when i asked a spokesperson for israel's defense forces whether or not it would have an impact, he said the short answer is we don't know. but right now, things are quiet on the border. so much frustration inside gaza, they believe israel is lying that this was something that happened because of islamic jihad fired misfire and hit the hospital. >> ellison, the hospital blast, how do things seem on the ground now, more tense? >> reporter: you know, i was just talking with someone who's inside of gaza, he's from gaza city, he and his family have evacuated a few miles to the south and i was asking him about some of the claims that have come out from israel, remember they have released footage that proves it wasn't their weapon that fell on this, they didn't launch an aerial bombardment targeting this hospital. they say they had absolutely nothing to do with it and they also released audio recording. people inside of gaza, though, they don't believe that, they say israel has a history of lying about things when things go wrong, they believe that islamic gee had, hamas, they don't have the weapons capability to carry out an explosion that looks this big and there's a lot of tension and nbc news hasn't been able to independently determined what happened here all we know is that hundreds of civilians died in that explosion. >> ellison, thank you. >>> we'll pick up that conversation now the u.s. intelligence community closely watching the developing situation in gaza and israel, that includes that deadly hospital blast we've been talking about in gaza city, if you look online today or social media you might see any number of unverified collapse about who was responsible, two senior u.s. officials tell nbc news that an independent assessment shows it was a rock from the palestinian islamic jihad that misfired and hit the hospital. i want to bring in stephanie gosk. she's been breaking down what it is we know. be transparent with our audience. >> what we've been told. >> what we've been told, thank you. let's start with what i just said u.s. officials are saying, look, this looks like this was an errant rocket. >> yes, it dovetails with what israelis are saying right now. they held a lengthy press conference in english. complete with images. they're saying that the damage isn't as bad as hamas is saying and casualties aren't as high as hamas is saying. the rocket didn't hit this parking lot, if it had been an israeli missile you would have seen damage to these building here and there aren't any damages. the crater the size of the crater where the missile would have impacted, they showed these two images of previous israeli strikes and you have basically 20 to 60 feet in diameter and what was in that parking lot wasn't even close to that and they also alleged that hamas realizes very soon that it had -- it was actually islamic jihad rocket but then twisted the story for its own benefit spreading that in their own words the narrative to the arab world and we've seen the result of that. >> let's flip to the other side, what palestinians are saying or hamas. >> they're saying right before the attack, there was actually a warning from the sraelis to clear out of the area one indication it was an israeli missile attack and they talk about the damage. we can't verify it ourselves. american journalists aren't on the ground in gaza. what palestinians are saying right now there's a significant amount of damage that could only have been created by an israeli missile. the angle that missile had taken and they also point out in the past idf has been wrong about incidents. palestinian journalist who was shot, they had to walk it back and say it was israeli military. >>> just 11 minutes after its founding, president harry s. truman and the united states of america became the first nation to recognize israel. we stood by your side ever since. we'll stand by your side now. >> president biden is once again reinforcing america's commitment to support israel in its war with hamas. >> the president was supposed to meet with leaders of egypt, palestine. but that was called off. an degree mitchell, tensions are high in so many parts of the world right now, what do you make of the cancellation of those meetings with arab leaders? >> i mean, it's so unfortunate. it's the result of the horrible bombing of the hospital in gaza and the meeting, the summit in jordan that was supposed to be held today was a key part of the president's mission, he wanted to be both in israel, of course, reinforcing support, but also cautioning them to limit the civilian casualties, finding out what happened at the hospital in gaza and he agreed, that the u.s. intelligence has concluded that the israelis weren't responsible contrary to the claims from hamas. but the fact that the arab meeting was cancelled, that was supposed to be the balancing act, and it was a very important mission, he wanted to be there to get the crossing open into egypt, dependent largely on the president of egypt, el-sisi, and to get all sides to agree. the humanitarian aid has to get in for the weeks and months this invasion may continue. with all of that, try to prevent the war from extending, stop terror attacks, but instead you had the horrible bombing, immediate claim of responsibility by hamas towards israel, saying that israel was responsible and there was a gap there before israel denied it. saying that they evidence to the contrary. by then, you were seeing protests in jordan, protests in beirut, very violent protests as well. the declaration of day of rage from hezbollah in the north and of course the cancellation of the summit and that that eliminated the possibility of getting the aid in, getting hostages out and other civilians out, and also looking towards the future of what a post-hamas gaza could look like. >> we've been talking a lot about hamas and hezbollah, but senior u.s. officials say it was a different group that misfired a rocket that hit the hospital, can you tell us about the other militant groups operating in the middle east? >> within gaza, in particular, palestinian islamic jihad is very active, they claim they already hold hostages, they have some of the people they have taken from israel as well as they're responsible for terror acts. that's the claim from the u.s. and others that it's the islamic jihad. if that's true, we can't determine. we can't get in on the ground. you have everyone pointing at each other. it could be that the islamic jihad was trying to wreck with somewhat promising conversations for getting hostages out. >> andrea, quickly, the state department, their request for more than 350 u.s. citizens now wanting to leave gaza, i know earlier today president biden said the u.s. is giving humanitarian assistance to palestinians in gaza, too, food, water, medicine, how soon can any of that happen? >> yes, she was. >> reporter: he said her hospital treatment got so bad he tweeted in part. i can't wait to write a tell-all about my experience. four days later she was died. >> we used to take pictures all the time -- >> reporter: mcintyre said doctors missed repeat signs of hellp syndrome. now the 31-year-old is a single father to their 3-year-old son elias. today he sports the grieving families act. legislation in new york that would permit families in wrongful death suits to recover compensation for their anguish. >>. >> receiving quality care -- >> reporter: instead in new york, wrongful death compensation is based on the potential future income of the person who died, which can lead to quote problematic payout calculations. >> for example, it says children's lives or lives of elderly are worth much less. it also tends to value men's lives much more than women's lives. >> to get groceries on the way home. >> reporter: it's a reality that he's felt firsthand. his 66-year-old mother ruth was murdered last year in the tops supermarket shooting. at 86, ruth was the oldest victim and a lifelong work from home mother. >> for her life not to be valued because of her children's profession, because of her age, is outrageous. she was invaluable. >> reporter: opponents to the grieving families act, updating the wrongful death calculation would drive up liability costs for malpractice. >> you're going to lose more physicians. >> reporter: since 2019 at least two states and washington, d.c., have passed laws banning the use of race, gender in the wrongful death calculations. it's not just about compensation but accountability and equity. >> we don't want to put a price tag on amber. you know, she's not just another statistic. >> bruce has filed a wrongful death lawsuit with the hospital and the litigation is ongoing. in a statement, that hospital tells nbc news they're not able to share information about the case due to pending litigation and hipaa. and patient privacy rules. as per the grieving families act, new york governor previously vetoed the bill, however she's currently reviewing an updated version. >> what's different about this updated version that might make her sign it in. >> she vetoed the bill back in january the two main differences are changed to statute of limitations. when families can file for damages after a case of wrongful death. some significant shifts there. >> that was a great. thank you so much. >>> there's much more news ahead. >> don't go anywhere. you're watching "nbc news daily". plop plop fizz fizz winter warriors with alka-seltzer plus. >>> welcome back. we are looking at some video right now out of gaza. come take a look at this. this is just sheer devastation from many of the air strikes we now know israel has been launching into gaza trying to attack what they call hamas targets and their specific infrastructure that's allowing them to have command and control. we're just looking at these images of sheer destruction, jose. >> it's unbelievable to see these images. the united nations relief and works agency this morning issuing a stark assessment of the situation in gaza z as the death toll continues to climb. quote, there are not enough body bags. >> the u.n. also says there are more than a million internally displaced people in gaza. after ram as tarry filed this report from outside a hospital in south gaza. >> reporter: on my way to this area i have just spoken to the head of the hospital who is also a mem brer of the senior team. he informed me and in his words the situation is more than catastrophe. the supplies are depleting and on the verge of collapse. they are struggling with the minimum they have to save the lives of the people who are injured and struggling for their lives. because of the ongoing gave station, the medical teams at the hospital and in different areas of the gaza strip have been not going back home for such while. i saw at least two of them, they were seeing their friends and relatives. one of them saw his son killed. he didn't talk about that. because of the destruction of the communication throughout the gaza strip, he didn't know his family was injured and he was saddened and shocked to see his son killed and to see the remaining family members injured. another one also saw his father and his son killed in another place in the gaza north. they were targeted, they were killed, and the doctor was just assuming his job and doing his duties, saving the other people and he was shocked and surprised to see his family there. >> our thanks to gaza journalist asatari. >>oining us now is a palestinian american doctor who lives in texas, and 49 members of his extended family have been killed in the strikes in gaza. thank you so much for joining us. >> thank you. >> i'm very sorry for the losses, what you've experienced. 49 members of your family. can you till us about who you lost? >> well, a few days ago it was seven -- distant cousins, the next day it was my cousin's in-laws, her husband's family, 17 of them were annihilated in one strike. two days ago, 22 members of the joudah family in one of the small suburbs or refugee camps essentially, towns around gaza were killed. last night my father sent me a note that three beautiful little girls also from second cousins were killed last night, two of them are sisters. so that's 49 i think, if the math is correct. you know, i am both heartened and disheartened to watch the first few minutes of your show because the focus on the collective death of palestinians and the collective carnage visited upon them is -- somehow puts a face -- gives the palestinians a face, a face they've always had, and always have. but, of course, i'm disheartened because yet again we get to this moment where we're looking at photographs or videos for a people who are awaiting a life worse than death. you mentioned the morgues, the ice cream vendor morgues which can only fit the bodies of children. this happened in 2014 when israel visited the same brutality on the gaza strip. i was thinking of this morning and it's terrifying for me to think that this is happening again, and some people didn't know it happened before. i have even written about it in some of my work, though not as directly as i am speaking of it noud. i've been asked on several shows if i have photos of any of the dead, of my family, and i don't. and the reasons are many. i am not permitted to go back to gaza to even have photographs with them. i have no access to ask them to send me photographs. and on the occasion that i might, i have to ask them ethically, at least for me, permission to use their photographs of the dead. i know that i would also feel conflicted to ask because they would feel -- i know they would feel terrible about having their photos on u.s. tvs, no matter the good intention from the same system that has sanctioned their killing and has sanctioned it before. but we as human beings understand that every human has a face, and the proof of relatability does not have to be burden of proof on the dead. >> doctor, absolutely every human has a face, every human has a soul, every human has worth. in this so conflicted time, you whose profession and vocation is to help heal as a doctor, how do you process and help us understand how difficult it is for this to finally be focused on people and innocent people who a week ago were massacred in their homes, in a concert and who now in your case 49 family members have been lost? >> yeah, my case is irrelevant -- less relevant to me because it is a collective case at this point. i hold on to what i say. if we truly believe that people are equal, the palestinian question will be solved a lot sooner. this is difficult for people to hear in english, in american english, but we do not view palestinians as equal. i know in our hearts when the situation is presented to us linguistically as a rational thing to hear, every one of us will say, but of course i see you as my equal or my brother, my fellow human, fellow citizen. in reality, this is not afforded to the palestinians. if it is afforded to the palestinians, we would all pause and say, well, what does it -- what would that entail? what would it entail for palestinians to have equal rights to the majority of civilians in israel who have always water, electricity and often a greater, greater, by folds, degree of security than most palestinians have. freedom of movement and even freedom to books, reading, travel, et cetera, et cetera. the language we have constructed i think over the last few decades that prevent us from seeing this simply is what we have to come to terms with in america so that we can open our hearts truly to what we all believe in, that we are all truly equal. >> i think you heard in the interview last night from president biden that he believes longer-term solution to this conflict in the middle east specifically in israel and palestinian territories and trying to determine where this all heads, he sees as a two-state solution. of course, this is something that has been a complicated negotiation and, unfortunately, led to a lot of violence over decades and decades and decades. this is a new flashpoint. we're also in a situation where it was a historical attack that happened against the israeli people by hamas, and that complicates it even more. thank you for sharing your thoughts and perspective, and our heart is with you. >> it's complication because we do not sees the palestinians equally. what about the catastrophes and the unheralded attacks on palestinians, also? >> well, hamas clearly brought upon itself, brought the palestinian people into and unfolding tragedy of epic proportions. this is going to get immensely worse before it gets better. in my judgment the idf must get into gaza, an your want built-up area, three-dimensional battle, above ground, below ground, surface streets. they've got to take out the structure, the root of the hamas military and political leadership, and it's going to be a very intense battle. they're trying to minimize the terrible impact on the palestinians by having them move out of the main zone of combat. this is going to be an atrocious battle. the idf has no option. it cannot survive when hamas can conduct attacks and brutally murder hundreds and hundreds of innocent civilians. so this attack is imminent now. it will not be resolved in a few days. president biden correctly said they don't want to occupy gaza, but this is not going to be over until the idf is convinced that they will not be vulnerable to another attack of this nature. >> general, when we hear so many times that gaza is isolated, nothing comes in, nothing comes out. they're able -- hamas is able to get quite an arsenal of weapons, we're talking rpgs, surface-to-air missiles, claymore mines. where are they getting this amount of arms from? how? i'm just wondering, general, when you're talking about how israel has to take out hamas by its roots, how do you think that is going to be accomplished in this particular scene? >> well, of course, the isolation of the gaza strip and it's a couple million people, thousands and thousands of palestinians work in israel on a daily basis. there's still a fishing fleet occasionally used to smuggle things into gaza. there are tunnels underground that go from gaza into egypt. egypt has very poor control over the eastern sinai. there's a jihadist insurrection targeted on egypt, also. but behind all of it is iran, principally supplying weapons and training but also direction and moral backing, political backing to these hate-filled groups that threaten the very existence of israel. no question that hamas fighters, maybe 30,000 of them will put up a stiff fight, many until death. again, i see no option for the idf but to go in, spend the weeks necessary to attempt to find hostages, some of whom undoubtedly will be rescued, but principally to find, locate and destroy the hamas military and political leadership. >> general barry mccaffrey, thank you for being with us this morning. >>> up next, a view from lebanon where israeli forces have been fighting a different group, hezbollah. could this war now be spilling out of israel and into the wider region? the middle east, that's the new warning from the united nations as tensions escalate. the israeli offensive into gaza seems imminent. these are live pictures, as you see, from gaza city at 5:41 in the afternoon. >>> meantime, up on the northern border of israel, the idf says shots were fired at idf forces on the lebanese border. let's bring in nbc's foreign correspondent matt bradley who is in tyre let me none. what new developments are you seeing on that border? >> reporter: we're hearing reports from both hezbollah and the idf saying there's been these tit-for-tat attacks. there was one fatality and before that two killed on the lebanese side. clearly what we've been seeing is a simmering of the situation on the border. any wrong move could turn it into a full-on boil and it could boil over. in 20 '06 this whole thing went from totally quiet to a full-blown war in just a matter of hours. now we have all this diplomacy swirling around the region with different actors trying to both tamp down the threat of an internationalization of this conflict while at the same time stoking and goading each other into further war. i'm speaking about the united states and iran whose foreign ministers have been making tours around the region. >> matt, you spoke with a hezbollah member of parliament in lebanon. what did he have to say about all of this? >> i spoke with this hezbollah member. remember, hezbollah like amass is backed by iran. he basically made a somewhat sinister reference to american ships parked off my left shoulder in the eastern mediterranean, meant to act as a deterrence. here is what he told me. >> reporter: so, as you heard, he laughed openly at my question about america projecting its power into lebanon and trying to use its military assets, naval assets as a deterrence. he was referencing something very sinister. he actually mentioned the 1983 attack widely blamed on hezbollah, though not proven necessarily, on a u.s. marine barracks in beirut that killed more than 250 u.s. service members. that was a sinister threat and the kind of thing that really brings the past right into the present. you could dismiss this as bluster or bravado. but the fact is he es right that hezbollah is maybe more powerful 40 years ago because it's taken position in the lebanese government, more advanced weapons. unlike hamas it has directed missile, and it has freedom of movement. it has a lot of strength that would dwarf even that of hamas. >> matt bradley, keep us posted. appreciate your reporting. >>> we want to bring in former state department senior adviser najera hawk. i was fascinated by matt bradley's conversation with that member of parliament because, as he was saying, hezbollah is very much a part of lebanon, and they have such influence and impact in syria. this is a group that is different from -- in many ways from what we're seeing in gaza. they are much more powerful. what do you make of those comments? >> here is what they have in common. hezbollah and hamas both backed by iran, and iran never really getting into that direct warfare itself. it spreads its tentacles through organizations like hamas and hezbollah along lines of common issues such as chanting "death to israel." they're relying around what they consider a common en meechlt that's constantly going to be a challenge for israel as it notes its way through the war and the middle east is that it is working with and surrounded by entities that simply do not want it to exist. hezbollah has been around for much longer, but they don't really control a state in any meaningful way because lebanon has been in civil war. even with cease-fires people are suffering. that's where hamas and hezbollah start to lose ground. they have never proven to be effective governing bodies and the people they claim to represent also end up suffering. >> i also want to ask you because hezbollah is backed by iran, more collectly even than hamas is my understanding. we're hearing that heavy losses could be inflicted on the united states, quoting what he said yesterday. what do you think iran is prepared to do in all of this? >> as part of their asymmetric warfare, the way that they operate, they will be keeping an eye out on american torths, mostly hard targets such as military installations because they do know that when civilians -- american civilians are under attack, the united states comes in full force. they'll be looking to avoid u.s. direct engagement while still sucking in others, other democratic states into this conflict and making it just a tension situation that the world has captured and keeps focusing on. one of the things that may or may not be a good thing is saudi arabia now talking to iran, something they have not done directly for decades. china is the one that opened up that channel between iran and saudi arabia. saudi arabia has one of the largest military installations of the united states. it is our other ally in the region. it remains to be scene if saudi arabia is going to be a force for good or a force for self-interest. >> najera haq, thank you for being with us. >>> more coverage of the war in just a moment. also following breaking news out of washington. judge tanya chut kin is hearing arguments over whether to impose a gag order on donald trump that would keep the former president from are commenting on his federal election interference case. nbc justice and intelligence correspondent ken dilanian is outside the courthouse for us. what are we hearing so far, ken? >> reporter: this is the most consequential pretrial hearing in the case because it could affect how donald trump can campaign for president. we heard a forceful argument from prosecutors that there needs to be restrictions on what p is say to disparage the prosecutors, witnesses, the judge. he's called jack smith a deranged luna accused judge tanya chutkan of being an baem hack. his lawyers are arguing this would impede his first amendment rights. what judge chutkan has said as a baseline is, look, he is a criminal defendant and can't just say and do what he pleases. she raised the question of, if i do impose a gag order, how do i enforce it? (vo) get iphone15 pro, apple tv 4k and 6 months of apple one. all three on us. only on verizon. keith morrison: it was a start, >> it was a start. the first lead in the robin hoynes murder investigation. a name had surfaced, william marshall. marshall was a former kfc employee who had worked with robin at the very same restaurant where she was killed. on the night of the murder, he was supposed to stop by the store. >> he was due to return some equipment or a uniform and also pick up a briefcase that belong to him. >> a kfc uniform, which william marshall did not need anymore. and for a very good reason. >> william marshall had been terminated because of missing cash and failed polygraphs. they had two situations reported to the torrance police department concerning thefts of cash from the safe. to thefts on the very same safeway robin had left the money. and though they could not exactly prove that he did it, marshall was a suspect. he had the opportunity, he failed the polygraph when questioned about those previous robberies. and at the time, he knew the combination of the safe. so, the night that robin was killed, did marshall it had to rob the safe again? >> he knew the previous combinations. i don't know if he was aware that they had changed them, because it had happened several days earlier. >> detectives brought william marshall in for questioning. he was friendly, cooperative. said that he was home entire evening and that he could prove it, he said. all police had to do was go ask his girlfriend. yvonne hargrove. without telling them why he were talking to her, they did ask. >> i told him that william was with me that night. and what did we do? i said that we cooked a spaghetti dinner. >> yvonne seemed credible. never wavered in supporting marshalls story. it was -- so maybe the marshall idea was a dead end. as they were leaving, cops had one more question though. did she know anything about that mysterious piece of foam found at the crime scene? >> they brought out this thing. kind of funny shaped. funny color. you know with this is? >> i said no, i had never seen that before. >> so what could they do? they let william marshall go. the cops had nothing on him. robin hoynes funeral was a big event in this part of town. and because robin was well known and so well liked, much of the neighborhood attended. and friends and colleagues. except for one, cheryl, the girl who had switched shifts with robin the night the murderer came to call. >> i had heard that they were really upset with me. and that they did not want me at her funeral. and i did not go. i felt really sad that i traded hours with her. that should have maybe been me. i just felt very guilty. >> a few days after robin's murder, the case seemed to be going sideways. william marshall remained only a person of interest. no new leads had emerged. and that odd clue, the piece of foam, was still just a mystery. then came a break. police got a call from an employee at a kentucky fried chicken outlet about 30 miles away from the one where robin was killed. he had claimed that someone in army fatigues, when akot club and boots had been casing the store after hours. detective lancaster showed the employee pictures of several suspects who might have been prowling at the kfc that night. and he picked out william marshall as being the person that was acting suspicious around this business at 11, 11:30 at night. >> marshall was put under surveillance and followed for a few days. and where did he go? back to the very same kfc where he was prowling in the week before. employees there would not let marshall in, so he drove off. and the cops followed. a few miles later, they pulled him over. >> after removing him from the car, we found what we thought was the weapon that he had used in our homicide, which was a 7 to 9 inch 00 knife in the backpack he was carrying. >> there was no usable evidence on that knife, but it was the right size in shape. so it looked, to the cops at least, that they had their man. william marshall was arrested. his knife, clothes and boots found in the car were booked to evidence. under california law, detective lancaster had two days. either charge him or release him. he took the case to the da, made his best argument. >> i felt that going in we had a good case. maybe a tough case, a circumstantial case, but a good case. >> going in? >> going out? >> i felt like we had been kicked. nobody showed any interest, complete rejection on prosecution. >> too circumstantial, said the da. and no incriminating evidence. even on those items seized from marshalls car. >> marshall was released from jail. his girlfriend yvonne picked him up. once again, detective lancaster had to deliver the news to the hoynes family. the only suspect that he had was back on the streets. >> and his life goes forward and robins is snuffed out and she never gets to meet her potential. because of what he did. >> they all suffered. all the hoynes. perhaps mr. hoynes most of all. >> our dad felt like he had not done what he was supposed to do. as a father, because he did not protect her. he did not keep her safe. >> our dad would sit at the edge of his bed and just think about robin. and wait for her to walk down the hall. every day. >> of course, they did not know -- none of them did, that the solution was sitting right there in plain sight. until somebody closed the lid and filed it all away. >> coming up, nearly 20 years would go by without a break, until a fresh pair of eyes focused on one particular photograph and saw something new. >> i thought, it couldn't, be it couldn't be. >> when dateline continues. you want to be able to provide your child with the tools or resources they need. with reliable internet at home, through the internet essentials program, the world opened up. fellas, fellas. that's how my son was able to find the hidden genius project. we wanted to give y'all the necessary skills to compete with the future. kevin's now part of this next generation of young people who feel they can thrive. ♪ ♪ >> hello, i'm katie phang. here's what's happening. the israel-hamas war appears to have escalated and entered a new phase. israel pounded gaza with a promotional thumbs overnight. israeli forces say they struck 150 underground targets and killed several hamas terrorists, including the hamas leader who directed the aerial attacks on october 7th. the suspect in maine's mass shooting on wednesday is dead. authorities say robert card was found with a self inflicted gunshot wound near a recycling center where he used to work. 18 people were killed in the shooting spree, including a 14-year-old boy. now, back to dateline. ack to datele.in welcome back to "dateline." welcome back to dateline, i'm andrea canning, investigators have a person of interest in the murder of 21 -year-old robin moines. william marshall, marshall has an alibi. there isn't enough evidence to bring charges against him. a break in the case would come. but not for another 20 years. here, again, keith morrison with the night before halloween. >> october 1985, another halloween. once the hoynes house would've been festive, not anymore. they closed the door, turned out the lights. just the word, halloween, unleashed a wave of grief. the investigation into her murder was stalled, even though police had a suspect in plain sight. william marshall. the family groped for solace. >> we knew, ultimately, that they answer to a higher power. we just had to take comfort in that because we really are probably never going to see any resolution in this. they didn't have enough evidence. >> years passed. there were other cases to solve, new priorities, of course. for detective lancaster, retirement. >> there are cases that stay with you for the rest of your career. at least for me. this is one of them. >> the hoynes family struggle to move on without robin. there were high school graduations, marriages, children. but -- >> the hole doesn't go away. >> there are times when you need to have a tissue handy? >> absolutely. absolutely. >> and then, a decade after robin's murder -- >> our dad committed suicide. it was devastating for us. it's true, he had a terminal illness. he was dying of emphysema. but honestly, he was dying of grief. >> virgil hoynes was just 61. by 2003, the robin hoynes murder case was as cold as they come. 19 halloween's old. buried in the basement of the torrnace police department forgotten. but that year, the department are viewing unsolved murder's. the hoynes case caught the attention of da john lewin, taking special pleasure in cracking unsolved cases. >> this is my favorite thing to do. if i won three billion dollars tomorrow, i would be coming to work. because i love doing but i love. >> when lewin read about the original suspect, william marshall -- >> my response was, wow. there is no question this guy did it. i mean, there is just no doubt, whatsoever. >> but did he have enough to prove it? the job of finding some new evidence fell to detective with an unusual pedigree, jim wallace. >> i was in architecture school for a while. i tried design. i had a bachelors degree inside. >> odd but it helps, says detective wallace. >> a lot of these cases, this case in particular, are very visual. i am inclined that way. i see the structure of the space, the crime scene. every little detail the crime scene sticks out to me a little more. >> so, wallace looked at the photos and the fragments of evidence still preserved. >> and i said, wow. the anomaly in the room is right here. if i can solve this, i can put the whole thing together. >> the anomaly. that would be the puzzling piece of evidence, which haunted investigators from us two decades. that odd, oblong hunk of foam. >> and it was either gonna come from robin, the victim. or going to come from the suspect in the case. once i was comfortable that this didn't come from robin's purse, it didn't come from robin's clothing. it is not from the kentucky fried chicken restaurant. it doesn't belong there. >> it left only one other possibility. the murder. wallace poured over those pictures of the one suspect, marshall when he was pulled over by the cops a few weeks after robin's murder. >> but suddenly, a light went on. >> he is wearing his clothing, still, of course. he has a pair of work boots. the work boots, sure enough, i can see just enough from the pants up, i wondered if those are the kind of work boots that have that. it couldn't be. it couldn't be. >> could it be the foam? >> wallace rushed down to the evidence storage room, looking for the box with williams boots inside. amazingly, after two decades, they were still there. in a plastic container, intact. >> sure enough, when i pulled them out, one of the boots had the brown leather casing for that part of the boot. it was so worn, that the foam was missing from the casing. >> come on. >> i was sitting there looking at that ship. i gotta tell you, there was a tingle at my neck. for sure, at the back of my neck. >> wallace thought he had hit the jackpot. the phone from the kfc appear to have matched the remaining foam in william marshals boot, even the color and curvature. >> that foam, he thought, must have fallen from marshals boot right at the scene of the murder. wallace rushed the news to the assistant da john lewin. >> i could have looked at that foam for six years. though she is. i never would have put that together. ever. but jim saw it and then we took it to the fbi. >> the fbi crime lab in virginia, where the foam from marshals boot and the foam from the kfc would be compared to confirm they matched. it was obvious to the detective that they did. a test, really, was just a legal routine. no problem. >> i can remember getting the call from the fbi analyst. my expectation was that she was gonna tell us, i have a match. >> and? it was like a needle going through a balloon. there was a problem. >> she was not willing to say. i can't say with any certainty that this is from the same ship because, let's face it, one has -- and one dozen. >> validates? what in the world at? those one thing that they were troubled against the case in william marshall. there used impasse plastics to meet the more flexible and durable. anything from plastic bags to containers. if that chemical turned up in the chemical in marshals boots, but not the from the crime scene, wouldn't that exclude marshall as a suspect? >> he was a firefighter. worked his way up to fire captain here in the station in 2000. >> a fire captain with the california department of forestry. according to hutchinson, he was responsible for the station. by the year 2003, marshall had been almost 15 years here. lived quietly in this rustic community. in this mountain center. people called him bill, respected him, trust him to keep them safe. >> he lived right there at the house behind me. >> he made friends with martial soon after he moved. and >> he was really good person. he was very well respected. he fit in real well here on the mountains. >> back in torrents, the case that detectives had provided was not beginning to fit so well. they had stacked back pieces of evidence to -- but the lab wouldn't be definitively back it up. without some break, the case would stall, again. what to do? well, it was, perhaps, a long shot. but deputy da figure that the allied that martial council girlfriend, you vaughan, was a little shaky. so, he had an idea. what if detectives interviewed both yvonne and marshall on the very same day? would they trip themselves up with divergent stories? >> two teams went out. the day mr. marshall was contacted, one team contacted him and a second team went to ohio and contacted her. >> yvonne was living in cleveland by then. >> and they say, we need to talk to you about something that happened 20 years ago. my brain when it's like this. i'm like, okay. they tell me that they are reopening the one about william and the kfc. they asked me, was he with you? i said, yes, the whole night. >> all those years later, yvonne has insisted that the story she told then and now we're absolutely and positively true. william marshalls alibi remained rock solid. meanwhile, 2500 miles away, high in the mountains, detectives pulled up to william marshalls house. not knowing what to expect. >> for whatever reason, he was comfortable enough with us to let us in. >> things unfolded slowly. marshall was cooperative and even keeled, and enfold now it's all guilt whatsoever. then, detective walsh tried a different approach. they are talking about shoes. why that distinctive wear pattern on the shoes please seized from marshall after he was first arrested after thethk? >> he did explain to us that his pattern of shoe wear was such that he typically wore out his shoes in this fashion. he wouldn't untie his shoes to get them off. he would kick them off. that rubbing of the heel constantly rubbing, coming out a shoe, eventually wears his shoes. he actually showed us several pairs of shoes with the exact same pattern of wear. >> then, detectives surprised marshall. they revealed the existence of that strange piece of foam found at the crime scene. they told him that one of the boots seized from him was so worn, it was missing a piece of phone. the remaining foam in the boot seemed to match it just about perfectly. the cops asked marshall, can you take some pictures of those worn out shoes? that is when marshall put on the brakes. and with that, the interview was over. interesting, sure. but usable evidence? well, none, really. back in cleveland, it hadn't gone so well either. the cops were wrapping up their meeting with marshall's former girlfriend, ivan. then, just before they left, almost as an afterthought. she offered something, a strange story about william. about something he said when she picked him up for the police station when she was versus a spotting robins murder. >> he is crying say, how am i going to get to heaven? how my going to get to heaven? how am i gonna get to heaven? he kept seeing this over and over and over. >> that is as far as she would offer. it sounds like that this is a statement made by somebody who feared because he had done something. >> intriguing, but not exactly incriminating. the cops needed more. so, wallace returned to the fire captain's house, this time with a search warrant. >> going back a second time, he had gotten rid of all the shoes. the closet was completely cleaned. all of those shos were missing. now, interestingly, on the back porch, he left one pair of shoes though. the one pair he didn't get rid of. they had the same pattern of. wear. i did click those, as well. we use those to demonstrate that the marshall was one of the people who would wear his shoe this lie. >> more circumstantial evidence. but nothing definitively connecting william marshall to the crime. that afterthought from yvonne had been interesting, but might have meant nothing. then, back in cleveland, after the visit from the cops, even got to do a bit of soul searching. >> coming up, i know with that thing was on the campaign. >> what was it? all this as the pressure is building for republicans to reach a consensus and pass much needed funding for israel. to say nothing of ukraine and the budget battles to come. nbc's ryan noble is joining us from capitol hill and also with us is fred upton. welcome both, ryan, where do things stand in the speaker's race, did they begin their second conference of the day, and have we gotten any word on what they are doing? are they actually going to get to a roll call inside? >> reporter: that's a great question, andrea, and i can tell you that that second conference meeting is happening here behind me. we saw a long line of republican members of congress make their way into that building and into that room. we've heard a smattering of applause, so we should be under the impression right now that the nomination and forum part of this proceeding will take place. essentially the two candidates will be nominated. there will be fellow members that will give speeches on their behalf, and they'll get to make their pitch to the rest of the conference. this vote will be a private vote, so members will be able to vote their conscience without any specific consequence. the final outcome will be important. we widely suspect that jim jordan will be successful. he has now faced a challenger in the form of austin scott of georgia. it's really that margin of victory that we'll be looking for. as you rightly point out, andrea, you know, this candidate winning in this is only part of the battle. it's a small step towards the lodge goal of becoming speaker of the house. they would need 217 votes on the floor. if there's a sizable number of republicans that are willing to vote for austin scott who up until yesterday or up until about an hour ago showed no leadership ambition whatsoever, that would show that jordan does have problems within the conference. there is the possibility that they do this vote internally, they emerge with a nominee and then patrick mchenry the speaker pro tem makes an effort to take it right to the floor and drama again on the house floor. >> i should point out that you were warning us the other day when steve scalise was nominated that it was only a preliminary vote and did not mean that he by any means would come to 217. he had i guess 113. some of those were non-voting members, and jim jordan had 99, and there were 99 people against him, if not more, and he actually lost votes as he was trying to whip the count all day yesterday before backing out. so that sets the stage, you know this better than i. jim jordan just got a key endorsement from the chairman of the republican congressional committee. what do you think? is there a chance jordan could overcome the opposition of a lot of more moderate republicans? >> well, a couple of things. first, you need to know that i'm told that more than a dozen republicans have left washington, gone back to their districts, perhaps some to the other side of the country. so even if -- and i expect that jordan will get a majority today for sure. i mean, he's been campaigning for this for now two weeks, ten days. and so he'll get a majority, but he's not going to get 217 on the floor, and neither would austin scott, i think. i mean, things are really bitter right now. so chances are that, you know, assuming that jordan gets the votes, they'll have to say, well, we'll try to do this tomorrow. so everybody come back to the beltway, everybody come back to d.c., 1:00 so people can come back. if nobody gets to 17 and still not likely, that really punts it into next week, and that's where you'll have something like perhaps patrick mchenry, one that's widely respected on both sides of the aisle, doesn't want the job but maybe shut things down until earlier this morning when someone tried to raise and expand his powers. he doesn't want to do this. he's not part of that effort. but the world is ablaze right now. we've got israel, we've got ukraine. here in michigan we've got the uaw strike. we have the cr so you got all these federal employees going what the heck is going on. are we going to keep the government open a month from now, when you're not even talking to each other? no one has any idea. we're going to the north of gaza, which isn't near at all, which isn't safe at all. just pray for us and hopefully we'll come back home. we will come back home. >> the u.n. says the evacuation of northern gaza is not possible without devastating humanitarian consequences. hamas has been telling residents to ignore thousands of evacuation flyers dropped by israel and stay put. stay at home. human rights watch says even if all of northern gaza does try to leave, one day is not enough time. that's not to mention hospitals in gaza, many inside the evacuation zone, which are all filled to the brim and say them not move wounded patients, many of them children and teenagers: joining me now is phil chetwin, the global news director, phil, thank you, i don't know if you still have reporters inside gaza. others are trying to get out because it looks so ominous for journalists as well as any westerners, americans and others. >> it's been a really tough few days. we have nine journalists still in gaza, and today we have moved them down to the south of the gaza strip as really all of them fear this looming israeli operation and this so-called deadline because it's not just that they're working on their own. they're not just making their own choices. of course they've also got all their families around them. so when we say we've moved nine journalists, it's about 40, 5 people with all their families and their main fear really is to get their families to safety so that they can then try to work, you know, in a clearer -- in a clearer way. >> phil, 40% of the population in gaza are children under the age of 15. many of them have been injured by shrapnel. we've seen evidence from hospital and other hospitals. how hard is it for people to evacuate? is it inadvisable perhaps to be walking at night on campus as a jew. >> it's terrifying. i'm stammering. thinking about it makes me scared. >> well, it's something colleges and universities around the country are now grappling with as students clash over the israel hamas war. so with many students fearing for their safety and their mental health, how are college students coping with the rising tensions? i want to bring in cornell daily sun news editors. thank you both for being with us. julia, i could hear raw emotion in those students' voices. what's the feeling on the ground at cornell right now? >> i'd say that jewish students that we've talked to express concern about these threats but at the same time, they have begged the university and local police department who are responding promptly and effectively. they've also expressed to some degree a sense of trying to stay prideful and you know, fight against these threats by staying true to their identities and not let the fear win. >> jonathan, you reported there were also antimuslim threats as well. i'm wondering just the overall atmosphere on the campus, what kinds of conversations are you having and what are some of the students there telling you about how they're doing? >> so, the students that i've spoken to have, they've, the jewish students especially after sunday's threats, they've, on sunday, they expressed they were naturally shaken up by the threats they were posted to greek rank which is a public forum. anyone can post. you don't have to be affiliated with cornell. and some of the muslim and generally palestinian students have also expressed to me that like the reporting, they are worried about being, having their addresses and personal information posted online because of their support for palestine. >> i want to play for our audience a little bit of what new york governor hochul said yesterday when she was visiting your campus. >> we will not tolerate threats or hatred or antisemitism or any kind of hatred that makes people feel vulnerable. and exposes people and makes them feel insecure in a place they should be enjoying their campus life without fear. no one should be afraid to walk from their dorm or their dining hall to a classroom. that is a basic right. >> julia, i think we can all agree with that. and you mentioned many of the students you talked to feel there's been a response. obviously, the governor came. your campus authorities. the security. the increased security. so visually, they're seeing a change. but do they feel a change? in terms of the atmosphere on campus? is it helping? >> so i think that in addition to the resources that were provided on a security level, there have been a lot of outreach on behalf of religious leaders, professors and community departments in charge of mental health. because this is not just a threat to physical well-being but mental well-being. based off the expression of the people that we've interviewed and i think that some students have kind of talkedension on campus based upon some other incidents that have occurred relating to graffiti that was anti israel, anti zionist. but at the same time, we've had a lot of the great community discussions that have been more peaceful in nature. all of the rallies and protests and demonstrations so far have been peaceful. >> jonathan, it occurs to me that this is not as horrible, it's also not happening in a vacuum, right? everybody on that campus, all the students, had to live in some form of isolation during the pandemic. whether they were in high school or college. so they're still coping with the aftermath of covid. it's a hard time to be a college student and frankly, you're spending a lot of money to prepare for a career. do you and other students you've talked to find it hard to concentrate on that goal with everything going on in the world? >> that hasn't really been something that's come up in interviews i've conducted for my reporting right now. >> that's good to hear, but do you feel a confidence that this campus is going to be able to move past and again, i mean, you're not going to move past antisemitism as a scourge in this country. that's a much larger issue, but get back to the business of doing what college students want to and should be able to do? justice kagan making a direct esident who blocked critics fromolwing him on twitter. >> sometimes, he was announcing policies. even when he wasn't, i don't think a citizen would bee to reerand the trump presidency, if you ithout any access to all the things that the president said on that account. it was anta part of h he wielded hisutrity and to cut a citizen off from that is to cut a citizen off from part of the way that government works. >> joining me now, nbc's laura jarrett and lisa ruben. good to have both of you here onset. i'm sure you both remember that kagan joked and got a laugh earlier in the year when she said the nine supreme court justices are not exactly the key experts on the internet. >> she always finds a way to joke. >> yeah, she's good at that. but the question is does blocking an opponent violate the constitution's first amendment? >> yeah and that's the question they're grappling with. this time as it relates to two public school board officials in california and also a city manager in michigan. so we're talking about state officials but they were getting nasty comments and so as everybody does nowadays, you can block people and the question is is that violating their constituents, those people's rights by not having access to those people. part of the line drawing issue the court is engaging in is that these officials are using their private accounts or private platforms but posting about stuff related to work. so the court is trying to figure out how we're supposed to draw that line. these are not their government accounts but private accounts. >> give us more insight into that, lisa. walk us through what the justices are weighing in this case. >> the right of the public to have access to information implicating their governments, right? there's a first amendment right at issue there. one of the things we're really struggling with today, chris, is identifying that there is some degree of interest there. there are some posts even on private account that are unquestionably part of a constituent's right to understand what's happening in their state or their locality. even something as simple as justice kavanaugh said about taking the trash out, for example. but at the same time, there are some posts there that don't implicate those rights. so that line drawing, i think we're going to see a supreme court that sides with the plaintiffs in some respects but how they draw those lines and exactly what the test is remains to be seen. >> so even if they do say at least some of these social media posts can't be blocked, how does that get enforced and who does it? >> that's one of the big questions is exactly the plaintiff supposed to bring that to somebody's attention or perhaps it's a decision that serves as a guide post for local and state officials, federal officials going forward about how they should conform their posts to match the opinion. this isn't even the only social media case on docket this term. there's another interesting sort of the flip side of this where conservatives were worried about twitter and facebook and other social media platforms sensors conservative speech. so they wanted to make sure the posts in different platforms couldn't do that. we'll wait to see what the court does on that, too. there's another case about the biden administration and what interactions they can have. this came up a lot during covid. so the court is really trying to take this issue on even though as kagan would programs admit, they're at a stage in life where they're not using the social media platforms. >> we've only got 20 seconds left. what does the timeline look like for this? tensions over the war grow here. >> yeah, a joint fbi and department of homeland security bulletin is warning local authorities about the heightened possibility of violence over what's going on in gaza and israel. attorney general merrick garland says the department of justice is laser focused on keeping americans safe. >> we are seeing an increase in reported threats against faith communities, particularly jewish, muslim, and arab communities and institutions. the entire justice department remains vigilant in our efforts to identify and respond to hate crimes, threats of violence, or related incidents with particular attention to threats to faith communities. >> nbc news investigative correspondent tom winter joins us now. so tom, we have been talking all week about these threats, right? but what more can you tell us about the warnings specific to this security bulletin? >> right. so i actually was reviewing some of our reporting on this program and some of our web stories over the week. this memo that went out today is a catch-all of everything that's been out there so far, and the reason for that is the bureau, and joint terrorism task force on the east coast and on the west coast that are kind of providing more updates realtime. you've got our own independent research of what's going out there on the internet, and fbi and dhs sends, here's what we're seeing. what we're seeing is violent rhetoric, and it's interesting and perhaps disturbing through this process that people seem to get more engagement online the stronger their positions are. the more heated the rhetoric they use, and the more violent the images that they publish or put out there in their posts, and so i think that has led to a ratcheting up of the type of rhetoric that we're going to see and we have seen, and where does that go from there? does somebody act out on that in the form of violence? that's really what has law enforcement so concerned. >> that's a good point. i want to ask about the state department out with their new warning about americans abroad, they say, due to increased tensions in various locations around the world, they want americans to exercise increased caution. >> there's an investigative unit that we have been focused on and that's terrorism in europe. there are more individuals there that have ties to terrorist organizations -- actual real ties to terrorist organizations and have the ability to organize. particularly back in 2016, '17, and '18, a group came out and had previous ties to all sorts of terrorist groups and are those individuals given the closest to northern africa which is a hot bed for terrorist groups. there are more individuals that have traditional ties to terrorist organizations and you have as we discussed yesterday, these direct calls from various terrorist organizations for people to act out and commit violence, and so i think when you see that, that led to the state department saying, hey. just because you're not in the united states or because you're not in israel, you might have a problem wherever you travel. >> tom winter, thank you. >> sure thing. >>> the state department says nearly 600 americans are still stuck in gaza. lester holt spoke with one of them. >> what happens when it gets dark where you are? >> you hear the drones get much louder, and you just hear lots of booms. many in the distance. some hit closer, and at times -- at times you hear a whiz go by and something hit closest and those are quite scary as well. it makes you jump whenever you hear a car go by during the day because it sounds like a missile going past, but again, you just -- you try to sleep because you want to wake up with the morning. >> that is emilee rauschenberger. she and her kids and husband have been stuck in gaza since the war broke out. if it sounds familiar, you have been with us before. you were with us a week ago today. we keep checking in with you about your family. that's the first time though that we've seen your daughter, emilee. how does it feel to see for her you and hear what she's saying? >> just delightful. absolutely delightful. i'm glad you could connect with her. we hear from her for a couple of minutes each day because they only have about an hour of internet and i was really happy -- i guess the fact that mr. holt was in tel aviv, maybe he got better connections quicker than we do from the states over there. >> yeah. >> it's just heartfelt. we can't thank nbc for keeping this out front and helping us try to get the americans out of gaza through the rafah border, crossing as well as other foreign nationals. we want them all to come home and leave the country safely. >> i'm sure it's just so great to see her and be hearing from her if only for moments each day. i know though, you told us that your daughter and grandchildren are still cramped into a small apartment with 30 other people? so how are they managing? how are they describing their conditions? >> well, they just took in another family. so now there's 34. the kids and i would say half of them are kids. they won't let the kids out of the house to play during the day which is very difficult on the very young ones like my 4-year-old granddaughter miriam, but they are managing. food supplies are getting a little tight. they sent two of the older kids, nora there in the hot pink. she goes of the with the bread line. her first day in the bread line, she spent two hours, got near the front and got muscled out and then the door shut. she said, the second day i knew what i was doing, and no one was going to muscle me out. they got the -- emilee confirmed the type of bread they have is getting smaller. the bakery is starting to run out of materials. the water -- they have to go out and find a water truck each day for their water needs, but they're trying to make it kind of as much of a campout as they can for the kids. >> you have to pretend. >> as long as they are focused and steadfast and positive, the kids respect their parents, but we just so want to draw attention that we have these foreign nationals and most importantly, americans on the border there. we need the border to open it up to prepare to leave. >> you talked to one person at the state department who got on the phone and they said, we can't help you. since then -- >> right. >> -- the government says, we're going to open up the rafah border and they promised a lot of things and yet your family is still stuck. have you gotten any updates? >> no. we knew they had to get the americans out of israel. they were in danger up there to the north too, but they're in more danger i feel selfishly in the south. we have heard nothing from the state department. we registered them on the very first day this began as wanting to evacuate from the rafah border crossing. i registered them as the sponsor so i'm supposed to be contacted the same time she does, and with all due respect, we have not heard anything from the federal government or the state department which is very frustrating. all we hear is word of mouth within the couple of miles of the rafah border. they can leave on a moment's notice. they're packed and ready to go, but no. we're frustrated. >> i'm sure. >> we're hoping the president addresses this tonight. >> john rauschenberger, again, we wish you only the best and hope everything works she was 1 of 19 defendants including trump himself who was indicted in august for their efforts to overturn the results in georgia. joining us now, nbc news correspondent vaughn hilliard and "today" anchor, laura jarrett. thank you so much for being with us. vaughn, let's start with you. remind us which case this is. the details of it, and just how much of a surprise this really was. >> right. this is the fulton county case. donald trump as well as sidney powell, they are 1 of 19 defendants who are charged on state charges. sidney powell is key. she is now the second of these 19 defendants to plead guilty. she's pleading guilty to election interference. particularly in her instance, she was around an alleged effort to tamper with voting machines here. but what is so important about this guilty plea is the fact that -- part of this agreement, she has to go and testify truthfully about all the other 19 defendants, and sidney powell was around for an awful lot. she was attorney for donald trump, was in cahoots with rudy giuliani. she was at the white house in december of 2020 when donald trump talked about appointing her as special counsel to investigate these fraud claims. she was privy to a lot and could be key to the prosecution. >> and so, laura, what could this mean to the case of the former president? >> well, it's not welcome news to former president trump's defense team because obviously she's privy to all the meetings that vaughn laid out and she has to testify truthfully about them or this entire thing falls apart. remember, guys, she was facing serious prison
