flipside, you saw the man on the court, particularly chief justice john roberts, justice scalia, to a lesser degree justice anthony kennedy, much much harder on the obama solicitor general who was trying to defend the contraception mandate. it broke down almost perfectly on gender lines. host: talk about the questions the justices had to face and what decision do they have to make about hobby lobby and conestoga? guest: they have to make a determination that these two religious employers of for-profit corporations are either people are not people for purposes of the religious freedom provisions in the constitution and the first amendment and under the religious freedom restoration act. a lot of the questions were predictable. how do they exercise religion, corporations? a lot of questions were pressing on the future implications, the slippery slope problem. you had justice kagan and soto mayor pressing paul clement saying, if you're going to grant religious exemptions to employers over birth control what about blood transfusions? what about vaccines? what about civil rights statutes? is this going to allow employers to sw

justice roberts will be concerned about the way it potentially goes against fundamental principles of corporate law that separate the owners from the corporate entity itself. i think justice kennedy hobby lobby's owners to impose their own religious beliefs on their employees. americans don't give p religious beliefs when they sign up to go for a craft store or wood maker. those employees might have different beliefs from their employers and justices, like justice scalia, who care about the original meeting of the constitution, will find a problem with the fact it's hard to square hobby lobby's vision with the first amendment with the way it's been practiced for the last more than 2000 years. >> does this equate to hobby lobby forcing its employees to share religious beliefs of the owners of the company? >> absolutely not. hobby lobby's employees are free to make their own decision and nothing about this case is going to change this. the simple question is will this be paid for by hobby lobby and the green family or is this something the employees are responsible for on their own? the government has already exempted more than one third of employer health plans from the con ttrace

roberts and alito seemed to accept the idea of personhood. citizens united meanwhile justi justice briar remained quiet and clarence said nothing. once again, the decisive vote likely to fall on justice anthony kennedy. the court is expected to reach a decision in late june. joining me from washington the elise hogue and in los angeles, california state senate candidate. you were in the courtroom today and there seemed to be two issues here. one is whether corporations do the, are entitled to religious freedoms as protected in the u.s. constitution and the second is whether the contraception mandate represents some sort of burden. on the second point, i'm curious to know what you thought of the arguments because at one point from what i understand, hobby lobby actually offered its employees a plan that would have covered the very thing they are saying is an undue burden, coverage of plan b pill. what did you think of the argument on that point in particular? >> i mean, let me start by saying thank goodness for justices ginsburg, sotomayor and kagan. i cannot imagine what it must have been like before we had any kind of gender representation on the board because they were the only ones who are actual
