jeanette reyes is outside the courthouse in norristown with more. good morning, jennette. >> reporter: good morning, tam, i was here when we got news that the jury was deadlocked and that the judge was sending them back to resume deliberations and everyone here was stunned. just to give you an idea how long this is taking this is day five of deliberations over 40 hours, now, just about as long as the trial itself from opening statements to closing arguments, as long as that took you cannot overestimate how exhausted this jury is. day four of deliberations seemed to drag on after the jury told the judge they were deadlocked couldn't reach a unanimous decision on any of the charges. the judge said it was their duty to try their best to reach a verdict and try again. as deliberations approached 40 hours, the judge told the jury of seven men and five women you are exhausted, deliberations should be done with a fresh minds and body, around 9:00 p.m., a fatigued jury was sent back to their hotel. the famed comedian spokesperson pushed for a mistrial. >> i

jeanette reyes joins us with the lightest developments. >> reporter: rick, deliberations are underway right now. they are deliberating now for more than 40 hours. just to give you an idea how long this has taken it threatens the deliberations phase threatens to be longer than the testimony and arguments phase of the trial. the jury is exhausted there is no doubt about that but trying to give this their best. they started off the day with a question, perhaps the most telling and indicative of what may be going on behind closed doors. >> this morning. the jury was brought in for another grueling day of deliberations. bill cosby arrived in a black suv a half hour early as usual. and the comedian looked worn out for another day of simply waiting. the jury asked a seven and question, this with two parts. this likely part of the battle with the jurors. they wanted to hear the 2005 testimony he then admitted to giving andrea constand benadryl pills. >> the second goes to the heart of the case the jury wanted the judge to define reasonable doubt. and they rejoined deliberations an hour later.

"action news" reporter, jeanette reyes is live at police headquarters with details. good morning, jennette. >> reporter: good morning, tam, the only teen victim in the shooting died from his injuries hours ago after being shot in a hail of gunfire. he is one of two victims to die overnight. the shots broke out along the 1300 block of west rush street. two shooters approached their victims on bicycles and fired over two dozen times at close range. police arrived on the scene to find two men on the ground with shots to their torso and surrounded by shell casings. one victim was in his 20s and the other 17 years old. they found a third victim. >> reporter: while investigating the scene a 20-year-old man showed up at temple hospital. he was shot in the arm, he is in stable condition. >> reporter: now, police have no motive or suspect at this hour, but they have a little to go off of, they have witnesses and they are looking at surveillance videos police cameras and residential cameras that they are reviewing hopefully that will lead them to their killers. jeanette reyes
