. >>> allie rasmus is live where there are problems. >> reporter: the fire trucks are gone. before they left i had a chance to talk to the pg&e worker. he had gone inside this home in berkeley. he was checking to make sure there was no carbon monoxide or gas leak problems. we found out there were no problems. while this investigation was going on, the four people that lived in this home were waiting outside in an ambulance trying to keep warm. berkeley firefighters were called out to the home around 3:30 this morning after one of the residents reported feeling dizzy smelling fumes and fell and passed out. the family told them they had turned on their heater for the first time. with the cold weather setting in this is the time of year people should be aware of some of the problems heaters can cause. >> if a heater hasn't been used in a long time, it can get a build up of dust and dirt. the first time it can turn on it will burn off that and it will cause a foul smell. >> reporter: now again pg&e did not find any signs of oak sycessive -- excessive carbon monoxide in his home.

allie rasmus has new information on this situation. what's the latest? >> reporter: we spoke to the spokesperson who says the refinery is in the process of restarting operations. if i step out of the way, that's the tesoro eagle refinery you are looking at. the mailing address is in martinez but the refinery itself sits in an incorporated part of concord. even though it appears things are back to normal, two of threes flares are still burning off fuel this morning. >> we have one or two flares that are actively flaring at this point. but as a result, we were able -- [ inaudible ] >> reporter: it was a different scene out here yesterday, when six flares were burning, flames and huge plumes of black smoke were visible in the area. around 4:00, the refinery's pain power source and backup system went out. that outage triggered the flares, it burned off diesel and hydrocarbon in the air and released the pressure buildup. any time you burn off fuel it will lead to air quality concerns. contra costa county hazardous materials department took samples of the air

allie rasmus is live with the latest on prop 19. >> we're live in downtown oakland where supporters ofproposition 19 are signing up if -r their campaign party this evening. prop 19 would legalize marijuana for personal recreational use in california. that party is going to be taking place through these doors down the bassment of this building. the yes on 19 people would not allow our tv cameras to be downstairs in their basement for the party. they said there just wasn't enough space. so instead what they're going to be doing, they're going to be a projector outside and they're going to film the party themselves and broadcast it out here on this wall for media and other supporters out here to see. now their campaign headquarters is a block away from here. right now volunteers are down there doing some last minute polling, last minute phone calling to get their supporters to the polls. the latest ktvu field poll shows opponents of prop 19 outnumbers supporters 49-42%. earlier this afternoon we stopped by a polling place and we found people with a variety of opinions on the issue. >> i v
