. $31 million in prop k, $32 million in problem be. the combination of these funds, along with a projected savings from current capital projects are what is identified as a solution for closing the remaining funding gap for the central subway program. as a maximum -- since central subway have received the maximum allocation under prop k, as you can see, the items identified under kapor reprogramming, a number of projects would require the reprogramming of prop k and sfmta, along with the sfcta will be working on a reprogramming efforts that will start immediately and conclude prior to the submission of the financial plan in february of next year. a $34 million in prop 1a is part of the $61 million state funds for high-speed rail. one of the conditions of that funding was connectivity. central subway provides a direct link to caltrain and imposed high speed rail station at fourth and townsend. earlier this year in march, we put in a programming request to the california transportation commission for $27 million, and we were approved by

prop 26, the key thing it does there, at the state level it does two key things. the first one, it does away with a tool the legislature has had for years where if they want to make an adjustment in taxation, particularly it has been helpful in federal tax conformity. you can combine a tax increase with an equal amount of tax reductions. this past year there has been the ongoing potential for an oil searches tax on california home oil companies,off set by minor reduction ns a host of other taxes -- reductions in a host of other taxes. now that result requires a 2/3 vote. so it pretty much takes that revenue blending tax shifting off the table. the second thing it does at the state level is it redefines regulatory fees and taxes and requires them to be passed with a 2/3 vote. if you have heard of the sinclair-paint division -- decision where it was used for other cases, that is now illegal. unless it is passed by a 2/3 vote of the legislature. that is the key things it does at the state level. >> at the local level what prop 26 is requires us to public -- put regul

so there are other producing the prop 1b funding. commissioner campos: so what is the answer to the question, whether or not the use of this money comes to the expense of other projects? is the answer no, is that what i am hearing? >> out of the prop 1b effort, the agency is assigned it capital funding level. central subway is its number-one priority, and with that number one priority, has garnered a lion's share of that. but there are other programs benefiting from prop 1b. commissioner chu: what you are saying, in terms of the $72 million, that does not come from taking it away from another project that has already been allocated. it was previously unallocated money and is going toward this current priority. commissioner campos: i think that clarifies it. thank you. >> now, the sfmta needs partners to time of the allocation of these funds, primarily we are asking for advocacy, identification of the prop 1a bond funds in the state budget, so that we can put in a program request for the $34 million. also, for a time allocation of the

voters snuffed out prop 19. christie smith is live in oakland.ost by quite a big margin there. >> reporter: yeah, that's what we're hearing. really the whole nation tuned in to see if california would blaze a new direction here with its marijuana laws, but voters decided to go another way on prop 19. here with me this morning is dan rush with yes on 19. good morning. what is your reaction to how the vote went down? >> well, i think that we see a clear and decided movement in california to move in the right direction and create jobs and taxes. so, unfortunately, the irresponsible message that was sent by the attorney general resonated a little more than we thought it would. and unfortunately it's going to be a couple more years before we see the 60 or 80,000 sustainable union jobs that are created from a legalized cannabis market. unfortunately it's going to be a few years before we see the billions in sustainable tax revenues. but obviously we see clearly that there is a grassroots movement out there. there's a social labor and political movement

one of the first things that prop 22 does is protect both those sources of funding. in addition, it protects, and this will be prosecutor for projects like the presidio parkway -- it will protect the highway users tax account from being borrowed and goes a step further and prohibits the use of highway users' tax account funds to pay for general obligation debt service. the legislature in enacting the swap was trying to generate some revenue to help the general fund, and they did. it is booked at about $1 billion. proposition 322 those thorough -- proposition 22 throws that into doubt. some say that relief will be lost. at this point, the pretty clear reading that the general fund is going to be hit at the state level at about a $1 billion level on top of everything else. there is a provision in there that says anything enacted from october of 2009 through the passage of that measure that is not in compliance is in invalidated. some folks have said the fuel tax swap may violate that in some regard, but it would take some sort of action before anybody would ever say th

stacy you wanted to prop 25. the sure you prop 25 and will come talk with our analysts. prop. 25 has been a big issue in california because the fact that we just went through the budget delay or the budget was over 90 days late to end each day the budget is late it cost the state money at least ious and furlough fridays. the voters at this point this is mostly absentee balloting voters are saying look you guys to a simple majority instead of the two-thirds threshold pass a state budget that would not change however tax hikes. what you think for 1925. >> 19 is in trouble while wallace 25 looks majority. >> prop 19 got $1 million from billionaire just in this last week he pumped in a million dollars and supported the measure for medical marijuana out just regular marijuana use. that's a big gap. >> i do think that gap will close but i don't think it's going to pass in this election. one of the big problems is going to be a turnaround pureed 90 was popular with young voters and they're the worst has a were turning out. with a big turnout of young voters this one not so much

. >> at the local level what prop 26 is requires us to public -- put regulatory fees before the public? mar or a regulatory fee. supervisor mar: commissioner maxwell? supervisor maxwell: give us an excellent? >> alcohol. >> that was passed prior to 2010 and just stays the same. you will be able to leave that on the books. if you increase it or extend it, if it was sunsetted, then you would have to play by the new rules, requiring a vote of the people. >> one i have wondered about if we were to ever impose a congestion fee impacted by prop 26? would we have to go to the electorate now? >> it could be. you could design the fee and have fight findings and dedicate the revenues. you get outside that and use the fee revenues for other things, it becomes a little more subject to 26. supervisor mar: economicser maxwell? supervisor maxwell: no. >> one last comment is there is a school of thought that the fuel tax swap, either in part or in whole, may be in validated. now a provision in prop 26 that anything that was enacted in 2010 that is in violation of the provisions of the act have a weir

prop j requires substantive changes. it's a tremendous increase and creates a new body with tremendously more power than the landmark board had and even increases in some respects the power of the board of supervisors. substantive changes were required. so that really was kind of why this took longer is because really it is a complete transformation of what we're doing. that being said, we tried to keep it as simple as possible and where possible, keep what was in article 10 and 11 in there, and in some cases in terms of the notifications, actually try to make it easier and simpler. i for one am very much in favor of trying to reduce the cost to the public. and that sort of thing. one of the things that prop j is did is give this commission the power to initiate and that power was not qualified. it was not qualified by any true sense of the public, it's pure. that we have the power to initiate. so i think that it was very appropriate that it shows up that way in our -- in this proposed article 10. however, what we have d

prop 25 will make it easier to pass a budget, but with prop 26 it's questionable how are they going tose the money to -- >> belva: the fees, does that apply to local government? >> yes. >> belva: that applies to everyone? >> it does. it does. now, there are some exceptions for some regulatory fees where you can, you know, make a clear nexus between the fee and the regulation. but there are a lot of things, i mean, you think about -- >> jerry brown said that may take a billion dollars right there out of -- >> it will kill local governments because as their budgets have been hemorrhaging they're looking for anything to -- walking down the sidewalk -- cigarette butts, chewing gum. >> and the league of cities was leading the charge against that. but what happened was, too, with money in these campaigns the backers of prop 23, the rollback of the air pollution law, they saw that was going down, and toward the last few weeks they shifted a lot of their campaign money to yes on 26. chevron, the american beverage association. and i think it paid off. >> let me ask you about the simple majority

as i mentioned, $120 million in prop 1a, 1b funds. then we can work together to find alternatives for all of our other needs in the agency. it translates to about $27 million a year that we would have to back fill if we were to give up the money for the central subway project from those remaining 1a, 1b funds. we look forward to working with the mta to come up with funding, or hopefully the federal government will be able to provide us with some transportation funding. supervisor campos: thank you. these kinds of challenges are challenges that happen with any project of this magnitude. it is probably exacerbated because of the economic climate we are working in. i am just wondering if there is anything that this body, whether it transportation authority, board of supervisors, can do to help advocate for these funds. many of us have made clear that we are committed to the project, so what can be done to help us get to that end result? we are talking about $137 million, potentially $225 million. that is a lot of money. >> we would love

prop 19 lost by a solid 8-point margin. state voters also rejected prop 23. it would have suggestion expended certain environmental laws until california's economy improved. also prop 24 went down. it would have repealed three recently approved tax breaks for businesses. >>> and there are two big races that are still too close to call this morning. in the race for attorney general, republican steve cooley the district attorney in los angeles county had been in the lead all last night. but democrat kamala harris of san francisco has now pulled ahead by a fraction of a percentage point. she is the d.a. in the city. also drama in the 11th congressional district, which includes parts of alameda, contra costa and santa clara counties. there, democratic incumbent jerry mcnerney is trailing in his bid for re-election by a mere 23 votes to republican challenger david harmer. >>> and right now, san francisco police are looking for the person who stole a bunch of ballots. police say someone broke into an automatic ballot counting machine yesterday afternoon in the city

let's start with prop 19. not a lot of advertising dollars on this one, but certainly a lot of buzz. it would legalize and regulate recreational marijuana use. the latest poll show that it is failing which is 42% of voters backing that one. on to prop 23 which puts a hold on california's green house gas emission standards until the economy stays steady for 12 months. 48% of likely votes surveyed said they will vote no. on prop 25, this has to do with the budget to change the vote to pass a budget to a simple majority. that really seems to strangle the process every year. 48% of fed up and will say yes on that. they close at 8:00 tonight and that's when we start our coverage on channel 11-2 and comcast 186. at 9:00 tonight right here on nbc bay area, the news political team will begin coverage of the national races. we have a couple of those as well followed by an hour long 11:00 election night newscast. coming up in about 10 minutes, we will talk about voter turn out and you might be surprised about how many p

"today in the bay's" christie smith is live in oakland.ugh the voters have spoken this time, the fight is not over yet. >> reporter: yeah, good morning to you. despite the defeat at the polls last night, supporters of prop 19 are really seeing the silver lining in this, that it was actually taken quite seriously by the voters overall. here with me this morning is dan rush with yes on 19. good morning. what happened? >> well, we see that there is a clear movement in california to end prohibition and to create these jobs and to create the tax income. i think we did pretty well, even though attorney general eric holder and his really irresponsible message threatening people that are going to form jobs, private industry that's going to create good, dignified jobs that are going to put people back to work. california is hurting and we need to get creative. one of the things we can do is tax and regulate the 500,000, 600,000, unregulated, untaxed cannabis transactions that happen in california every day. and there's a clear coalition going on he

prop 23 was defeated. prop 24 also defeated. breaks for the corporations will continue and prop 27 has been defeated, and that would have gotten rid of that independent redistricting commission altogether. so let's chick in with catherine heenen in our newsroom with an update on the local measures. >> i just want to leave you with the thought that if you want to raise money for your community tonight, the way to do it was to tax medical marijuana across the board. those were the big yes votes. this is alameda county, measure s. in berkeley raised taxes on medical marijuana from .122% to 2.5%, huge yes, 83% saying yes. measure t. in berkeley expanding medical marijuana would allow six medical marijuana growth facilities on the west side of town. it would allow for a dispensary, another huge yes vote and measure v. in oakland, they want to nearly triple the tax on medical marijuana and yes, another huge yes vote from voters. back to you. >> and a quick update here, the governor, lieutenant governor, jerry brown declared the winner

the prop ontse -- fix muni. the prop ontse say it will but it does nothing to make the service more efficient or even make management more coonlt -- accountable. within the agency we have a bloated, top-heavy layer of management who is ineffective, not accountable and basically we feel is one of the main on stackals to real form. -- on stkles to real form. proposition g. all it does is blame drivers tore the problems. last year we had a top manager who makes $220,000 a year while service was decreased, fares increased and we even eliminated service on one line. one of the big issues is we want accountability and proposition g doesn't even address that issue and one of the biggest issues is that drivers are part of the solution, not the problem. we have one of the hardest jobs in the city, driving one much the -- in terrain that is difficult to maneuver but you know, we do it in a manner that is efficient taking into consideration we carry over 700,000 people a day and we deal with disabled and senior passengers
