nbc10's randy gyllenhaal is live at the courthouse in norristown. tell us what happened. >> kane's attorneys had filed a motion, basically accusing montgomery county prosecutors of leaking fbi recordings to an allentown newspaper. those recordings allegedly showed that kane knowingly gave confidential grand jury information to another reporter, and that is something she denied. let me show you the video of kane arriving in court this morning. she did make no comment, and in a surprise move, her defense team actually decided to withdraw that very motion they had just filed about the fbi tapes, calling this all a distraction. >> i don't have time for distraction. i don't have time for going on some kind of wild-goose chase. i thought it was a distraction, to be frank with you. i have been in these hearings before. and it's a mystery that never solves. >> now, montgomery county prosecutors have denied leaking any kind of fbi tapes to a newspaper. meantime, kane's defense team asked for a week to file more papers in the case that could potentially delay

randy gyllenhaal, nbc 10 news. >> police are using new video right now to try to track down the woman who threw hot coffee in another woman's face in center city. philadelphia police say around 9:00 monday morning the two women were arguing at this starbucks on arch street. after the coffee was thrown, the suspect punched the victim. police are still looking for the suspect wearing pink pants and holding a pink bag during the assault. >>> now, to a mail mess in philadelphia. some 10,000 bills, notices and citations aren't making their way into mailboxes. an investigation reveals mountain of mail is just sitting unopened in the city's mail distribution center, that center located in the concourse of suburban station and is not connected to the united states postal service. but nbc 10's aundrea cline-thomas following the story. tell us how did this happen? what's being done about it. >> reporter: the investigators with the controllers office made a surprise visit to the mail center. when they arrived they found that half 0 the employees did not show up to work on time. those that were t

randy gyllenhaal is live on the scene. there were two exchanges of gun fire there? >> reporter: we were told after those exchanges that suspect ran here to the front of the boost mobile store on north broad street and collapsed right there on the sidewalk. police are saying this suspect was in the process of robbing an elderly man with a gun. let me show you some video when he was interrupted bide an off duty philadelphia police officer. police tell us the off duty cop confronted the robbery suspect telling him to drop the weapon. some words were exchanged. the man refused to put the weapon down and that is when police say the officer opened fire. >> at that point the suspect turns towards the officer. the officer engages him i believe there's a discharge at this point in time. the suspect then fled southbound on park avenue. >> the off duty cop pointed a gun at him the whole time. like, don't move. >> reporter: now, that suspect was hit in the abdomen. he was taken to the hospital and pronounced dead after 3:00 today. that elderly robbery victim was hospitalized. p

nbc 10's randy gyllenhaal live where he spoke to neighbors as well as investigators. e did just get an update from police. they tell us the mother of this girl called 911 on sunday, saying that her daughter had slipped and fallen while she was playing. but the police investigation revealed injuries much more consistent with something like a car accident as opposed to just a simple slip and fall. >> reporter: 2-year-old athena wolf found unresponsive at her family's home in morrisville. she had bruises up and down her body. >> very disturbing to see this small child in the condition that she was in. >> reporter: when paramedics arrived the baby was in cardiac arrest, neighbors watched as she was rushed into a waiting noti bruises on her face and she was not responsive. it didn't look good. >> reporter: doctors performed emergency surgery but athena died from blunt force trauma. doctors say she looked malnourished and was battered. now police have charged the girl's own mother with criminal homicide. >> she kicked the child repeatedly in the head and in the trunk area of
