that, apparently, was not good enough for governor rick perry, and this is where we take the turn toward tonight's felony indictment of governor perry. last summer, the "austin american-statesman" newspaper reported that texas state officials were warning rosemary lehmberg that if she did not resign as d.a., governor perry was going to strip the public integrity unit of its funding. he was going to veto funding for that unit in his office unless miss hemberg stepped down. and the reaction in texas was, some of this is about rosemary lehmberg's drunk driving thing, but some of it felt more like some familiar politics. texas is a red state, but that public integrity office for all state officials is in the office of a district attorney elected by a democratic county. and texas republicans have long hated that. they have tried many times in the past to defund that office, to get this public integrity office with this democratic d.a. off their back. texas republicans never succeeded before at defunding that office, but then, the d.a. who runs that office. well, she got herself this dui. oppo

governor rick perry down in texas indicted. what is that going to mean for his interest in running for president? >> it doesn't ever help to have the association indicted two years before a presidential election, barbara. it's very possible that rick perry's just been indicted, that doesn't mean that he's been -- that doesn't mean that he's been convicted of anything yet. we've seen politicians time and time again end up getting indicted, but then a jury saying they were innocent. but the problem that rick perry has is the process is going to take a very long time. months if not a year. and -- and if -- if the process takes a year, come august of 2015, the presidential election will pretty much have already been waged. the iowa caucuses and new hampshire primary would be months away. and that -- that's what's troubling for rick perry. >> a lot of his supporters were saying, of course, this has happened in travis county, austin, texas. the midwest democratic of all counties in -- in the state of texas. they think maybe that will

if you're rick perry what you will hear from the rick perry personally and from his team is of course this is all politics. when he was up in new hampshire, today, he said the travis county grand jury, which indicted him, they are the blew bare in the toe mate -- the blueberry in the tomato soup. very blue democratic in red texas. we've seen this before. there's no there there. gwen: good point. >> the point being there. if you look at this, though, from just a legal standpoint, you say, well, and political standpoint, you say, first of all, he's only the second governor who's been indicted in 100 years. so this is not something that's done lightly. and that at its core, what he's accused of is abusing the official capacity and coercion of a public servant. so let's step back and say what did they accuse him of? back in 2013, the travis county d.a., this is austin, she's a democrat. she was arrested for drunk driving. there is video of this. very powerful video. she is not just a little bit tipsy. she is three times the legal limit. she's belligerent with the officers. he says to her,

i think that the next two days, next few days will be really tough for rick perry. he's going to be booked, fingerprinted, and have his mug shot. these are not in a presidential playbook. >> hold on to that point. angela, here's the big question. governor rick perfect riff becomes the first governor indicted in tex it tex since 1917. the governor's private attorney responds this way, basically, stating i am outraged and appalled that the grand jury has taken this action, given the governor's constitutional right and duty to street toe funding as he deems inappropriate. so is this political theater, angela, or did the governor abuse his power? >> this is political theater, but it's a pr nightmare. if i were the governor's strategist, i would have had him meet with the d.a. privately. kelly, this is a district county. travis county reelected this lady by 74.4% of the vote. she's very popular. why have a public war with the d.a.? now, as the commander in chief, would i want a d.a. to break the law while prosecuting the law? no. but there was a better way to handle this.

this was a defiant rick perry.he got up on that stage at heritage, which of course was a very friendly crowd. and the first thing he tackled as soon as he walked up there was this indictment. he was defiant about it. he almost seemed to be enjoying it. and then he went on to make a speech that was primarily about iraq and syria. he warned that isis terrorists could already be coming across the mexican border. he said america should be much more aggressive in iraq than the obama administration is being. he left open the possibility of troops on the ground. i think what you're really seeing is a rick perry who is trying to take advantage of this moment to sort of energize the base, get people to feel defensive of him as he sort of step by step rolls out a potential 2016 campaign. he's in new hampshire today. he's going to be in south carolina next week. his aggies are playing down in south carolina. he's going to go to the game. so i think what you're seeing is somebody who's really trying to take advantage of this m

potential republican presidential candidate rick perry is fighting a felony indictment alleging he misusedwer as texas governor. that's never a big plus on the campaign trail but can perry make it work for him. i'm joined by someone who has been there before, former house republican leader tom delay. quite familiar with both politics as well as the texas justice system. congressman, thanks for joining me. is it possible for governor rick perry to fight these charges and still keep the light, a positive light on a presidential campaign? >> well, it's going to be difficult, candy. that's for sure. especially in raising money. people that may want to give him money will wait until this is over to give him the money or they may go somewhere else, another candidate. it all depends over the next few weeks, the judge could throw this out as frivolous, which it is and the prosecutor not appeal it and then it would be over. but all of those decisions are going to be made in the next 30 to 60 days, and we'll just have to see. mine went nine years. >> still ongoing. i know that appeal overturned your
