the jury has reported several times in the last couple of days that it was unable to reach a verdict. the defense had argued to the judge that he should declare a mistrial. the prosecutor said perhaps the jury could still return a guilty verdict on some of the other counts against senator menendez but after polling each member of the jury individually in chambers with just the lawyers present, the judge in the case has concluded there must be a mistrial. he just said in court, my evaluation of this case is i find -- addressing the jury, i find you're unable to reach a verdict and i have no alternative but to declare a mistrial. so the question now is what happens next. the government will have to de
