martha: rick leventhal is on the scene. rick, what are we learn being what happened here? >> reporter: the "new york post" is reporting the engineer said he zoned out before the crash. but tmz is reporting the engineer said he fell asleep in the minutes before the train crashed. when he woke up it was too late to stop the train from hurtling off the tracks. he did not cut the brakes until 6 seconds before the derailment. and it was too late. it killed four people and injured 3. there are still three critical as of last night. >> the preliminary information from the event recorders shows the train was traveling approximately 82 miles an hour as it went into a 30-mile-an-hour curve. >> reporter: rockefeller, the engineer was take from the scene on a stretcher. he was released from the hospital yesterday. he was tested for drugs and alcohol and his cell phone was koon fist skate. they have seen ad his phone record. and it appears he may have dozed off before this crash. martha: the ntsb is not the only agency investigating this, right? >> there are two police agencies conduct

rick leventhal live in our new york city newsroom with more. rick, what went wrong?rter: well, leland as you said according to ups the company's delivery system was overwhelmed by up credible demand. too many boxes and not enough planes. and since pilots are not driving and drivers at wheel on the job, there will be frowns at the tree. probably already were this morning. if you haven't gotten a gift dropped on your doorstep by now, it will not make it until tomorrow at the earliest. according to a company spokesperson said demand was much greater than forecast this year. in a statement posted on its website united farce sell service says, ups understands the importance of your holiday shipments. ups is experiencing heavy holiday volume and making every effort to get packages to their destination however the volume of air packages in the system exceeded the capacity of our network immediately preceding christmas so some shipments were delayed. ups is not making pickups or delivery on christmas day and will resume normally scheduled service on december 26th. have faith

rick leventhal joins us now live. rick what amazing exit interview to have. is it going to be tough for this guy who has protected and served for so long to step down? >> reporter: apparently not, leland. he is ready for a good night's sleep and first vacation in 12 years. being a top cop is 24/7 job. ray kelly has been commissioner of new york city police department longer than anyone else. this past year was particularly controversial with protests and lawsuits with the nypd "stop-and-frisk" policy which gives cops more leeway to "stop-and-frisk" people. kelly says it took thousands of guns off the street and potentially saving thousands of lives, making new york the safest big city in america. >> you've got really record-breaking reductions in crime, particularly violent crime. last year we had a record low in shootings and murders. this year about 20% below that. we're at a figure of murders that haven't seen since eisenhower was president. and even then they were not as accurately measured as they are. >> reporter: kelly is being replaced by bill bratton

rick leventhal is here with more on this. s to toughen gun laws, and they have been met with very mixed results. >> reporter: that's true, martha. soon after the tragedy, president obama called on congress to strengthen background checks and restrict access to assault weapons. that failed. and the vast majority of bills proposed at the state level were rejected. in fact, gun owners in general have more freedoms today than they did before sanity hook. more than 1500 new gun laws have been proposed across the country since newtown, less than 10 percent of them passed. and of those 115 new laws, only 41 are considered tougher, 74 loosen restrictions, for example, allowing guns in some churches, bars or schools. the law center to prevent gun violence and the brady campaign gives most states failing grades. california and the new orleans east were given -- northeast were given the best marks, and the group says progress is being made, but gun advocates continue to fight back. >> wherever you tell people you can't protect yourself,
