high clouds, low clouds and hazy sun. so temperatures, it looks like the sea breeze picking up double what if was. inland temperatures will come down. more of those are up towards the north bay than everywhere else. it looks like about san francisco, oakland, concord, north, more so than south or east. 50s to near 60 degrees. overnight lows are running cool he. there's a delta breeze. i think travis was about 6, 7 miles an hour. that's a big jump. a lot of low clouds and fog in place. high pressure getting knocked down a little bit. the end result is high pressure is going to replace it into the great lakes and the northeast for a very fall-like system, even though we're technically still into summer. cool for some. warm to hot for others. i think we'll bring temperatures down a overnight when the fire happens. right now, you can see the excavator is back, that huge piece of equipment so administrators can pick through the damage and meet through insurance agents here. the fire started just before 4:00 a.m. yesterday. it took it three hours to get it under control. these kinds of modular buildings protesters meant to be temporary structure us so they are not required to have sprinkler systems. the direct give -- executive director said they've been raising money to build more perm structures in place but until they have that, the -- more permanent structures in place. >> these are older buildings. the alarms and sprinkler systems were not required when we put them in. the classrooms are small. the rooms have two exits. >> reporter: and the fire department in tunisia. reportedly, they've taken down the american flag and now a large cloud of black smoke can be seen coming out of the embassy. police have responded. gunfire can be heard. tear gas can be heard as well. police used tear gas here from cairo, egypt. a temporary wall -- wall has been built now. in lebanon, police reportedly shot and killed a protester -- protester who set fire to two fast-food restaurants. >>> four people have been arrested in the attack committed on libya at the u.s. consulate. u.s. warships are headed to the coast of libya and the marines have been sent as well. >>> there is a report from a british newspaper this morning that claims the united states had early warnings about the attacks in libya. coming up at 8:15, we'll bring you reaction from the obama administration. we'll give you a live report from washington, d.c. >>> coming up 0 8:4 -- coming up on 8:01. investigators are examining the damage left behind at fair oaks elementary. we're live where the high-speed chase ended in had gunfire. quite a bit of drama there. claudine wong has more. claudine? >> reporter: all of the drama is over. you can see the damage that's left behind. if you take a look at those poles in this round-about area, you can see the gates closed. there was no one here and no one on campus but certainly it did cause some damage. i want to show you the scene so you can get a good look at how this all came down. this car was chased by vallejo police, ended up in front of this yard. the two suspects tried to get away. the police officer -- the police officers actually tried to stop this car in vallejo about 20-plus miles away. we just talked to one neighbor and she told us what she heard. there was like a bunch of cop cars. a car came speeding pass and i heard gunshots and at least 10, 12 of them. >> reporter: the sergeant on scene told us she heard a gunshot because one shot was fired by a police officer. he says after this car came to a stop, the two suspects got out and that's when en-- that's when he said one of the suspects made a gesture. here is him explaining why that officer fired his gun. >> crashed into the protective pole. officers took the individuals in custody. >> individual or -- >> there were two in the car. there were two male cars -- there were two males. >> reporter: back here live where school is getting underway. the bell rang at 8:00 this morning. this was a stop that started over drugs and weapons. and we are told that they did recover some drugs but as far as we know, no weapon has been recovered. that street and sycamore drive. firefighters think someone torched this rope, trees behind the stores. the flames spread to one of the doors -- to one of the stores. >>> a van crashed into a power pole at 1:00 this morning on campus drive. tara moriarty has been on the scene since 4:00 this morning. are the roads still closed there as well? >> reporter: they sure are, and they should remain about that way until 2:00, 3:00. we're here on campus drive. if you take a look behind me here, it's a pretty dramatic scene. the pole that they are attached to completely toppled. around 1:00 this morning, a woman driving a gold minivan crashed into the utility pole, it fell snagging some high- voltage wires and knocking out twice to about 1 to -- to about 12 to 20 homes nearby. the woman says she kept driving disoriented but she did stop. >> police would not confirm if the woman was arrested for dui but she was taken into custody. we're about one block from the cal university and close to some bus stops. as far pass the cost of the damage, one work estimates it will run at least $15,000, a pretty large restitution fee for the driver to pay. you can see the traffic lights are not working obviously because of the power outage. there have been some signs that the police just placed at the enof this treatment letting folks know that this intersection was shut down so there wouldn't be a traffic jam. we're looking at 2:00, 3:00 in the afternoon before campus is fully open again. live in hayward, i'm tara moriarty, ktvu channel 2 news. >>> a search continues now for a purse snatcher in san mateo county. it happened last friday at the baklava restaurant. police say the thief reached from an open window and stole a woman's purse on the back of a chair. he took off running, put the -- in the forefront? >> reporter: mitt romney took a lot of flack for his comments the other day najaf, florida. a -- in jacksonville, florida. a number of people who were against him but now jumping on board with him. the white house has pushed back very hard as have a number of democrats in the congress against romney really slamming him on that. you know, it's one of those things where you just never know how it's gonna play. what republicans would love to do is paint president obama as jimmy carter version 2012, basically. you will hear a lot of that in the days ahead. >> any impact month polls? here this morning closed so no one can get through. if you are not familiar with lisa lang, where in school is located, you might not notice where it is. it looks like a straightaway but when you get to fair oaks elementary, you are not going further and that's when the suspects found out quickly last night. it may have caught them offguard. the chase started about 7:45 last night. police say detectives in vallejo have investigated and threed to pull the vehicle over -- tried to pull it over and that vehicle got on the freeway and they chase it through three counties. police say they were going in speeds in excess of 80 miles an hour. >> there was just like a lunch of -- bunch of cop cars feeding past. i heard guts and the police -- i heard gunshots, like 10, 12 of them. >> police say once the car crash. police say one officer fired a shot. the two people in the car were taken into custody. this morning, the prince pam said the parents dropping off their kids have been wondering. we have a school manager system that we can put out the call and we're getting people know that we can come and we're safe. i think most people don't know about it but as they are innerring they are having questions. we're letting people know we're open and there's no concern. >> reporter: all of this started because of that ongoing investigation we talked about. public reports say it's drug and weapons related. again, that all continues with those two men inside the vehicle in custody this morning. but again, back out here live at fair oaks elementary school, they did put some caution tape thing to talk about because a lot of people learned the hard way with bernard madoff, but financial advisers taking advantage or scamming their customers. how big a problem is this? >> it actually is quite a big problem. the cfp bore, the non-profit organization that certifies financial planners, said over half of their planners, people coming to them, particularly older americans, have been victims of some form of financial abuse, either because of the advice that they were given or the investments that they made, and so now they are in another situation on round two or three trying to rectify the situation. >> all right. so let's get to some important advice so they don't become a victim. you say the first thing is you want to hire a financial adviser, be sure to check them out thoroughly. do your home ork. >> one of the basic things, ask and check. want to know what their employment history is like, if they have had disciplinary action taken against them, are they certified, registered financial planners, and places to go to check, if it's a broker or someone selling you investments, go to finra.org, for the broker check. want to feigned out about your financial adviser and all of these things as well, go to the s.e.c.gov, security and exchange commission and adviserinfosec.gov and cfp net is a place to go to see if they are a certified financial planner. >> there's always a level of risk so it's good to get investment pros and cons and know what level of risk you're willing to take. >> absolutely right. one of the things when checking them out, know how they are compensated and what fees are involved, and also want to know what fees are involved with the investments that they are suggesting and what the pros and cons are of various investments. if they are telling you about a particular investment and only telling you the upside, the potential would turn that it make not how much it costs you in terms of fees or the downside, probably not an investment you want to make, at least not right away. definitely get a second opinion. >> important to create a paper trail. be aware of all your paperwork and payments. document everything you do. >> this is critical, and so many people don't do this. you're working with a financial adviser. that's great, but the actual statements that you get about your investments probably should not have that adviser's first name and last name and letterhead on them. they should come from securities firm or a brokerage firm where those investments are held. you also want to make sure that any paperwork that you do does not have blanks on it, and if it does, if you sign something and you're waiting for a signature on the other side, then you want to make sure that the paperwork that you receive back says submitted on it that you have everything there filled out. when you make a check out, don't make it out in the adviser's name. make it out to the firm or to a brokerage firm. you're not making it out to the person directly. you don't want them to have control over all your money. >> right. full access to your account. >> exactly. >> also, most people who are seeking financial advice usually are doing so because they have experienced some life-changing moment, unfortunately, which could affect their pockets, so you say avoid making hasty decisions. >> it can be -- >> be careful. >> it could be a great thing, too. just had a baby, and now you're like now i'm going to get my financial life in order and will put all my money into a college savings plan. have you saved enough for retirement. you want to make sure you don't do or make hasty decisions if you just got divorced or a death in the family or something like that. make sure you take the time and also take the time to find out what the charges and fees are involved, you know, as you wait to make these decisions. >> and the last point, a good one, designate a financial power of attorney for your finances the same way that you have a power of attorney over your health. >> exactly. if you become incapacitated, there's a way that you're unable to make financial decisions for yourself, you want to have a friend, a relative, someone that you trust who is your financial power of attorney to make these decisions for you, another gut check on the financial adviser that you may be working with so that they again do not have full reign over all of your finances, that someone is stepping in to make sure it is right and find a financial power of attorney, get the documented done with answer tate investments. cnbc personal finance correspondent sharon epperson has important tips on making the right choice. good morning to you, sharon. >> good morning, natalie. >> so this is a really tough thing to talk about because a lot of people learned the hard way with bernard madoff, but financial advisers taking advantage or scamming their customers. how big a problem is this? >> it actually is quite a big problem. the cfp bore, the non-profit organization that certifies financial planners, said over half of their planners, people coming to them, particularly older americans, have been victims of some form of financial abuse, either because of the advice that they were given or the investments that they made, and so now they are in another situation on round two or three trying to rectify the situation. >> all right. so let's get to some important advice so they don't become a victim. you say the first thing is you want to hire a financial adviser, be sure to check them out thoroughly. do your home ork. >> one of the basic things, ask and check. want to know what their employment history is like, if they have had disciplinary action taken against them, are they certified, registered financial planners, and places to go to check, if it's a broker or someone selling you investments, go to finra.org, for the broker check. want to feigned out about your financial adviser and all of these things as well, go to the s.e.c.gov, security and exchange commission and adviserinfosec.gov and cfp net is a place to go to see if they are a certified financial planner. >> there's always a level of risk so it's good to get investment pros and cons and know what level of risk you're willing to take. >> absolutely right. one of the things when checking them out, know how they are compensated and what fees are involved, and also want to know what fees are involved with the investments that they are suggesting and what the pros and cons are of various investments. if they are telling you about a particular investment and only telling you the upside, the potential would turn that it make not how much it costs you in terms of fees or the downside, probably not an investment you want to make, at least not right away. definitely get a second opinion. >> important to create a paper trail. be aware of all your paperwork and payments. document everything you do. >> this is critical, and so many people don't do this. you're working with a financial adviser. that's great, but the actual statements that you get about your investments probably should not have that adviser's first name and last name and letterhead on them. they should come from securities firm or a brokerage firm where those investments are held. you also want to make sure that any paperwork that you do does not have blanks on it, and if it does, if you sign something and you're waiting for a signature on the other side, then you want to make sure that the paperwork that you receive back says submitted on it that you have everything there filled out. when you make a check out, don't make it out in the adviser's name. make it out to the firm or to a brokerage firm. you're not making it out to the person directly. you don't want them to have control over all your money. >> right. full access to your account. >> exactly. >> also, most people who are seeking financial advice usually are doing so because they have experienced some life-changing moment, unfortunately, which could affect their pockets, so you say avoid making hasty decisions. >> it can be -- >> be careful. >> it could be a great thing, too. just had a baby, and now you're like now i'm going to get my financial life in order and will put all my money into a college savings plan. have you saved enough for retirement. you want to make sure you don't do or make hasty decisions if you just got divorced or a death in the family or something like that. make sure you take the time and also take the time to find out what the charges and fees are involved, you know, as you wait to make these decisions. >> and the last point, a good one, designate a financial power of attorney for your finances the same way that you have a power of attorney over your health. >> exactly. if you become incapacitated, there's a way that you're unable to make financial decisions for yourself, you want to have a friend, a relative, someone that you trust who is your financial power of attorney to make these decisions for you, another gut check on the financial adviser that you may be working with so that they again do not have full reign over all of your finances, that someone is stepping in to make sure it is right and find a financial power of attorney, get the documented done with answer tate chicken broth. >> all of it? >> put it all in there. we'll threat cook, and this is going to cook for about 45 minutes, let it simmer until it gets nice and -- the pepperoni gets soft and loosened up, and then we're going to puree that sauce up a little bit. >> put it in a food processor. >> right in a blender. put in right in a blender, let it go for a couple of minutes. chicken wings, cleaned them up, tips off and the wings and we're basically going to marin ate these. throw that rosemary, lemon and garlic in here. >> mm-hmm. >> how long do you let this marin ate here? >> back into the refrigerator for about two and a half hours. you want to kind of threat get -- >> leave it in overnight if you want to? >> won't hurt it at all. fresh rosemary and fresh lemon and garlic. break up the popping the opposite direction, popping above $3 a gallon. there was a refinery explosion in canada, we now know that refinery operations have returned to normal there, but that caused the pop there, and natural gas prices, by the way, natural gas the best-performing commodity on the cme today. cold weather switching in, a lot of energy producers switching from coal to natural gas, and by the way the euro hitting a two week low against the greenback, that pressured crude prices and a lot of other commodity prices that we will show you in the next hit in a few minutes from now. back to you. cheryl: all right, sandra, two of the hardest working women in television right there. home prices are on the rise, and yesterday's case shiller report, today we got new home sales numbers, and there was a dip. these numbers are impacting home improvement and furniture stores. here to tell us, ethan allen's chairman farooq kathwari. great to have you on the show. first, i want to ask you about what we're seeing really today with the company. you've got a stock that's up more than 60% over the last year, but today a little bit of a hit. how do you feel on days like this? >> oh, you know, one cannot really pay attention to what's happening on a day-to-day basis. as you rightly said in the last year or so, we're up 60, 70 percent. but more importantly, we are focused on making sure that we continue to reinvent our business, increase our sales, increase our profitability. in fact, yesterday we started our 80th year celebration in vermont. of course, the company's first set up. and we still make 70% of our products in the united states. cheryl: and you've been there for 25 years, we should mention to our viewers, you yourself have been with this company for 25 years. one of the most impressive things, i think s you've been able to keep 70% of your manufacturing in the united states at plants in the united states. what's the secret? >> well, the secret is what you have also indicated is the fact of being around for a long time and also thinking long term, making investments. you know, manufacturing in the united states is not easy, and if you're not thinking long term, if you're not continuously investing, it's not possible. because, you know, we have great people, we've got great history. we, in fact, have 73 locations in china and 60% of the product we're shipping from the united states to china. in furniture which is, you know, not made by robots. we still have a lot of labor even though we have a lot of, lot of technology that we've introduced. so i think it's a question of quality, it's a question of craftmanship, and i would say it really is this ability to think long term which has given us an opportunity to retain good people and also to help continue to do, to increase our business. cheryl: you know, farooq, i, like many americans i'm sure, we've all walked into an ethan allen, we've seen your store, but you do have competition out there, and you're on the higher priced size. how do you continue, especially when you go through a housing downturn, how do you kind of continue to get that customer to spend at ethan allen and not go to the competition, not go to lazy boy, for example? >> well, you know, it really is a challenge. the impact of globalization and commodityization has impacted every business from housewares to electronics and furniture. the way you differentiate is by providing great service, good quality. you know, we have 2,000 interior designers that go to a consumer's home and provide service. we have a great logistics network that deliver our products at one price nationally. and then we also focus on making sure that we've got great style. in fact, in the last two years we have changed 60% of our products. so we used to change 10%, and that was a lot. now 60% product change means you're relevant. yes, there's a tremendous amount of competition. so you really have to take market share, and you have to differentiate. we have great quality, great style and service. otherwise you can't do it. cheryl: 80 years in business, farooq. thank you very much. 25 years of that you've been there. ethan allen's chairman, ceo and president. congratulations on the anniversary. >> good to see you again. cheryl: closing bell's going to ring in 27 minutes. consumer stock names dominated our today's s&p 500 winners. when we come back, brian purie has consumer names he says are still worth the buy right now. ♪ >> announcer: meet tom, a proud dad whose online friends all "like" the photos he's posting. oscar likes tom's photos, but he loves the access to tom's personal information. oscar's an identity thief who used tom's personal info to buy new teeth and a new car, and stuck tom with the $57,000 bill. >> reporter: oh, yeah. taking a look at dean foods, right? i pulled it up nice and big for us. it's up a full five percentage points right now. dean foods clearly a winner on the s&p 500, and why is that? because they are confirming that they are scoring a potential sale of their morningstar dairy operations. as a result, you see that being a winner. a lot of the consumer stocks very resilient. consumers are resilient despite a tough economy, whatever you want to call it. but take a look at some the other names, or does that make you hungry? tyson foods, conagra, campbell's soup. a lot of up arrows today for this group in particular, a lot of winners on a day where we've had a lot of red on the screen. back to you. cheryl: nicole, we'll see you very soon. well, consumer stocks are among today's biggest s&p winners. brian peery says the consumer is not dead and now is the time to buy into equities, portfolio manager at hennessey funds and joins me now in a fox business exclusive. it's nice to see you. i always like to talk about hennessey funds, but i do want to talk to you about the consumer. how sure can we be that the consumer is really going to hold us up for the rest of the year, spend more money? >> well, you know, i think, cheryl, i think everybody is -- that's the big question. and, you know, i think that there's been a sentiment out there for some time now that the consumer's really kind of shifting their value proposition, and what they're really doing is trying to stretch that discretionary income that they have to maximize their, you know, their commodity goods. and i think there's a lot of opportunities, i think the market's still reasonably priced for these stocks, and, you know, if you're selective in what you're picking and have an idea of why, i think there's some great opportunities. cheryl: your s&p 500 target before the end of the year is 1500, i'm curious if you could give me a good time sense to get into the s&p 500, just the index even. >> well, you know, i really look at these down days like we've had in the last couple as great entry points. as long as you can kind of take a little bit longer view than maybe some of the traders on the street have, and you can really look out a few quarters of a couple of -- or a couple of years, if you can buy on these down dips, you're going to be fine over time. cheryl: all right. let's talk about some of those consumer names you have because there's some interesting plays, and i want to get these out to our viewers. you like names like family dollar, obviously, that's a stock that's been very success. , it's had a great run. you also like pier one. start with family dollar. do you think we stick with it? >> i do. you know, i think they've done a phenomenal job in both managing their costs and increasing their top line revenues. they're growing roughly 8% year-over-year, so anything that's growing above that kind of 2% gdp is attractive. they've managed to keep their costs down which has shown up in higher earnings, and i think that, you know, that kind of value proposition is still very much in play, especially as you come up into halloween where you guys were saying earlier, you know, $8 billion gets spent in halloween. i think that that combined with the back to school really is going to look pretty favorable on the quarter. cheryl: stocks up 15% the past year. again, one of the great plays when we had a recession going on, this stock has been performing strong. it's one of your top ten holdings at this point, you still like it. >> we do. it's actually, you know, as of the end of the quarter, that's our number one holding in the fund, so it is a name that we have owned for some time, and we continue to like the story. they keep executing. their same-store sales, you know, keep knocking the number out of the park, so, you know, we continue to be a buyer in here of this, of ross. cheryl: last year 61%. we're looking at the chart right now. i mean, the chart doesn't lie. let me get to this one, and this is pier one. pier one is an interesting play. do you think it's because maybe we're seeing that pickup in home sales, or is this more of an apartment play do you think? because we still have a big portion of the population that's renting. >> you know, cheryl, that's a great question. i think you hit the nail on the head when you were talking with farooq, and it's a question of price sensitivity. you know, because i have people coming over for thanksgiving, i don't necessarily need to go out and potentially purchase a new doing room table, but i'm happy to buy, you know, some place mats that go on top of that. [laughter] cheryl: brian, wait, the fine china's not coming out at your house for thanksgiving? does your family know about this? >> my kids are better served eating off paper plates, to be honest with you. [laughter] cheryl: all right. overall, talk to me about the next few months with hennessey funds just in general. how are you feeling about the next six months, once we get past the election, all that stuff. are you still kind of bullish overall? >> yeah, we are. i mean, there's certainly always going to be some questions and some concerns. you know, the looming fiscal cliff is pretty much forefront of everybody's mind at this point. you know, i think at some point it, hopefully, all gets worked out, you know? and then all of this cap x spending that we've been kind of waiting for from the corporations eventually starts to trickle in, and instead of doing stock buybacks, it transfers to plant and equipment which is great for the economy long term. so as we start to kind of move through these progressions, we think that, you know, overall the economy's going to start to pick up a little bit again, and, you know, six months, a year out we're going to look much better shape than we are. cheryl: brian, again, i'm looking forward to my hennessey barbecue sauce or bobblehead that i'm going to get during the holidays. >> have a great day. cheryl: brian peery at the hennessey funds out in california. closing bell going to ring 15 minutes from now. only two more trading days left in the month of september. will the major indices be able to hold on to some gains? when we come back, we're breaking down all the big movers for you. cheryl: here is your fox business market check, everybody, and we really have been steadily down today. but again, it's a light volume day. there's some news to turn around in the economy, home sales data came out this morning, prices, watching all of that. nicole's been talking about that throughout the session. right now you have the dow down 47 points, the nasdaq down 27, s&p down a little more than 8 and the cuss l 2000 -- russell 2000 is down as well. oil closing below $90 a barrel. now, despite being the worst performing sector this year, the utilities sector is a bright spot on the s&p today as the top performer, leading the sector today. take a look at some of these names, and you know them very well. one oak, coned, southern company, wisconsin energy, cms energy are actually leading utility players today, and with that, let's send it over to sandra smith to take a look at some big movers she is watching from the cme. >> reporter: hey, cheryl. well, i said it in the last hit, there were some big movers, and a lot of the reason was we had a weaker euro hitting a two week low against the u.s. dollar, and that put a lot of pressure on those dollar-denominated commodities. natural gas prices surging more than 3% today. remember, a lot of those energy producers switching from coal and more expensive coal to cheaper natural gas. that's spurring demand for it. also we're heading into the winter heating season, arbob spiking today, there was a refinery explosion but a bullish report from the government on supplies, and silver getting a small bump despite gold heading south. here's your commodity losers on the session. again, that smaller u.s. dollar pressuring a lot of these prices. weak corn, soybeans -- wheat, corn, soybeans, all the grains getting hit. worldwide a lot of countries that import u.s. grains are finding it way too expensive to buy u.s. p crops, so they're buying from other countries, and that's lessening demand and putting pressure on prices. crood closed -- crude closed below $90, and copper prices very indicative of the slowdown in the u.s. and global economy, it too got hit in today's session along with many of the other commodities. back to you. cheryl: oh, good. less people for go to foreclosed homes and steal the wiring out of walls. popping numbers. >> they are. they're eye-popping numbers. it's hard to sit here, i must say, year after year, giving eye-popping numbers because these numbers continue to be bad. now, this study is a little bit different because it gives projections. this is by a group called trust for america's health, and projecting things is always tricky business, but they're using cdc data to look into the future. one of the things i found interesting is that the obesity epidemic is not the same from state to state. let's look at the two extremes, sort of the best state and the worst state, all right? so colorado, let's take a look at 2011 first. mississippi, high rates of obesity. 34.9% obesity rate versus colorado, 20.7%. now, by 2030, those numbers are expected to go up in both states. so 34% becomes 66% in mississippi and 20% becomes 44% in colorado. so both states going up. but still, a pretty big difference. >> it's incredible. so i'm going to ask you the impossible question. what can be done? >> you know, all the suggestions for what can be done are the same kinds of things that we've heard before. more sidewalks so kids can walk to school. healthier school lunches. you know, all of those kinds of things. they'll be making the foods that we buy healthier. it's all the same things that we've heard before, and have happened slowly, but many say need to happen more quickly now. >> okay. so i don't hear either presidential candidate talking much about the obesity crisis in the united states. i hear one candidate's wife talking about it a lot, but that's about it. >> it is interesting because this is one of the biggest public health threats in this country is obesity. and you don't hear a lot about it, but we asked questions and looked around. and so, you know, that candidate's wife, obama's wife, has the let's move campaign, and president obama has said that he wants to continue to change school lunches, something he's already started. we went to the romney campaign's website and saw nothing about obesity. we reached out and sent e-mails to his spokesperson saying hey, this is a big problem. what are you going to do about it if elected? we got no response from his campaign. >> elizabeth cohen, thanks so much. >>> in chicago, we've heard from the teachers who have been on strike for more than a week. we've also heard from the city going to court to force an end to that strike, and now we're hearing from other people. who also want the kids back in school. kyung lah is covering the strike. i would imagine parents are getting pretty fed up, right? >> reporter: yeah, we've spoken to some parents, carol, who still support the union, but we also sat down with another group of parents, about a dozen of them last night gatheng at a home, a very informal gathering, saying hey, look, enough is enough. sure, the city is now going to court, yes, the union is looking at this contract line by line, but what these parents say is being lost is that they and their children are the ones paying the price. here's what one parent told us. >> parents need to get out there and have their voices heard. we need to get the children back in school. bottom line, it's as simple as that. and if parents sit on the sidelines, the pressure's off, and there's no sense of urgency anymore. we're going to just keep delaying this. we have got to turn up the heat, and parents have got to speak up. and we have to end the strike and get the students back in school. >> reporter: so could this strike end? well, we should know sometime this afternoon. at about 3:00 local time, the union delegates are going to meet in this building behind me. there are about 800 of them. and they have spent the last two days looking over this contract, talking to their members, and they're going to vote on whether or not to end the strike. they don't actually vote on the agreement, but they're going to vote on whether or not to end the strike. so we should have some answer in about four, five hours, carol, on whether or not this strike in the nation's third largest school district affecting 350,000 schoolchildren will continue. >> okay. we'll check back. kyung lah reporting live from chicago. >>> remember the controversial supreme court decision on citizens united? and it tastes good? sure does! wow. it's the honey, it makes it taste so... well, would you look at the time... what's the rush? be happy. be healthy. ♪ lord, you got no reason ♪ you got no right ♪ ♪ i find myself at the wrong place ♪ [ male announcer ] the ram 1500 express. ♪ it says a lot about you. ♪ in a deep, hemi-rumble sort of way. guts. glory. ram. >>> it is 15 minutes past the hour. checking our top stories now. the romney campaign on the defensive this morning over the release of secretly recorded tape of mr. romney speaking to big-money donors at a fund-raiser a few months ago. romney saying his controversial remarks about nearly half of americans were not elegantly stated and that he wants to help all americans. >>> veteran soap opera actor john ingle famous for his 19-year run as edward quartermaine on "general hospital" died at home in los angeles. his last date on the soap opera was just last tuesday. he was 84. >>> turns out president obama's jobs record isn't the worst since the great depression. in fact, president bush faced a bigger gap eight years ago. doing the math, private sector payrolls cut 1.6 billion jobs during bush's first term while obama's added 415,000. of course, it's the unemployment rate that cannot be ignored. in 2004, it was 5.4%. today it is 8.1%. >>> less than 50 days to go to the election, and the president of citizens united, the group responsible for that landmark supreme court decision that allowed corporations to donate to campaigns, is back with a new hour-long documentary on president obama. >> as time went on, you know, i started to see the bailouts finished. and then i saw unemployment rising and rising. >> i think he is in over his head. >> i don't think he was well prepared for these problems. >> i don't think that i got what i was expecting. >> the film premiered at the republican national convention, but it features only democrats and independent voters. it's set to get a wider release now, running on six cable networks and some local tv stations. joining me now are the director of the film, steven bannan who, by the way, also directed the sarah palin movie, "the undefeated," and the president of citizens united, david bossy. welcome to you both. >> thanks for having us. >> thanks for being here this morning. you tried to do something similar to this in 2008 with a film about hillary clinton, and it was barred by the courts. after the citizens united supreme court decision, though, now you can put films like this on television. not many people realize this, but that -- what was really behind your fight all the way to the supreme court, right, david? >> it really was, carol. thank you for pointing that out. most people don't. and let me just say, before citizens united, in your intro, before citizens united, the supreme court case, corporations could not give to campaigns. and since citizens united, corporations cannot give to campaigns. corporations can give to new ganizations that are these outside groups but not directly to campaigns. i think it's important that people understand the difference, so i appreciate that. but our case was about making movies and their ads. and that's really what it comes down to. michael moore, i love to say this, had the right to make "fahrenheit 9/11" in 2002. we didn't about hillary clinton. we felt it was a violation of our rights. >> that movie was made during the primary, and that was the difference between the two documentaries. >> they were both during the elections cycle. michael moore's film came out during the summer of 2004 right before the conventions, right in the height. and by the way, michael moore wants to enter the marketplace, and so do i, at the time the american people care about these issues and care about these electi elections. so it's not hard to imagine that people on the left and on the right want to participate in the conversation through film, and that's really what this film is about, the hope and change is the first time since our supreme court case we're able to have a film. and this film is going to be tonight 7:00 eastern on hd net movies, and we're really proud of that fact. >> and david, who's in the movie? >> what we did is steve and i spent about a year going across the country in battleground states. and so there are no republicans in the film, no members of the tea party, no conservatives whatsoever. these people are all 100% democrats and independents. every one of them voted for barack obama in 2008. and they naturally wanted to support him then, and they wanted to support him during his presidency. and after four years, these people tell their story of disappointment. this film is truly more in sorrow than in anger. they want him to succeed. he just didn't in their mind. >> and, of course, that's a way to get those people who are undecided in the selection to vote for governor romney, right? that's really the point. >> carol, i think really is that a year ago when we started thinking about this, we kind of figured what was going to be the most important aspects of the final days, the final 90 days of the election. and we figured that david axelrod would have to solve for that part of the equation. but these are folks that really voted for president obama. and so we wanted to go out, and that's why we hired democratic strategists and pollsters to really run these focus groups. and we wanted to see people either leaning towards voting for president obama or not voting towards president obama. >> so let's talk about the people in your film because you want these people, of course, to vote for governor romney. governor romney -- >> well, no. >> just let me ask you this question. >> i'm sorry, go ahead. >> so governor romney is secretly recorded at this -- at this donor event in front of wealthy donors. and you know what he said by now. i think everybody knows. he said there are 47% of the people who will vote for the president no matter what. all right, there are 47% of the people who are with him who are dependent upon government who believe that they are victims who believe the government has a responsibility to care for them, who believe they are entitled to health care, to food, to housing, to you name it. he's -- isn't he talking about some of the people who are in your film? >> no, i don't think so. i don't think so at all. >> really? >> first of all -- >> you don't think those people -- >> these people in our film -- >> you don't think those people, i mean, some of them don't pay income tax because they don't make enough money? >> i think what mitt romney is trying to say is that it's better to grow the pie. it's better to create good jobs. it's better to create opportunities for people, entrepreneurs, small businessmen and women across america to be able to grow the tax base as opposed to having more and more and more people live off a smaller group of people who are paying taxes. that's fundamentally a conservative principle and quite frankly a smart economic principle that president obama doesn't realize. and that's why our economy continues to tank. so all i'm saying is, i don't know what mitt romney said every single word. it doesn't matter. the principle behind what he said is, more people are drinking the water than carrying the water. >> how could you say it doesn't matter? he's calling half the country victims. >> no, what he's doing is -- >> who live on the government dole. he has to be president to all americans, doesn't he? >> of course he does. what he's doing is he's pointing out the fact that barack obama has more people on welfare, more people on food stamps, more people in the unemployment lines than if his policies were put into place. and that's, i think, clearly what he was saying. >> but people he is talking about are people who have jobs and pay payroll taxes and other kinds of taxes. it's not like they're doing nothing. they're working really hard for very little money, and they get tax breaks just like the wealthiest americans have tax breaks. >> and what mitt romney's trying to do is create policies if he becomes president, and i'm not his spokesman by any stretch of the word. i'm a i guy shooting from the hip here. i think that he wants to create policies, if he becomes president, that allows more people to cross over into the 53%. because if we can grow that pie, if we can have those people earn more, be able to get better jobs, better educations, to be able to earn more, then they're going to be able to participate as the 53%. i go back to, it's more people drinking the water than carrying the water. and at a certain point, you can't continue that. >> carol -- >> and stephen, just a last word, the people in your film, since supposedly you supervised this or interviewed some of them, if they listen to those remarks by mitt romney, how would they feel? >> carol, i think the people in the film, you know, are working-class democrats, middle-class democrats and independents who lean democratic. these are hardworking americans. i didn't find the entire year that we took to make this film that they're looking for more government entitlements or more ways to be dependent upon the government. i mean, these are hardworking people who, quite frankly, really supported the president trying to bring the country together and trying to focus on the economy. and i think when you hear in their own voice that the country's more divided and that the economy is worse and that the jobs are not being created, i think the power that comes through in their voice is they think he has not lived up to the expectations they had for him. so i'm not familiar, really, with governor romney's remarks. this film's not a pro-romney film. this film is very much -- >> we don't talk about him at all. >> this is a film very much in the voice of working men and women in this country. >> come on. come on. come on. >> this is not -- >> come on. >> carol, we really wanted to make a film and have people really explain -- and i think one of the powers of the film, both liberals and conservatives have seen it, is that away from the political class of both parties and away from the media class, the pro wrestling that takes place every day on cable and talk radio, you really hear the agony, angst and trepidation that the middle class and the working-class people in this country have with this financial crisis we're in. >> okay. thanks to both of you for being with us this morning. stephen bannan and david baasie, thanks so much. >>> dramatic video out of libya shows a group of men apparently trying to rescue u.s. ambassador chris stevens. we'll show you. wo tickets to paradise! pack your bags, we'll leave tonight. uhh, it's next month, actually... eddie continues singing: to tickets to... paradiiiiiise! no four. remember? a new political catchphrase has been born. makers versus takers, and democrats love it. calling the secretly recorded romney tapes the mother jones scoop the mother of all political gaffes. >> there are 47% who are with him, who are dependent on government, that believe they are victims, who believe that government has a responsibility to care for them, who believe they're entitled to health care, to food, to housing. >> but governor romney is not backing down. he says although his comments were not elegantly stated, they're in line with what he's been saying all along. >> do you believe in a government-centered society that provides more and more benefits, or do you believe instead in a free enterprise society where people are able to pursue their dreams? i believe the latter will help more people get good jobs. >> many republicans are applauding romney for telling it like it is. and let's face it, many americans feel americans have grown too dependent on government. a near record 46.4 million people are now on food stamps. and who can forget the bitter partisan brawl over extending long-term unemployment benefits? still when you take a closer look at romney's assertion that 47% of people, quote, pay no income taxes and are dependent on government, it's not quite true. more than a quarter of those people have jobs, and they pay payroll taxes. 10% are elderly who collect social security after paying into that entitlement. boil it down, and just about 7% pay neither payroll nor income tax. when all is said and done, though, haven't we been down this road before? >> i'm good. thank you for being with us this morning. governor romney came out, he clarified, called his comments inelegant, but he's standing by them. i mean, in your mind, does he need to apologize? >> carol, i have to say, you know, i've worked for the president for 5 1/2 years. he ran to represent the entire country. even when people don't agree with him, he wakes up every day wanting to solve the challenges of everybody in this country. mitt romney wrote off nearly 50% of people in this country before he's even sworn into office. this is something that i think is shocking and really alarming to people who want to bring this country together and are scratching their heads about what he said. >> well, i will say the fact remains there are more people on food stamps now than ever before. i mean, does romney, you know, as inelegantly, as he put it, does he have a point? a lot of people would say he does. >> look, i think the people mitt romney was talking about, let me shine a little light on this. he's talking about military veterans who fight overseas and are supporting their families and come back. he's talking about seniors who have worked hard for 50 years and deserve the place they're in. he's talking about students who are working two jobs. these are the people he's talking about when he makes remarks like that. >> but i think, jen, his underlying issue is that, that there are too many people dependent on the government these days. and when you look at the numbers for people on food stamps, it sort of bears it out in a lot of voters' minds. >> well, look. i think, you know, that's an issue where you look at president obama's plan for lifting up the middle class, for making sure they have tax incentives for making sure kids who don't have a chance can go to college, for making sure people have access to affordable health care. those are helping people who need help the most. the president, you know, he believes in the hard work and the entrepreneurship of the american people. but he also believes that we need to start from a point where we believe we're fighting for all people and not writing off 50% of this country, which is exactly what mitt romney was doing in his remarks. >> well, on the subject of the president's plan to get the economy moving, it isn't working as fast as he would like. still unemployment is 8.1%. the jobs situation is certainly not where it should be. do you think those thoughtful voters that mr. romney mentioned in that hidden video will respond to the governor's comments? >> look, i think any american out there, any middle-class american who's looking at the choice they're facing in november is looking at the president who is saying, i want to extend your tax cuts. i want to make sure you have access to affordable health care. i want to make sure that if you can stay in your home, we're going to help get you the assistance to do that. mitt romney -- >> for many people, those efforts are agonizingly slow, at least, you know, when it comes to real life. >> oh -- >> i just want to ask you a last question before i have to let you go. remember back when president obama made the comment about clinging to guns and religion? and he made it in sort of the same kind of setting that governor romney made his statements? i mean, sometimes politicians say things that don't come out the right way. >> well, look. what the president said then really lays out the fundamental difference between them. he was talking about how sometimes people in this country are frustrated, and we need to pull together and address these problems together. mitt romney was saying something entirely different. he was saying, i'm not worried about 50% of this country. so that really highlights the fundamental difference between the two of them. >> i don't think he was exactly saying that. he was saying they probably would not vote for him because they supported president obama's policies. so he had to concentrate more on the thin slice of undecided voters that are out there. isn't that what he was really saying?
