the next question how much up side for the s&p 500? we have andrew thrasher. i have a chart of the s&p 500 and the along with 10-year yield. the 10-year yield is inverted. normally goes this way. it is easy to understand. here is your question. you have the 10-year yield right here, which is the blue line, but we got all the way to 4% and that was a pretty dramatic move last week, andrew. i think you were on vacation. also coincided now of course the yields are going down which is inverted here. the nasdaq getting hot again. is this what it is all about right now? is the market keep following these bond yields as a proxy? >> i think it is. we've been 2022 has been the year of the bond market. it has been the year of powell whether we liked it or not. whatever the fed is doing dictated how the markets responding. when ever we see round numbers in this 4% we're seeing the market respond to those. we're seeing bond bears take off. the move in the 10-year it has taken it back to the 20-day moving average. we're not seeing a break down. we look at the tlt popular bond etf, it is not rising back above the 20 day moving average. so we had a nice little recovery here but we need to start see short-term moving averages broken before we get, start expecting too much out of this tape. charles: right. is there a sense that 4% that could have been a blow off top? >> i, very well could be. if we start seeing, this is a big jobs week, if we start seeing some disappointment there. we saw the jolt reports, job openings, that is helping fuel the rally right now. we're starting to see fed funds easing back. maybe we don't get 75 basis points at the next fed meeting. that is what the market is keying off of, how aggressive will the fed be? a bad news is good news. disappointing labor market that slows the fed down. but breaking of labor market that will get powell to pause and slow these hikes. charles: we want to emphasize a lagging indicator a lot of folks point to. if that comes in, maybe saying to the fed you're going to aggressively like the jolts report this morning, certainly the pivot conversation comes back up again. speaking of proxies. you told us to watch apple. it has gone mostly straight down. the market is starting to break down because of it. pretty good day today. at what point we have this reverse it okay, maybe apple is okay, the broad market is okay? >> i call them the big four, apple, microsoft, tesla, amazon. they may not be at all times the four largest, the four individual stocks the market really keys off of. microsoft made lower lows. we have didn't see apple, amazon or tesla make lower lows. looking apple, the fact we saw return being somewhat after little bit of a safe haven, we were not seeing those key stocks get pounded harder like we saw in the individual market, the s&p 500, that shows us maybe we saw some exhaustive selling. charles: right. >> we're seeing that bounce. we're seeing same leadership going back to small caps that is starting to do really well. growth names are bouncing. tech, consumer discretionary. but we still have energy. energy continues to be a market leader. so we haven't seen new leadership take over, which is caric of a new bull market. we're seeing energy being the strongest sector, at least today. but yeah, apple the fact it didn't break that june low is a positive. charles: all right. next time you come, i'm hoping that this 50-day moving average thing is a little bit different. we don't have time to go through it. i like when you really walk us through, to say we can learn. i have to ask, are you getting dresses up for halloween? we're up over 2%. one of these days 90% of the stocks were up. i thought that was the very definition of strength? >> what is strange looking at 2% days, they are really uncommon. the whole bull market. 2013 to 2019, each had 0 to 4 2% days. we've had 15 just this year. in a bull market it is awesome. in a fragile, shaky market if shows how off things are. charles: if we were up 3%, more bullish, 1 1/2%, maybe more bullish but that 2% thing is really, it is intriguing that you follow it that closely. >> yeah. much nicer to see .5, .5, .3, .7, a bunch less than 1% days stringing together. that is what creates a bull market. low volatility, grinding returns higher. charles: less manic. >> exactly. charles: more orderly rally. >> exactly. charles: one thing you talk about a lot, a lot of folks talk about the vix, our audience is intrigued by it, volatility index, fear index, what you call it, two periods, 2,000, 2002 and 2007 to 2009. what is so interesting about that and how does it apply right now? >> what is fascinating about the two periods of long volatility. 20 year average is 20. years where the vix was over 20. it dampens overall valuations. investors are fearful. they don't want to pay the same pe. we don't want the vix to be above 20 all next year. charles: what about guests we have to get to 40 before capitulation, are you in that camp? >> i understand that lows in 2002 and 2009, the vix was 42 to 49. i see how they get there. the magic number is 36. charles: we almost hit that one time. >> march this year. that was the march lows. charles: the important we don't have duration, long period of vix up long period of time. kiss 40, come back down we could be off to the race. >> exactly. charles: another tweet i love you put up, because i think this is getting underreported, geopolitical developments around the world, it is amazing. the world really has gone haywire but the same token we had major rallies during wars. what are the keys you want to see resolved. >> you want uncertainty. give you fun fact, why the low 2002 october 9th. when congress approved military action in iraq. weed into what was happening in geopolitics. you don't need to see good news. you need resolution of news. charles: too many unanswered questions right now? >> exactly. charles: war in ukraine, north korea firing off rockets again. does iran deal play into that? >> anything that touches on oil prices is hugely important to the stock market. any country that produces oil, that is very important. charles: in this environment, atmosphere, what is an investor to do? do you sit on your hands? do you get some cash? what is the best way to make it through this period particularly if we get some things you're looking for during the fourth quarter, looking at fourth quarter rally? will there be more releases to that? she said no. there are no conversations about anymore releases from the strategic petroleum reserve as some analysts say, could see a price spike in the price of oil and gas when that leveling effect is no longer in the market. charles? $2 billion to reduce the highest tax rate which we would know probably raise revenue. $2 billion. the bond market goes haywire. charles: right. >> meanwhile do you know how much money the central governments of the oecd countries borrowed over the last two years? $21 trillion. so you have $21 trillion way up. tiny tax cut down here this will be the end of the world. this shows what a lot of international leaders want more government, more government. that is what the united nations wants. that is what the central banks want. one other quick point when the united nations we care so much about the poor. wait a minute the poor are victims of high inflation. charles: right. >> they get killed by inflation. charles: they're never going to get unpoor, just living day-to-day become as big struggle for them. steve, what do you, steve forbes, rather, what do you make then of what's happening just even here in this country right now? where are we going? >> the exact opposite of where we should be going. the early 1980s we learned stablize the dollar, have growth, tax cuts, deregulation, the u.s. booms and rest of the world imitates. 50 countries cutting taxes after we did. we had a global boom for 20 years. so they're doing the opposite. they're suppressing production, not only of energy, but they're raising taxes, that so-called anti-pro-anti-inflation bill which is pro-inflation because it cuts back the economy. charles: right. >> the federal reserve believes the only way you fight inflation is by creating recessions. they want people to be unemployed. so what do you think will happen when governments are working to suppress people from producing rather than encouraging them to produce? charles: you have a piece, steve moore, in the journal on costs on this war on energy that it is costing americans. give us that number. >> so we estimate because of what biden has done to shut down american oil and gas, as you know his first act as president what, killing keystone pipeline. charles: he probably did it. he proudly did it. i will destroy the oil and gas industry. >> we estimate, a study i did with casey mulligan, one of the top economists in the country, you know him, he estimates we would be producing $100 billion more gdp with oil and gas output if we had stuck with the trump plan. now, you were talking about the spr. we are the lowest level of the spr since the summer of 1984 when we started building it up in the first place. charles: right. >> we estimate we would be producing, ready for this? over that high. in the pacific northwest dives all the way down here and does that then you get another branch of the jet stream and a warmer one at that. this one comes underneath . so you got a low in southern california, one in arizona. now the another low these patterns last a while and we've been stuck in this pattern, but it does look like it's about to break down end of this week. look at the twenties. i mean 10.21, minneapolis, 24. chicago 35 nashville, 36. these are really cool temps for october. no doubt about it, but it does look like after body about the weekend. the pattern will become more progressive, which means it continues to move. instead of being locked in or blocked. we have a little low to the west southwest. it's just taking the same path almost as the one that they had over the weekend in southern california and arizona. so it stays south, but it spins in a lot of high end mid level clouds. and that's what we have over us right now, so that's giving us warmer lows for sure. a lot more fifties. we had more forties yesterday by far but high clouds warmer lows each day. though we are bumping up these temps a little bit tomorrow will be the warmest day. but built sooner than many other projects. one completed the long proposed $4 billion sites reservoir will hold enough water to feed the needs of five million homes a year or a half million acres of farmland. that's enough water to cover every square inch of san francisco 50 ft deep. currently there's a big gap between the supply of water in california and the demand for it. but if you close off this little gap and one just like it, you can easily create one of the largest reservoirs in all of california. huge naturally occurring ball was first identified by the california department of water resources back in the 19 fifties as a potential reservoir when it was contemplating the rapid growth of california. more than droughts, and not even that thought or inkling about something called climate change . jerry brown, no relation to the former governor says sites reservoir would increase northern california's reservoir water storage capacity by 15% with the water to be shared between the state's biggest water goals. it serves farms families. fish and fowl benefits would stretch from the northern central valley in bay area all the way to southern california. sites would get its water from the sacramento river, but water would only be taken in the rainy season and only when the water flow is very high when much of that overflow ends up going out to sea, in essence, it teleports water that comes to us naturally in the weather periods to the drier times when we need it, more water would be sent through 180 miles of canals westward to the sites project near maxwell. all but 12 miles of that already exists, saving enormous costs with our changing climate with our drought conditions extended drought periods whether wets drier dries. i think that the problems are becoming more serious and that that necessitates, you know, putting something like this into place. once constructed, it would take about five years in drier years to fill it, but in a super wet year, it could be done in just one winner. fewer than two dozen people live and what would be the sites reservoir valley some families here for many generations, while the land can be used for cattle grazing, many ranchers here actually truck their cattle to oregon to feed on green grass. there's pretty good support from from those folks that are really giving up a lot in order to make this possible for all the rest of us. the primary opposition to sites is from environmentalists who do not want to see high water flows diminished. final approval of funding sources. almost 900 million already approved by state voters. another billion from uncle sam and just over two billion from the waiting list of many participating local water agencies, cities and counties should be finalized by sal man suspected of killing five people in stock tonight and one person in oakland is due in court this afternoon to face murder charges. ktvu is amanda quintana live in our newsroom with new details about his criminal background. good morning, amanda. good morning when wesley brownlee was arrested early saturday morning , police say he was searching for another victim to kill, saying he was lurking around parks and dark areas, quote. out hunting. he even had a mask and a gun with him. he's accused of killing six people. five men shot and stopped in and one in oakland, is also linked to a shooting in stockton, where a woman survived, court records show. the 43 year old was born in san francisco but grew up in oakland. his criminal history dates back decades at age 14. he was accused of sexually assaulting a 14 year old girl along with two other boys later that year, records show he sold cocaine. chained to an undercover officer. then in 1995 , his older brother was shot and killed. a probation report says he became depressed. his mother said she wanted him in therapy and described him as mentally slow and learning disabled. brownlee never graduated high school when he was 18. he was sentenced to two years in prison for having a large amount of cocaine. once out, he was living with his mother in stockton's, but in 2014, he was accused again in alameda county of selling cocaine. he served some jail time and three years of probation, and the killings began a few years later. the suspects reign of terror and our community has come to an end. we are sure we stopped another killing. investigators say all of the killings are linked through ballistics, and they're confident brownlee is responsible based on tips and surveillance video. we've learned that some of those tips had to do with the way he walks and that was also caught on camera. police are still looking for a motive. they say they're racking their brains to figure out why he would do this. he's currently in the san joaquin county jail and due in court today at 1 30 this afternoon. we'll have updates from that hearing on our afternoon newscast and on ktvu dot com. live in the newsroom. amanda quintana ktvu fax tunis. thank you. time is 5 33 more details about two illegal pop up gambling casinos in the south bank. last week, san jose police raided two casinos. one was on capitol avenue. the other was on march and drive. seven people were arrested. authorities say one of the people arrested had a gun. the accused operators of the casinos were also among those arrested. the police say one of the suspects stabbed a homeless man, and that attracted the attention of people nearby. complaints from residents and neighbors in the area. like i said one of the things that was brought to our attention during this investigation was a stabbing that happened. police called the casinos dan's of criminal activity. several large trucks were used to haul away the machines and gambling materials witness stood by his previous testimony in the trial that led to the conviction of former theranos ceo elizabeth holmes, former lab director dr adam rosen. dorf appeared in court yesterday and said quote holmes needs to pay her debt to society. holmes attorneys claim that rosen dorf expressed remorse and possibly committed misconduct after he showed up at her house back in august. feeling bad about her possible fate. now the defense team has requested a retrial. with everything that the doctor testified to. unless the judge wasn't listening. there is no way she will be granted a new trial. rosen dorf admitted to having a brief conversation with homes husband at her home. he said he didn't want the children growing up without a mother and believes that homes may be pregnant again. holmes pursuit, died when his pickup truck was hit by another driver trying to get away from police ali a terrible situation. police are not identifying the victim. but friends and family say augustine toyota was driving that red truck to work early yesterday. morning now. at the same time, oakland police work chasing a silver honda near 69th in san leandro street. the suspect's car trashed into the truck, killing the driver. neighbors say they heard a loud bang, and then the truck's horn started blaring as the victim's body was leaning on the steering wheel. what what we up? i'm like, what the heck did somebody doesn't hit my door or something? police have identified the honda driver as 23 year old jonathan hernandez, a patrol car tried to get him to pull over, but he wouldn't stop. police say they requested permission and got it from supervisors to continue pursuing that honda after the crash. hernandez was arrested and police say he did have a gun . he now faces charges of vehicular manslaughter, evading police as well as gun violations. neighbors say that doesn't help their friend who died. and they believe police need stricter rules about when to end a pursuit. a lot of kids in the neighborhood, so it's like dangerous for the kids and the people in the finger citizens that's around here when the police are doing high speed chases if they are coming in tourism, dental areas they need to cut the chase off. the victim . innocent victims who died, relatives told us there are too upset to talk on camera. but privately they did tell us he was a hardworking, generous person. he had a lot of positive energy and will be missed by everyone who knew him. the officers involved in yesterday's pursuit are on administrative leave while the crash is being investigated. david pam putting more license this plate readers around oakland would dramatically increase the ability of the police to solve violent crimes, but critics worry about privacy concerns. last month, the oakland checks on people who want to buy guns. the researchers wanted to use that information to study the effectiveness of gun violence, restraining orders. homicide detectives in contra costa county have reservoir in northern california. it's the sites reservoir, it would be just west of colusa in sacramento valley and would hold enough water to meet the needs of five million homes a year or a half million acres of farmland. it serves farms, families, fish and fowl. in essence, it teleports water that comes to us naturally in the weather periods to the drier times when we need it more now the sites reservoir would increase northern california's reservoir water storage capacity by an estimated 15% project managers say the state has to be prepared for more dry winters in the years to come. with our changing climate with our drought conditions extended drought periods whether wets drier dries. i think that the problems are becoming more serious and that that necessitates, you know, putting something like this into place now, construction work on the reservoir would begin in the year. 2025 is scheduled to be completed six years later. alright 6. 18 is the time back over to south
