the court has denied a state house committee attempt to delay robert roberson's execution. conviction more than 20 years ago was based on allegations of shaken baby syndrome, and has gotten a lot of attention. but his attorneys argue that diagnosis has been discredited. i'm going to bring in cnn's ed lavandera. what more can you tell us, ed? >> reporter: well, this is a development that has been several weeks in the making. you'll remember that back in october, the day before robert roberson was scheduled to be executed, a state house committee issued a subpoena for him to testify in front of the legislature. and that subpoena date was set for after the execution date, so that move there halted in a very dramatic last- minute situation the execution of robert roberson back in october. and that set off a legal fight between the legislative branch and the executive branch here in the state of texas, which was essentially what the supreme court here in the state was looking at. and the state supreme court essentially ruled that the state house committee couldn't block the exec

roberson. the shooting happenelast tuesday on hollister avenue near bret hart elementary school and the city's bayview neighborhood. police say roberts and shot the victimhile she was at home with her daughter and other oplerobertson was arrested earlier this week in daly city. he's now facing several charges, including 2 counts of attempted homicide. san francisco, rather, san jose police arrested 4 people connected to separate homicide investigations. the most recent arrest happened last week for a deadly shooting in may. 46 year-old josef martinez is accused of shooting a man inside a homeless encampment. mclaughlin avenue and 2.80, the victim died at hospital days later. martinez was serving time in reno for an unrelated crime. last month he was booked into santa clara county jail for suspicion of murder earlier this month, 2 men and 17 year-old were arrested for a deadly shooting in october. a man was shot and killed on south second street. police say they found this rifle at the scene which led to the arrest of 19 year-old adam, do. eighteen-year-old brian medina and the 17 year-old who is not being named because of their age.
