kron 4's reggie kumar tells us he was remembered at a vigil honoring those lost to violence. >> a make shift alter was set up. candles were lit as photos of those who were lost to violence were posted. the center picture is oscar grant and kenneth harding, jr. messages were strung up on rope. this one says justice for victims of police violence. vigil organizer is with power, an organization that helps individuals find work. she says it's time for the community to start the healing process. >> folks will be able to put up pictures and notes and we are here to celebrate the surviable of folks who have been dealing with this. >> reporter: they saw police officers shoot kenneth harding and it's hard for them to believe he died from a shelf inflicted gun shot wound. >> i still have that image of him crawling for his life on the ground. i keep having those images. >> reporter: during the vigil some became angry and started yelling, urging people to remember kenneth harding at this spot where he died. he poured wine on the pavement. she felt compelled to come and pray for peace. >> i have a

reggie kumar, kron 4 news. >>> a developing story tonight in palo alto. the city counsel is considering asking voters to consider the fate of binding arbitration. they are negotiating with the firefighter's union. kron 4's rob fladeboe has more. >> they are still in there and right now, late tonight or tomorrow morning the city counsel is expected to vote on one of two options that could ask the citizens of palo alto to weigh in on this. binding arbitration has been on the books since 1978. part of the city charter. the only way to change it is to go to the public for a vote. let's go to video. this is all about an ongoing impasse with the firefighter's union. minimum staffing, 29 firefighters in palo alto must be on duty. the city says that's too much. paying too much in overtime. the firefighters are saying they can't get this done. here are a couple of argument on both sides of the issue. >> binding arbitration transfers that authority and responsibility from the sinty counsel to one independent arbitrator. i think in an era of public accountability th

reggie kumar tells us what the family of donald lee, the organizer of the fishing trip, plans to do now. >> reporter: donald lee is one of the seven fishermen still missing in the sea off the gulf of california. he had been organizing the trip for a year. they knew the search for the men would be called off eventually. he says he does not understand why the department of defense won't send divers down to where the mexican navy thinks the ship sank. >> they used very specific language by saying the capabilities to do this sort of dive were very limited and the capabilities were not available at this time. we're not going away. we're not giving up. if anything, i would say that we are more galvanized in our efforts because right now, we went from being sad to frustrated, and now we're angry. we do appreciate what the coast guard and everyone has done for us. there's just a lot of unanswered questions still that we would like find out before this effort's called off. for us, it's always been about the dive because we want to bring our fathers home. >> reporter: the family is now looking in

kron4's reggie kumar talked with the son-in-law of the man. >> reporter: families and friends have been hard at work posting this flier of the seven men still missing at sea. the ship capsized during storm on sunday. lee's daughter closely monitors the search operation with the u.s. coast guard through e-mail and on the phone. this is the fishing boat he uses he in the bay area. the 62-year-old had been organizing this fishing trip with all of his friends for a year. the red truck parked in front of lee's home belongs to al main. he's one of the missing. the son-in-law says the family believes lee is still alive. >> if he got the boat, we're confident he survived. he actually owns the fishing boat. he has a few boats. his choice is in the open ocean. he loves being out there. he's very comfortable in the water. he's a strong swimmer. we have a pool back here. he grew up swimming. fortunately, the conditions are very beneficial to us, warm temperatures, the water's warm which is why they've had such a large window for the search and rescue. it's a 96 hour window. we are preparing for the
