the suspect, 51-year-old philip gilberti, he is the man police say terrorized and killed his estranged wife. surveillance video at intersection captured the chaotic scene just after 9:30. the two were traveling in a van together. heather mcguire tried to get out of the car when gilberti pulled her back in, shot her in the head and shoved her body into the street as he sped from the scene. police worked well into the night searching for the suspect and found him just before 11:00 p.m. in rockville. >> we attempted to make contact with the suspect. receiving no response, we were then able to make visual contact with the suspect who appeared to be laying in a hallway. tactical units entered the home, found mr. gilberti deceased of an apparent gunshot wound. we believe the gunshot wound was self-inflicted. >> reporter: we tell you we poured through court records and they indicate that the estranged couple were married in 2009, going through a divorce. they were actually scheduled to appear in court the morning of the murder. coming up in my next live report in a half-hour, i'll tell you wh

the victim's estranged husband. 51-year-old philip gilberti. surveillance video captured the crime as gilberti shot heather lynne mcguire and then pushed her body out of the vehicle before speeding off himself. court records show the two were married in 2009, had three children who we're told are all safe at this hour. the couple was going through a divorce. after the victim filed several restraining orders against him. the suspect was released from jail just three days before the murder for violating those restraining orders. she told police and the courts she thought her estranged husband was going to kill her. >> we had probably over a hundred police officers at different locations watching vehicles, watching homes, and every one of them understood how potentially dangerous this individual was. we did have information that he had the gun with him. >> reporter: police say gilberti shot and then killed himself as the manhunt moved in on him late last night. he was at a friend's house in rockville. coming up in my next live report, i'll have mu

philip gilberti shot her in the head and dumped her body in the middle of connecticut avenue. turned the gun on himself while surrounded by police inside a home in rockville. our kristin fisher has been following this story from day one and spoke today with the victim's mother. this really has to be tough for her. >> oh, she's devastated, not only that, she's frustrated. she feels like this could have been prevented. i caught up with her this morning outside montgomery county's crisis center because not only is she dealing with her daughter's death, she's trying to get emergency custody of three of her six children. >> i wish i could have been there for her. i can't imagine the terror and the pain that she went through by herself. >> joanne kenny shook with sadness and anger as she remembers how she learned her daughter had been murdered. >> i spoke with the police. they said they were going to meet me at my work and i had the feeling that it was going to be really bad. >> it wasn't just bad. it was the very thing that joanne and her entire family had feared would happen for e

. >> reporter: montgomery county police found 51-year-old philip gilberti dead in a home they had tracked him to in rockville. it was the culmination of a volatile troubled relationship that he had had with his wife, kimberly mcgwire. he had charges of domestic violence. an attorney described the couple as oil and water. tuesday morning, they were seen arguing in their van. witnesses heard shots and then saw kim mcgwire exit the van and collapse dead in front of kensington shopping center. montgomery county police spent the day searching for gilberti knowing he was armed and dangerous making threats to family members and acquaintances. gilberti had been arrested for stalking and violating a protective order on saturday. >> there was an incident over the weekend involving his wife and another acquaintance. he was supposed to be in court this morning for i believe a couple of hearings. we are still trying to nail that down. he was in court for some time this morning. but then did not show up for a later hearing. we know at the time of the homicide was just after 9:30. >> reporter: we believ
