kpix 5's len ramirez with what he we are learning about the victim tonight. len. >> reporter: ken, we have some new information from the sheriff's office here in dublin this afternoon concerning the victim of this crime as well as some of the circumstances of this shocking murder. the picture of a father holding a baby and a pacifier, unfortunately they are pieces of the story at this murder scene's makeshift memorial. yesterday afternoon, a killer's bullets barely missed three baby but killed the 39-year-old father daniel del toro who was pushing the baby in a stroller in hayward when he was gunned down on willow street. >> with his baby when they shot him. that's unfortunate. that's really kind of uncalled for, bro. >> it crosses the line big time, it does. >> reporter: today neighbors and veteran officers were saying the same thing. >> even by street code, it's kind of a below the belt move to kill someone in front of their child. so, um, you know, it's disturbing. >> reporter: sergeant ray kelly says alameda county detectives are piecing together a case.

but the company told our kpix 5's len ramirez, don't blame us. >> reporter: the town of davenport sits on a hill overlooking the ocean halfway surrounded by water. but soon in this town of 400, there may not be a drop to drink. >> we had a huge downfall of rain this last winter, and no one would ever suspect that we would be running dry at this time. >> reporter: it's true. the problem goes back to the history of the town and its ties to the cemex cement plant, which closed in 2010. city water runs through pipes on the cemex property but last winter's storms damaged pipe and the town switched to a backup supply from a nearby creek which runs dry in summer. now according to one county supervisor, davenport has less than a month of water supply left, and the county may have to seek legal action. >> they always kept the water supply flowing to both their plant and this community, and now that they've left, they decided to essentially abandon the community. >> reporter: cemex sent us a response saying the damaged pipes are not on cemex property and blamed the county. cemex did discuss the

kpix 5's len ramirez is live in san jose and explains how much the company is paying up. len. >> reporter: well, it's in the millions, ken. you know, this water company provides water service to over a million people here in the santa clara valley. now, as you mentioned, it is applying to give a refund to its customers. but it denies that it did anything wrong. the san jose water company denies that it intentionally double billed its customers. >> we don't believe that that's a fact. let me add that there's been a complaint filed. >> reporter: but it has agreed to refund an average of $5.70 to every one of its 220,000 ratepayers. it's a $1.8 million debt to be paid for a big issue that surfaced last january -- billing issue that surfaced last january. >> they paid a rate that was not in effect at the time that they were billed. >> reporter: john tang says it happened when san jose water changed billing methods from a pay in advance system to a pay in arrears plan. he says the water company has the right to bill in advance. but a san jose consumer watchdog group says the c
