reporter: police say the delivery man was inside robert martin's apartment, he told police he thought martin was drunk and while the driver waited for him to sign the receipt, martin grabbed a shotgun and began walking toward him, pointing it in his direction. >> he was obviously very concerned at that point, then the man says you want to hold hold it. and this guy says hey i just here. reporter: that's when police say par tin sat in a chair and racked the gun. court paperwork says he never took his eyes off the delivery man. oddly, he then signed the sales receipt. >> i think he was traumatized at that point and not sure what was going on. he exited out of there and immediately called police. reporter: police surrounded his apartment and court paperwork says martin's landlord was able to get him to come outside. and dallas pizza where the delivery man worked, another and is still shaken up. >> certainly aggravate the situation. i don't know what advice i could give in that situation. seems as if he kept his cool and was able to get himself out of there, and get out of there unscathed
