nbc bay area's kimberly tere is live at the chp offices in redwood city with the details. >> reporter: terry, we're hoping to learn the latest on this investigation in just a few minutes shortly, but here's what we know so far. this crash happened at about 2:00 a.m. this morning. according to chp, a 43-year-old oakland man was driving on u.s. 101 southbound, south of the broadway, when his car slammed into the center divider. it came to rest in the fast lanes, facing oncoming traffic at that point. a party bus came and hit the front end of that car. the driver of the car, identified as raul padilla survived, but is in critical condition, but a passenger inside that car was killed. eight of the party bus passengers suffered minor to moderate injuries and the driver of the party bus was also injured, but refused medical attention at the scene, deciding instead to drive himself to the hospital at that point. those on the party bus who were taken to hospitals were between the ages of 22 and 45 years old. the chp says an initial investigation shows the driver and passenger of the car had b

he was attending redwoodside high school in redwood city. on all accounts he was a good kid and a student who studied hard. he love football and last night around 11:00, he was sitting in front of his home friends and just coming back from mcdonald's. two young men came walking up to the car and shot into the car. they stroke jose luis and the chest. a fourth passenger was able to escape. unfortunately, what looked jose luis it did not survive his injuries but the other two did. they do have life- threatening injuries but the big question is who did this and why? investigators are still trying to find this out. speaking with his father he believes it was the case of mistaken identity. at this point, even the officers are saying they do not believe this has any sort of gang affiliation. you can see this is actually the home of jose luis and you can see they're even some stray bullets that hit some other family members car. you can see the back window is blown out as well as another stray bullet that hit a home. very close to the doorway right
