cnn's priscilla alvarez, following this step.t's a big one as it is the first flight that's landing in guantanamo bay. priscilla, does the administration this has to do with space. they say, what does this mean? >> well, capacity for immigration and. >> customs. >> enforcement is maxed out. they have had limited resources for some time now, and they just don't have enough detention space. but this is still an extraordinary move to send migrants on u.s. soil to guantanamo bay. and here's why. there is a base in guantanamo bay called the migrant operation center now that has been used in the past, actually for years, for those who are. interdicted at sea. so people who haven't reached u.s. soil yet, who are interdicted, sent to that center and then repatriated to their origin country. but this move is taking people in the united states to guantanamo. and this is something that i'm told homeland security attorneys, as well as pentagon attorneys. were reviewing and assessing the legality of what is, again, an unprecedented move. now,

and cnn's priscilla. priscilla alvarez, um, let's talk about some of what senator cassidy said, because it's so important and so critical, not the least of which is you have a well respected doctor, a republican who's certainly gone sideways with maga world, like, i don't know, he voted for one of i think it was the second trump impeachment because of january 6th. but still, when it comes to his credentials, as a doctor, i would say they're unimpeachable. when you look at the republicans, what he said was vaccine. does the vaccines do not cause autism? he said that without hesitation, without qualification. he said, that is based on several studies that he has seen. he says the science is good and that it is safe. and that is what led him to get the promise from rfk jr. that he would, as manu said, not take that statement off of the cdc website and and other measures to make sure that the oversight of rfk, jr. and hhs is real. so now the onus is on senator cassidy. >> it is. and it would be extraordinary

for more on this, priscilla alvarez joins us. so what do we know about this facility and the legality of any of this? >> well, the legality was something that was assessed by the department of homeland security attorneys and pentagon attorneys. that's what i have been told, because what they're doing is unprecedented. the reason is because they are taking people from the united states who are on u.s. soil and taking them to guantanamo bay. now to remind viewers there is what is known as a migrant operation center that already exists there, but it has been used for those interdicted at sea. therefore, they have never touched u.s. soil. they are taken there and then repatriated to their origin country. this is a whole new step by plucking people out of the united states and taking them there before they are repatriated, which has raised a lot of questions among legal experts as to how exactly this could work within the confines of immigration law. but all the same, as you just mentioned, they did exactly this yesterday, using a mil

cnn's priscilla alvarez is on this story for us. tell us about the concerns of legality here. >> well, this is something that the attorneys are reviewing within the federal government. essentially. can you pluck someone out of the united states who is on u.s. soil and take them to guantanamo bay to then be repatriated to their origin country? when the migrant operation center, which is on the base has been used before, it has been used to interdict or rather to have and hold those who are interdicted at sea. so they never actually touch u.s. soil. so this is something that is completely unprecedented. and it is what the attorneys have been reviewing. but, brianna, in the last couple of minutes, i did learn more details about this flight. a homeland security official telling me it's about 9 to 10 people. they describe them as having criminal records who will be transported today to guantanamo bay. again, all of this is part of this broader effort by the trump administration to ramp up their detention space, because that is a hurdle t
