the sun will soon rise here on the first day of school here for kids in philadelphia. but not without any problems that are plaquing the the district. it starts with under funding and under staff. the philadelphia school district is opening up the year with the 81 million-dollar budget deficit. school starting on time as you said but there was some reason to worry over money, in this financially strapped district. to help with the budget crisis though, district leaders had to make some tough decisions like cleaning schools less often, leaving vacancies open and cutting staff positions. the district will have to find more way to cut cash if lawmakers don't pass a $2 a pack jet tax when they reconvene next month. despite all those distractions, and parents are hoping, and, and, learned. >> and, one good piece of and that eld of eligible for free males. families struggling to make end meet. of course, mayor nutter is going to kick off back to school festivities with a back to school march today. he'll come right to this area here behind me, chris. >> lauren, thanks very m

philadelphia police say 19-year-old darian person opened fire in logan on monday. this happened during a fight involving students from delaware valley charter school. person is a dropout from that school. 15-year-old aisha abdur rahman also attended the school. she was hit by a bullet shot about half a block away. antiviolence activists held a vigil in her memory. >> so many guns are still out here on the streets and i'm here as a parent to say stop the violence because we're losing our babies to the streets. >> the 19-year-old was shot in the chest and remains in critical condition. person remains behind bars. >> 5:34 now and officials with the philadelphia school district believe some of their budget troubles are about to be solved. pennsylvania governor tom corbett plans to sign a bill today that will allow the city to raise its cigarette tax to send more money to public schools. philadelphia public schools start monday.ith more funding cuts this year to the philadelphia school district, we've learned that there's been an increase in the number of kids enrolling in rt chaer schools. nbc 10's katy zachry is live outside an elementary charter school in overbrook to tell us why we're seeing that trend. >> according to the principal here, chris, from this elementary charter school, the two biggest complaints she's hearing is overclass size and school security at the public school level. those are two things here at west philadelphia achievement charter elementary school they have not cut despite less funding from the state this year. this is one of philadelphia's oldest charter schools, it's kindergarten through fifth grade. listen to this, there are 200 children on the waiting list to get in this year. founder stacey phillips says their class size is about 25 students compared to public school classes where you often have more than 30 kids to one teacher. she's also gotten calls from state representative
