rick leventhal, we thank you for your report and we'll check with you throughout the morning as news warrant. we're grateful for your time, rick, thank you so much. >> thank you. >> leland has more. david: with that we'll bring in our own gregg jarrett, attorney and anchor on fox news channel monitoring as the case went on and now it's been breaking the past 40 or so minute as a hung jury in pennsylvania in the bill cosby sexual assault case. gregg, what's interesting about this, there's a difference between it sound like somebody did it and proving beyond a reasonable doubt. what did the prosecutors have to prove? what was the defense's possibilities for creating reasonable doubt in the jury's mind? >> well, for the defense, it's that the accuser, andrea constand continued to be with bill cosby after she was allegedly sexually assaulted. and the defense says that's not the behavior of somebody who had a crime against them. this only underscores that they had an affair and that it was longstanding and consensual. so that was something, really, that the defense made a big issue of and

rick leventhal is live outside the courthouse and will be joining us, hi, rick. >> this was the longest jury deliberation outside of this courthouse, longer than the trial itself. despite 53 hours of questions and debate, seven men and five women bussed in from pittsburgh to sit on this jury could not agree on guilty or innocence of bill cosby on any of the charges against him. mr. cosby did not celebrate in the courthouse when the mistrial was announced. this is not over for the comedian mo turns 80 next month. the prosecutor says he'll move forward quickly as possible sometime in the next 120 days. >> she is entitled to a verdict in this case, and the citizens of montgomery county are entitled to a verdict in this case and we will push forward to try to get that done and get justice done. >> those three counts of aggravated indecent assault were filed against bill cosby after andrea constand went to authorities and convinced them that bill cosby gave her drugs in the home and knocked her out and a

rick leventhal has more. what do you have, rick?> bill, things have calmed down the last couple hours. when news first broke that the jury had dead locked on the charges, things got crazy on the courthouse steps, even circus-like with supporters of bill cosby waving signs to free him. we heard from one of the dozens of women who have come forward claiming the comedian drugged and raped them. a woman named lilly bernard. she confronted a group of cosby supporters out on the courthouse steps. >> i loved bill cosby, too. i thought he loved me, too. he often told me that i was one of his kids, that he loved me like a daughter. i trusted him. understand? when he gained my total trust and saw that i adored him, he prayed upon me and drugged me and raped me against my will. >> bernard said cosby threatened her and her boyfriend to sue them. so no charges were filed in that case. this case is unresolved so far. >> bill: what happens now, rick? >> the jury is back in the jury room resuming deliberations. the jurors did say they were dead loc

rick leventhal picks the story up from there. he is running as live from the courthouse in pennsylvania. have we heard from the jury yet rick? >> not yet julie. we certainly hope to. and so does the da.they want to know how many men and women believe that bill cosby was guilty and how many believe that he was not and why. that answer is very important to the das he considers every trial. the jury deliberated for more hours than the trial itself. the interrupted deliberations a dozen times of questions including for the definition of reasonable doubt. and the definition of it without her knowledge. they also asked for effects of testimony from police and the victim's mother, both cosby and his accuser,? this is now 79-year-old comedian drugged her and sexually assaulted her in 2004. in the end this was a case of he said she said. there was no agreement on which of the two is telling the truth. >> the judge is right. justice is real lives here in montgomery county. i am proud to have been able to represent mr. cosby. we came here l

standby, we are going to go to rick leventhal who is outside the courthouse in pennsylvania with the latest. what can you tell us? >> not surprising, this jury has been added for 6 days, more than 62 hours of deliberations. they told the judge thursday morning they were deadlocked and the judge ordered them back to work. they enter deliberations, numerous testimony, and the alleged victims of interviews with police officers, and police officer testimony, on and on throughout the week, 52 hours, the previous record for jury deliberation at the montgomery county courthouse is 14 hours so clearly taking a long time to come up with some kind of verdict and we were hearing from sources in the courthouse that there were one or two holdouts, presumably people would not render a guilty verdict on indecent assault charges, and come over the verdict and told the judge they no longer

rick leventhal's been doing a great job covering this from the courthouse in norristown, pennsylvaniains us once again. you know, rick, i guess the deliberation lasted longer than the trial itself, right? >> reporter: it did, indeed. apparently setting a record here, gregg, thank you. this was, in fact, a significant disappointment for the prosecutors and for the accuser, andrea constand, and for the victims, other alleged victims of sexual assault who have been coming to this courthouse every day of the two weeks of the trial and deliberations. we have heard some cautious optimism from the d.a.'s office as well which will retry this case, and we've gotten a statement from andrea constand's civil attorney which reads in part: we are confident these proceedings have given a voice to the many victims who felt powerless and silenced. we commend the prosecutors who raised awarenesses, the effect drug has on the victim's memory and ability to recall, and and we're nonetheless willing to represent -- and we're, nonetheless, willing to present this evidence to the jury. >> obviously, you kno
