the rfp, by virtue of just being the bulkhead did not extend to the entirety of pier 38, the rfp acknowledged the proposed project would be relatively small in scale, but would require substantial investment to rehab the building in order to amortize the capital investment. we knew from the outset this would be a very challenging project. the port received two responses to the rfp. both responses proposed a similar use program and lease term. both responses proposed a 20-25 year lease term and this is unlike other lease improvements that can be performed within a ten-year interim lease framework. and it's also different from doing the entire pier structure which would necessitate a pier sigh mike upgrade of the pier which would require substantial investment and a 66-year term. ~ seismic so in between this is a kind of unique and hybrid project and we just made this project particularly challenging. ~ and which has made in december 2013 nearly a year ago, the port awarded abopportunity to tmg pier 38 partners which is a partnership between tmg as well as with premiere structures which is an l

, you know you have got, i think three responses to the rfp. and at that point, this actually did not come before the board. because it was under $10 million. had it had the scope actually included the added new scope that is included here, it clearly would have come before the board of supervisors for approval because it would have, you know, gone past the ten million dollar threshold, the problem that i have is when you change the scope to this magnitude, it is never really clear if you are actually getting the best deal for the tax payer, because if the rfp had done with the proper scope to begin with, it may be that maybe somebody else could have given you a better deal, and so that is the problem that i have and when you have 26 different amendments, in a three year, or in a contract for a three year term, i mean that is pretty significant and so, i dent know, i definitely have questions, and i know that there is another item but i want to make sure that if there is any other questions about this my colleagues get to ask them. >> why don't

and then rfps go out and we realized that we have procured two different types of vehicles that doesn't allow for the greatest flexibility moving into the future. i'm not saying it's not possible for us to move down that pathway for us to have two different types of vehicles. and there are clearly ways to make that work in the three stations that we have identified that both high-speed rail and caltrain would be stopping at, millbrae and san josÉ and san francisco. but i think there is certainly a lot of different factors that will make this a more challenging system into the long-term, while more affordable in the short-term for both -- for at least caltrain. it seems like there would be additional costs for high-speed rail, if they were to build additional tracks in those two stations. so i think from our perspective, we're just realizing that we're getting to the point that we have to start the procurement process and we want to make sure we can open the conversation, as much as we can to seeing what all of our options are. >> i appreciate that perspective. i just want to add to it t
