immediately after the shooting reaves said he shot because he was scared. reeves said he was hit with a controcell phone, and prosecutos dispute that saying that the only thing injured was his ego. >> i have no doubt in my mind that it was the right decision. >> reeves attorney said this case clearly hinges on self defense. they say it's too soon to say whether or not he'll use the controversial stand your ground law as a defense, but he cited it several times in court. >> in west virginia residents are worried that their water still isn't safe. they filed a possession against the department of health. runs of people are expected to march today to the american water company headquarters. they're angry about a toxic chemical spill just last month that caused 350,000 people their water. we're live, andy, what's happening over there? >> reporter: morgan, the blame game really started to spread. here at the water department they're taking all the heat today. hundreds of people are gathering at a church a couple of miles away. they're going to march with placard

>> reporter: tony, the judge's decision that reaves will remain in jail until the trial or until an appealecause the attorneys are appealing it, came after two very long days of testimony. it actually felt a bit like a trial in and of itself. now, reeves' attorney said he's an elderly retired police officer, and he doesn't pose a threat to anyone. we caught up with olsen's widow and reef's attorney to get their opinion. >> i'm happy and relieved by the judge's ruling. i have no doubt in my mind that it is the right decision. >> reeves truly is an innocent man, and we look forward to proving that at a jury trial. >> less than a month ago reeves god upset with olsen for texting the babysitter during a mat nate at a movie theater in wellesley chapel. now olsen was texting the babysitter because his daughter was home sick. what we do know and according to police is that things escalated. olsen threw popcorn at reeves. reeves said olsen even threw a punch or hit his head with a cell phone. >> he kept on hollering and i'm not sure what he said, to be honest with you. he said something, and that

police say reaves did not have any injuries. but some how things escalated, and reeves said that olsen began spewing profanity at him, stood up in his share, and quote/unquote came at him 37 so much so that olsen's wife put her hand on his chest to hold olsen back. reeves doesn't know what olsen said but threatened him and threw a cell phone at his head. that's when he pulled a pistol out of his pocket. >> if i had to do it over again it never would have happened, i would have moved, but you don't get do-overs. >> so what made you shoot him? >> well, i guess he scared the hell out of me. i thought the guy was fictioning to beat the [bleep] out of me. i don't know how he would to say that. >> he never told you that? >> he said something that led me to believe. then when the guy comes at you with the aggravated position, the contorted face, the bleep stuff like that, i don't think i've ever had anybody get in my face like that, and it scared the crap out of me. >> olsen's widow was shot in the hand with the same bullet that killed
