renato, i want to switch gears now and talk about paul manafort's trial.s a remarkable, the situation in the courtroom, the judge apologizing to jurors for his scolding of the prosecution's handling of an expert witness. i mean, it seems unusual to me, but how unusual is it to have a judge apologize to a jury? >> you know, it happens from time to time. i will say, look, i'm not going to defend the actions and words of this judge. he's obviously made some errors. he's done things that are improper. however, i will tell viewers at home that as somebody who's tried a lot of white-collar cases, myself, there are judges who make mistakes on a pretty regular basis. there are judges with strong opinions like this judge. and there are many judges who try to get the prosecution to move along. i had those judges, myself. what i will say is that, you know, a lot of the focus on the judge's words and actions is misplaced. you know, really there's a lot of evidence in this trial. the prosecution has a big lead. the defense is in a lot of trouble. the judge knows this a

also former federal prosecutor renato marriotti. you heard jessica say what prosecutors are laying out in their first hour of closing arguments. what do you think of their approach? had is. >> it is really textbook. when you have a lot of counts. what the jury is looking for as an answer is, is there the evidence to prove beyond a reasonable doubt each of what's called the elements of those crimes, each the specific components of the crimes that they need to find. what the prosecution is doing is methodically walking through that evidence, showing the jury that for each of those 18 counts they presented evidence of his guilt. they are keeping the focus on manafo manafort. as a prosecutor you stay laser focused on the defendant and what they did or say, that's usually talking about how the defendant lied because that's the key component of fraud, is that you are lying to get money. what the defense is going to do is they'll try to distract, talk about rick gates, they'll talk about all of the other people. what the prosecution's job

renato, you said rick gates was the most important gates in the manafort trial by far.here was an accountant in the last couple of days who testified. how damaging was his testimony today saying he lied at the direction of mr. manafort, and because the defense was going to bring it up, prosecutors wanted to get it out as quickly as possible from rick gates that he lied to manafort and stole from manafort and broke the law. >> well, very important testimony, anderson. there's no question that it was important. one of the key things that gates did is he said on the witness stand that he committed crimes along with paul manafort. i will tell you from my experience trying white collar cases, it is always very damaging to the defendant when a flipper, a cooperator like mr. gates takes the stand and says i committed crimes. so did that man, and here's how we did it together. so that's something very help to the prosecution. but as you point out, there is all of this baggage that comes along with gates. i think the defense's argument is going to be that if mr. gates was able t

it absolutely should never happen. >> renato, the defense counsel, then, he is experienced.e himself was in the department of justice for 15 years. is he behaving ethically by welcoming the president's comments on this? >> no, he absolutely is not there. is a rule, a rule 3.6 in most jurisdictions, including virginia that says that attorneys should not be making comments that could prejudice a jury in an ongoing trial. when you a defense attorney coming out and saying we really appreciate the fact that the president of the united states supports our client, of course that's something that's going to get covered. he should know better. and i would be surprised if judge ellis does not say something to him about that. judge ellis does not have power over the president. the president doesn't appear before him. but attorneys are held to a higher standard. i know that might surprise people at home. but we're actually hold the a higher ethical standard, and he should be response form those comments. >> we'll let that one hang out there. but jennifer, we know the president is certai

renato's right, that's going to be a tough part of the cross. >> jennifer, does this testimony make it less likely that manafort takes the stand? >> you know, it's hard to tell about a defendant testifying. in my experience defendants only take the stand when they're desperate, when it looks really bad for them and they think they have no chance of winning. i think that's probably the case here. but keep in mind that his testimony then opens him up to cross on a whole variety of topics including things that he doesn't testify about on direct. as long as they go to his credibility. he may not be willing to open that pandora's box given what the government knows about him. so it will be interesting to see. i still am guessing that he doesn't testify, though, given the risks. >> okay. shimon, this case as we've mentioned is not about the president's campaign or possible collusion with russia. these are very clearly financial crimes that happened that he's accused of and charged with, that happened before manafort joined the trump campaign, years before in some cases. how important is real

renato, what do you think is key from this fbi agent?t about the raid but it kind of seems investigators may be getting into the meat of their argument that manafort knowingly signed several kinds of false financial documents. >> well, those documents, the documents that they found in the search warrant, are going to be the basis of this prosecution. we can -- we talk a lot about -- you mentioned the lavish spending and so on. and that is very interesting and it catches attention. but what is going to prove his guilt beyond a reasonable doubt will be that evidence. that's what prosecutors are relying on. in a case like this, it is usually hundreds and hundreds of pages of financial documents. >> as they said, follow the money. it seems that's what they're starting with right now. the prosecutor's legal strategy is, as we heard from yesterday, manafort is a liar, he opened 30-plus bank accounts to hide his money. for the defense the strategy seems to be blame the other guy. blame manafort's long-time aide, rick gates. what do you think of
