. >> and i'm raj mathai. we begin with the latest on the investigation of a sexual assault on a 15-year-old teenager named audrie pott. she took her own life days after the attack. it is a troubling story we reported last night. our usual policy is not to identify the victims of sexual assault or suicide. but in this case her parents want her name and face to be shown in an effort to prevent this from happening to anyone else. we have several answers on how the sheriff's department has handled the investigation. we have information about a key piece of evidence. p marianne favro is with us tonight. we begin with monte francis in san jose. >> reporter: the three 16-year-old boys are being held here at juvenile hall. we have learned way back in september they were cited on a misdemeanor charge of sexual battery and released. why did it take seven more months for them to be charged with felony? three 16-year-old boys in juvenile hall each with two felonies including one for distributing sexual photos of a minor.

. >> i'm raj mathai. >> and i'm jessica aguirre.:00 on the corner of leigh way and ann way. what a lot of damage. >> reporter: really a somber mood out here. this is one of the cars involved in this accident here. you can't see the second car because it is inside the home behind me. one of the firefighters said he had never seen a car go this far into a home. right now firefighters can't go inside the home. they are trying to make sure that it is structurally safe to go in there. they have been working on putting support beams up. at about 4:00 this afternoon firefighters say they responded to a call here on leigh avenue. the lieutenant tells me he believes from talking to witnesses out here on the scene that the people involved in the two-car accident are all minors and that it appears that they had been racing out here. quite a dramatic scene. we talked with witnesses earlier today and here is what they had to say. >> two bmws are coming, one red and one silver.

. >> and i'm raj mathai. >> a local district attorney is in hot water but perhaps what he did was completelyegal. that is what the santa clara board of supervisors wants to know after our investigative unit found john rosen giving thousands of hours of free time off to employees. >> the county executive is asking the attorney general to step in after the board of supervisors discussed it this morning. it is the latest fallout in our on going investigation. >> can he do that. >> reporter: supervisor wants the county's own legal team to determine what atmosphere what d.a. jeff rosen did was legal when he granted thousands of paid time off to make up for a 5% cut. >> i would like to avoid the cost and the delay and having somebody sort out the fundamental question which is it allowed or not. >> reporter: how that question will be answered was the center of discussion today. the county executive suggested they seek outside opinion. other board members agreed. >> if we don't have somebody come in and make a determination as to what happened in a binding way this could become very messy. >> report
