kasie hunt, couple of things to get to before you go. what's the deal with senator richardurr, having his cell phone taken by the fbi last night? >> reporter: nbc news just confirmed this "los angeles times" scoop. our pete williams reporting via law enforcement official that the fbi seized richard burr's cell phone. they obtained a search warrant for it and took it from him. in the course of their investigation into his stock trading, we had learned a few months ago, that burr made some very fortuitously timed stock sales that were right before the coronavirus pandemic really hit the u.s. between about 600,0$600,000 and million worth. it is hard to know the number because of the way the reporting works for these disclosures. most of the stock he sold then dropped precipitously. this raised questions, obviously, in his role as the senate intelligence committee chairman. he is privy to a lot of non-public information. not just more than you and i in the public, but also more information than most members of congress. he is part of the gang of eight that receives special brie

capitol hill correspondent kasie hunt and obviously, that very specific denial from kelly loeffler does leave an opening there, and i guess there's been a question here. is richardder a criminal investigation? >> reporter: chuck, you know, honestly, i defer to pete williams and our legal team on exactly how this would be characterized, but probable cause to get a search warrant seems to suggest that that's the track they're on. now, it would be really tricky to prove something like this in burr's case. the insider trading laws are written in such a way that they apply pretty much only to specific stock trades, so if you know something about a particular company's future and you make a decision based on information not available to the public, you can get yourself in trouble. now, senator burr asserts through his lawyer that he made these decisions based on public information, watching cnbc, reading the news about what was unfolding in china, and that's how he made these decisions, and presumably, the fbi is looking for information on his phone that could either confirm or contradict those claims that burr is making, because of course, you can get ensnared in oth

hunt and pete williams. i want to thank dr. patel and ramirez. going on to more breaking news today, and there's a lot of it, senate majority leader mitch mcconnell just announced senator leader richard burr has tentatively been asked to step down as chair of the intelligence committee effectively tomorrow after the fbi seized burr's phone wednesday, part of an investigation into possible insider trading. a federal authority is looking into whether senator burr used information as a so-called gang of eight, eight top congressional leaders who received the most secret intelligence, whether he did that to sell off stocks before the market plummeted, before most people were widely aware of the risks of growing covid-19 pandemic. in march senator burr's attorney released a statement saying in part, quote, the law is clear that any american, including a senator, may participate in the stock market based on public information that senator burr did. when this issue arose, senator burr immediately asked the senate ethics committee to conduct a complete review. so now to nbc's justice correspondent pete williams and, of course, our kasie hunt, host of "kasie dc." pete, what is the legal situa

hunt and justice correspondent pete williams. pete, i want to start with the seizing of this phone with richard burr versus what kasie has been reporting about, the back and forth with dianne feinstein. did they have to issue a search warrant because richard burr was not cooperating? is this the implication or is this -- does this come across as standard procedure? >> well, more the latter than the former, i think. we haven't gotten the details about why the government chose to get a search warrant. what we're told, it was served on one of the -- burr's lawyers who then notified the senator the fbi was coming to get his phone and went to his house last night. you're looking at video of him today on the hill. this is where he said he thought it was a distraction for him to stay on the committee as the committee chairman. but he wouldn't answer any specific questions about whether the fbi took his phone. he said it's their investigation. i don't want to talk about it. but in order to get a search warrant you have to show that there is -- you have to go to a judge and say that there's probable cause to believe that the thing you want coul
