so how will judge reinhart rule? if fast is precedent, it is almost certain he will side with the d.o.j. and keep the affidavit under seal. and all, d.o.j. is arguing releasing it would do grave damage to their investigation. but here's the thing, there really isn't a lot of specific precedent here. a former president of the united states has never had their home searched by the fbi. a former president of the united states has never taken classified materials home and then not given them back. a former president of the united states has then never gone on to publicly attack the fbi and the d.o.j., putting the departments and the individual law enforcement officers and officials who work there in grave personal danger. that is to say the public interests around this case along with the potential consequences of withholding more information around the search could sway the judge into releasing it, if not all of it then maybe some of it with redactions. and while we don't know what judge reinhart will decide at this mom

judge reinhart ordered the justice department to unseal portions of the affidavit used in fbi raid of's home in florida. ashley webster live from florida with more. ashley, good to see you. reporter: hey, great to see you, lizzie indeed. indeed u.s. magistrate judge bruce reinhart says he believes there are portions of the fbi's affidavit that could be unsealed. it's a document that lays out in fine detail the probable cause that investigators used to persuade that very judge to green light the search of donald trump's home in west palm beach 10 days ago. now the department of justice wants to keep the affidavit sealed arguing it deals with highly classified materials and contains the names of witnesses who could become vulnerable to potential threats. attorneys for media outlets argue it is the public's right to know and historicking is cans of the search outweighs any arguments to keep those records sealed but in the end, somewhat surprisingly judge reinhart took the middle ground ordering the government to send him proposed redactions to the affidavit by noon one week from today. t

those in the maga world who are cheering judge reinhart, i think that is premature. when we get the affidavit, i think that it will look like swiss cheese. i think that it will be five to ten words on each page, they will be disjointed and it won't tell the public much. and that is the way it should be because this is a pending investigation. sources are at risk. witnesses could be tampered with. and the targets could then be alerted to what the department of justice is doing and then they can coordinate their stories. so nothing good can come out of releasing this affidavit. and i don't think that donald trump even wants it released because in court yesterday his lawyers did not join in the media's request to release it. so he says one thing on truth social but another thing in the courtroom. >> and we've learned in court yesterday that this was a lengthy and detailed affidavit. we learned that the application for the warrant cites willful retention of defense information. does that sharpen the criminal focus do you think on the former president? because this is at

i just want to say that i personally know magistrate bruce reinhart.new him when he was an assistant united states attorney. i knew when he left and was in private practice, i've certainly appeared before him as united states magistrate judge. notwithstanding what the guess had said with respect to his facebook posting, i do believe that this judge, his integrity is beyond reproach. i've never seen him do anything that i would believe would somehow question his ethics or his integrity. with that being said, i am a little concerned as to whether or not there were some efforts that may have misled him down this rabbit hole and whether or not that may need to be further looked into with respect to whether or not he was more victimized to be used in a ruse to sign off on this warrant. that's the only thing that i can speculate. we don't know. >> shannon: if we get to this underlying affidavits and documents, we can understand how people would be skeptical of the past few years knowing there were things presented to courts. like we said with the fisa courts

what did they possibly tell reinhart? did they relay this history to the magistrate that, according to these sources, that the president had cooperated? i mean, the idea that he was subject to a subpoena, complied with a subpoena, didn't challenge it, voluntarily showed the storage room to the agent, followed their advice, secured it to meet their demands, all of that is hardly a basis for saying now we need to send in 40 fbi agents on a nighttime raid. i mean, if the subpoena worked the first time, then presumably a second subpoena would work the second time if there were remaining documents that were not gathered up in the first collection. what we have to find out is the details. you know, there's this suggestion of this confidential source. what was alleged in these papers? do they really suggest there was a risk of destruction or active concealment? those are things we're going to have to be looking at. and as for the recusal report that you just heard, obviously that's really quite odd. i mean if he recused himself
