recalls that can frighten consumers and for good reason. now a bay area lawyer and his clients are going after a major supermarket chain they believe is shirking its responsibility to individually inform its clients about the most dangerous recalled foods. traci grant is in san francisco tonight. this involves the untapped safety net that we know better as the safeway club card. >> absolutely, tom. you give safeway a lot of personal information. in exchange you get the discounts that come with the safeway club card. a lawsuit that was filed in alameda county yesterday insists with this, safe way has all the information it needs to sound the alarm on food recalls. now, to get this club discount card, you give safeway your name, phone number and e-mail address. they end up with a record of everything you buy. the lawyer, daniel labelle says all of that information could be used to figure out which customers have bought recalled food products and alert them before it's too late. one of its clients purchased the exact type of eggs last summer f

at florette entrapment recall in early october 2009, an expasion of the recall as well as the sticky pedal recall in january of last year. and, finally, the congressional hearings shortly thereafter. we receive the majority of the complaints after the recall and almost half of those came in favor and march of 2010. i want to draw your attention to some important numbers in our vehicle complaint database. of the 9698 unintended acceleration complaints, 1998-2010 model year vehicles, only 3054 were unintended acceleration complaints about toyota vehicles. in other words, about two-thirds of the unintended acceleration complaints to nhtsa spanned the entire automotive fleet. unintended acceleration i not exclusive to toyotas. the vast majority of the unintended acceleration complaints of toyota vehicles involved incidents with the vehicle was stationary for traveling at very low speeds, and the driver claimed that the vehicles suddenly accelerated and the brakes didn't work. we found when the complaint alleged that the brakes didn't work, or that the incident began when the driver stepp

>> reporter: the hercules recall committee delivered thousands of signatures to the city clerk for the two members. starting at the beginning of the year with 100 people at the first meeting and it gained community. >> i think the community has answered and said we want a clean slate in the city of hercules. >> reporter: it took 75 volunteers 16 days to collect 3000 signatures for each council person's recall. >> they are angry. i think we had less than 30 people that we asked to sign the petitions that didn't want to sign. people knew about it. they saw our signs. they came up to the post office with these signed. >> reporter: the signatures still need to be verified but if they do qualify then in june voters will be asked to decide whether the two should go and if so who should replace them. dan says he will run for one of those spots. >> we had a very strong city manager and we had a very weak city council. and the two added up to a lot of misused money. >> reporter: the recall efforts believes the city's redevelopment agency will be $62 million in the hole over the next five years.
