our legal guys are back with us, avery friedman in pittsburgh, richard herman in las vegas. can tackle this one. nfl commissioner roger goodell suspended the players in a scheme that paid players for injuring opponents. the coaches and a gm who were suspended remain out of the game. so because this was a collective bargaining process, it puts the players' louts up against the commissioner on hold. okay, richard, this is very complicated. . how did this come to be that the suspensions were overturned by this arbitration or appeals panel? >> because the players were allowed, pursuant to the collective bargaining agreement to take this level of appeal and the arbitrators ruled that the commissioner exceeded his authority. he did not have the power to be judge, jury and executionary, which is what he was in this case, and he got spanked, and he got sacked, clearly, fred, and these players are going to -- vilma will be on the field this weekend if he's physically healthy enough. >> apparently he's injured and may not but will smith, the defensive end apparently might, right? be a

avery friedman in cleveland, richard herman in las vegas.en, this convicted killer, ronald post, weighs 480 pounds and he has tried to lose more. but at 53, he says, you know what, it's not just an issue of his weig but that his veins are not good enough for lethal injection and that would constitute a complicated process which would lead to cruel and unusual punishment. so, avery, what are the options here? >> well, you know, it's interesting that the opinions about this have been thermonuclear. everybody says, well, he shot this lady so we should shoot him. but under the constitution, that isn't how we do these things. the fact is that there are legitimate arguments which u.s. district judge leslie wells who has the case has to decide based on science. but to me what's really intriguing here, really intriguing -- and i haven't seen any opinion on this -- is that the prison officials had to know, fredricka. this was coming. this was coming. >> really? >> why in the world didn't they just do a quick gastro bypass, which, by the way he asked

our legal guys are back, avery freeman in cleveland, richard herman in las vegas. two different states, massachusetts and new york, both handling them rather differently. in massachusetts, a court ruled in favor of the baristas and starbucks is now appealing. then in the case of new york, a federal court dismissed the case, finding that shift supervisors can participate in a tip pool under new york law. so, richard, we're really talking about what the law is -- what -- what law is already established in varying states as to how they're going to handle this plea that all share teir tips. >> exactly. who knew, fred, when you bought that $10 latte, that that little plastic tip box generates such great wealth that everyone cease going to fight and want a piece of that. but apparently, the managerial staff at starbucks wants to share with the baristas. the new york court reasoned, listen, these are managers. they're on full-time salaries. they get benefits, they get health care, they get sick pay, sick leave. i mean, it's not like a typical employee working part-time wh

all right, we talked to our expert, richard herman, a criminal defense attorney and law professor inas. and earlier i talked to them about a lawsuit involving the hooter's restaurant chain. now in queens, apparently a couple, korean-american couple was at this hooters, and they received their receipt. and an employee had scrawled an ethnic slur, they read it. and one of those customers is actually suing hooters, saying a, they were insulted. this is discrimination, and how could this be? that worker has since left hooters, so apparently is no longer working there. but the question is, is an employer responsible for the actions of its employees, whether they're still there or whether they have left? richard? >> well, an employee -- an employer is always responsible for the actions of its employees, fred, however, this case really -- if you want to open up the garbage can and throw it in there, this is the case to throw in there right now. i mean, this gentleman, this individual says he was humiliated, humiliated, and unable, now to go into any non-asian restaurant because some 20-year

. >> and richard herman, criminal defense attorney and professor joining us from las vegas joining usll. >> the school district cannot block these cheerleaders from using these banners with the bible verses, but isn't this an issue of church and state? >> yeah, that's a hometown ruling -- yeah, that's a hometown rule by a local judge that wants to get re-elected and has no bearing in law. the judge is flat out wrong. the united states supreme court has spoken on this back in the year 2000, santa fe v. john doe. you cannot give the impression that a public school is sponsoring prayer or religion. you just can't do it. that's how it is. it's open and shut, black and white. the school is going to shut down and they're not going to be allowed to do that. you want to bring posters in the stands, you can do that. but the students can't lead the charge and that's what's going to be stopped here. >> avery, why do you see this as laughable and what is this hearing all about then? >> well, what's laughable is that you got it exactly right. the amazing thing about this -- >> you're in agreement.
