news 4's tracie potts capitol hill.he odds that congress can pass something this morning. >> reporter: eun and aaron, all of those workers waiting to see if within the less than 24 hours congress can keep the government working. the key here seems to be health care. overnight we know the democrats once again blocked a temporary measure to extent the government funding. the issue here is that democrats don't want to see a vote on health care. we learn it's not going to happen this week. maybe next week, but not this week in the middle of the critical shutdown negotiations. here is the schedule for today. sometime late morning to mid afternoon another vote is going to be taken on that temporary measure. if it passes, the government stays open. if it doesn't, it's going to be going until midnight. >>> another issue is former national security adviser michael flynn. tell us the facing from the pentagon. >> reporter: right. the pentagon's inspector general is taking a look at whether flynn properly disclosed payments, includ

news 4's tracie potts. tracie, the trump administration trying to back out of the iran deal? >> reporter: they're aaron. it's not clear them' y'll be ab to. the u.s. does not like a few things they're doing. the secretary of state laying it out, laying out his case at the state department saying that iran is sponsoring terrorism in at least five countries, testing and developing missiles, arresting u.s. citizens and accusing them of human rights violations. so while they may be complying with the deal, the u.s. is trying to figure out if they can get out of it, there are a number of other things that iran is doing that the u.s. thinks is destabilizing the whole region. >> why is secretary tillerson making these claims about iran now? >> reporter: again, they want to put iran on notice the second time during this administration's short tenure. also, they had to certify to congress as part of that deal that iran was complying. they had to do that every 90 days. this was the first time that the trump administration did so. so while they sent the message to congress that, yes, ir

for more we're joined by tracie potts and democrats seem to have enough votes to block that this week so will that be enough? >> reporter: it may not be because they may be looking at what's called the nuclear option here, lowering the thresholds of how many votes are needed to get gorsuch on the u.s. supreme court. he cleared committee, now there are enough democrats willing to filibuster, something never seen with a supreme court nominee, that they could block this nomination without that rule change. take a look. four democrats bucking the party so to speak, three from red states up for re-election. the other from a home city of gorsuch, from denver. all of them saying that they won't block this nomination. but 42 other democrats plan to do just that, forcing, republicans say, forcing the party into this nuclear option where they can essentially confirm gorsuch without any democrats on board. they've got the numbers to do it, but is that going to pave

tracie potts joins us from capitol hill with the latest. this is the nuclear option. >> right.e've been calling it the nuclear option. here's what that means. they changed the rules so republicans can get done what they want to get done without any democratic vote. a few democrats said they will vote for gorsuch, but not enough to reach the 60-vote threshold. so starting this morning and for two hours there's expected to be a series of votes that will lower that threshold to a simple majority. so republicans can get him confirmed with 51 votes. we have not seen this happen, and now democrats are frustrated about it. saying if you have a nominee that can't get 60 votes, you need a different nominee. the danger of this, they won't be able to get gorsuch confirmed to the court, but the real danger is what happens down the road because of this split. they're not building goodwill for what will happen in a couple weeks. they have serious spending bills that have to be passed. what happens after that? tax reform, a tough issue is that the president wants to dole with and circle back
