nbc news justice reporter ryan reilly is outside the courthouse here in d.c.ter: enrique tarrio, the head of the proud boys was supposed to be sentenced yesterday. judge kelly wasn't feeling so great. he got on the bench and apologized for his absence. tarrio's hearing has been rescheduled for tuesday. later today, probably around the noon hour, i would expect, we could see a record setting sentence for january 6th cases. right now the record belongs to stewart rhodes, the founder of the oath keepers who was sentenced to 18 years in federal prison in may. in this case, federal prosecutors had gone for 25 years and ended up with a sentence of 18 years. in this case prosecutors are going for even more. they want joe biggs to spend 33 years behind bars saying he was an instigator on january 6th and was driving a lot of this sort of move towards rebellion and political violence by the proud boys leading up to the january 6th attack. he was actually on the ground january 6th and had a bull horn with him and leading the proud boys as they marched around the capitol.

ryan reilly is outside the courthouse. what have you got?federal prison. the second longest sentence of any january 6 defendant. the range was 27 to 33 years. prosecutors requested 33 years in federal prison for joe biggs saying he was a leader of this violent attack on the u.s. capitol. i'm showing images of him leading the mob towards the capitol. he made it on the floor. was in the gallery of the u.s. senate during the attack and celebrated this saying that january 6 was a day that would live in infamy. he spoke before his sentencing, asking the judge to show mercy on him, crying, talking about list daughter and his desire to continue to play a part in his daughter's life saying that his daughter had been molested and he wants to be there for her to be able to pick her up from school. ultimately, that probably isn't in the cards for joe biggs. that's 17 years in federal prison. short of what prosecutors wanted here, but still a significant amount of time behind bars, even with credit for time served as well as good time, that's going to l

joining me now, ryan reilly, from outside the courthouse in washington, d.c. donald trump set to appear there about 24 hours from now, tomorrow, from what we know. what do we know about that appearance? >> reporter: luckily the line hasn't started yet, but there is i lot of anticipation here. someone dressed up as donald trump in an orange prison jumpsuit was in the location behind me a little while ago doing interviews with reporters there. some of the fanfare has become. we expect barricades to be set up around this courthouse. we expect that means one entrance will be open. the secret service has to work closely with the u.s. marshals service, the park police. we're in an area that is, you know, within sight of the crime scene, which is sort of remarkable here. we can see the u.s. capitol from where i am standing now, a few blocks away. so you're going to have a lot of law enforcement agencies that need to coordinate for this security situation, to make sure everything is kept safe in this unprecedented event. we haven't seen indications thus far on social

. >> i want to bring in nbc's ryan reilly who wrote about this. security analyst, we're happy to have you here in studio. ryan, you have been looking into these conspiracy theories, theorists saying this protest in atlanta is a big setup. what's going on there? >> yeah, you know, it's surprising because i think a lot of trump supporters greatly overestimate the fbi's size and capabilities and practices generally. and a lot of this grows out of the january 6th attack itself because you constantly have a lot of these theories thrown out there about how, oh, these were undercover actors, working on behalf of the government in some capacity. an individual named rally runner, he's actually a st. louis cardinal's fan who ran around the stadium during home games there. back in 2021, on tucker carlson's fox news show, a january 6th lawyer, a right wing activist was saying this individual was clearly a law enforcement officer and saying this was an agent provocateur who was riling up the mob that day and causing them to do things they wouldn't otherwise do

ryan reilly joins us now. what did the judge have to say?ed would be the longest sentence of any january 6th attack defendant. that said, he is talking about potential for departing downward from that range, so that could not ultimately being the sentence range he gets. that's what they're starting off with, saying he does get a terrorism enhancement because he -- this was a crime of terrorism in taking down that black fence that joe biggs took down in front of the capitol on january 6th, that was under federal law a crime of terrorism because it was all about this broader movement of using force to basically to oppose the federal government, to strike fear in the hearts of lawmakers, who were inside the capitol that day. so could ultimately end up with the longest sentence here. the longest sentence to date was 18 years. that went to the founder of the oath keeper, stewart rhodes. they were seeking 25 years and the judge landed on 18 years back in may. and in that case, he was calling rhodes a threat to the country. we could see in the next

nbc news justice reporter ryan reilly joins us now. ryan, in a new court filing in the hunter biden case prosecutors wrote that this case, quote, will not resolve short of a trial. why is the special counsel being appointe now how does this change the investigation? it's a little bit of a good question because we don't really know the exact timeline and there's still a little bit of questions about how this all shaped up. we do know according to the justice department officials there say that this request to become special counsel came on tuesday, but there was still -- you know, this was still sort of in the works whether or not up until at least today is when we learned ultimately that there's not going to be this plea deal going forward, that there's just a fundamental disagreement there and they can't come to an arrangement. so this is going to be set for trial. what that also means is that because most of the alleged crimes took place either in d.c. or california they are not going to be able to continue on the track in delaware.

let's bring in ryan reilly, who is outside the courthouse for us.to skip ahead to the big fish who are yet to be sentenced. let's deal with what happened today. take me inside the courtroom, and especially shed some light on the victim statements. they were pretty powerful. >> yeah, so we actually have an omnibus hearing with all of these three various capital police officers earlier this week. and today we had individualized sentences for joe biggs and zach rehl. they went for 33 years. the judge went longer, the second longest january 6th sentence we've seen to date. and zach rehl with 15 years. what's notable about the zach rehl case. the judge determined between 30 years and life which make yourself head pop up when you hear a judge say something like that, but ultimately went with 15 years, which is fully half of what the sentencing, the bottom half of the sentencing guidelines would have been. and judge kelly sort of explained here that he wasn't convinced that there is enough evidence that zachary rehl actually intended to kill people on janu
