pat roberts. who against a competent tea party style opponent might have had a bad time. he had that guy instead, he got banged up statewide over the question of his residency. that's the charge that tends to stick with kansas voters. he's not really been popular in kansas. even with the x-ray freak show guy as his opponent, pat roberts only beat that guy in the primary 48 to 41 points. he did beat him, though, and in the general election, senator roberts has had the double blessing of running in a three-way race in the general election. he's been polling in this ppp poll at 32%. he's the incumbent, right? 32%, that's not good. that's almost a synonym for vulnerable. luckily for him, it's a three-way race, the democrat and independent in the race, really split the remainder of the vote, pat robert the by virtue of that was still in this thing. looking like he was a winner because that democrat and independent running against him were really screwing up anybody else's chances. that was the lay of t

of john roberts. i suspect for many of you, at least of a certain generation, you remember where you were when president kennedy was shot, i think for many of us who are supreme court lawyers, we remember where we were when we heard the very sad news that william rehnquist, the previous chief justice of the united states had passed away, i was actually watching college football at my parents house when they broke into the football game with the news that the chief justice had passed away, and for all of us, in many ways it feels like it was just yesterday and yet it was now more than nine years ago. john roberts had of course already been nominated to join the supreme court as a replacement for sandra day o'connor who had retired but president bush promptly turned afternoon a around and renominated him to become the chief justice. i thought we would start with some observations about the roberts supreme court, we'll talk about the term that ended in june before we transition into what will be the upco

pat roberts had a tough primary against a tea party guy but he survived it.licans after that primary thought senator roberts' seat in kansas was basically a safe one, one they could preemptively put in their win column as they tried to find six other seats to try to take over the senate for the last two years of the obama presidency. part of the reason kansas looked safe for republicans is because it's freaking kansas. they're so red they voted for mitt romney by 22 points. in 2012. they're so red, kansas hasn't sent a democrat to the senate since 1932. but more immediately, this year, incumbent republican senator pat roberts has had this great luxury this year of running against two people at once, two people splitting the vote against him. with a popular and well-financed independent taking as much of the vote as the democratic candidate was. republican pat roberts was going to cruise to re-election simply by virtue of this three-way race. with that kind of a landscape for november, pat roberts reportedly hadn't even been campaigning in kansas recently. and

he real liz made an issue of pat roberts' residency.roberts' is being hit by the tea party on his right and by greg orman and sort of the middle. and he's got seven weeks to figure that riddle out. >> we're watching pat roberts struggle, but what's fascinating to me, one of the most republican states in the country, we see pat roberts in trouble. we see governor brownback in trouble. what's going on with the kansas election this year? are all those individual problems? or should we connect them? >> we should connect them. we'll see how it plays out when voters go to the polls. but what you're seeing out here, rachel, is whether or not the rubber band is snapping back from the most right ward tilt of the republican party. you do get the sense, talking with moderate republicans that they are concerned that for whatever reason, the pendulum to mix my metaphors, has swung so far to the right that it needs to come back a little bit. brownback, of course, you've talked about it on your show repeatedly, has problems on tax policy. pat roberts

he's the best chance to beat roberts.lor writes a letter to the secretary of state who is an infamous conservative activist named kris kobach and what happens next? >> at that point, kobach decides that under state law and his interpretation of it, taylor is not allowed to withdraw from the race. taylor promptly sued kobach and then we went to the supreme court who issued their ruling today. their interpretation of the state law is that taylor's letter was sufficient to take his name off the ballot and so yeah, now the ball's in kobach's court. he's already said that he thinks that the democrats have to name a replacement for taylor but it's not sure what recourse he has to force them to do that and whether there's enough time to get the ballots printed so they can be sent out to absentee and military voters. >> as all there is happening, or man is surging ahead in the polls. there's polls indicating he's neck and neck with roberts and may even be beating roberts in certain polls. so was the big question was if taylor are

orman 41% to roberts 34%. that tells you why roberts is so concerned about going new a head to head. e.j., in theory, this could determine who controls the senate. >> it's true. and actually, all of the models that people are playing have shown the battle for the senate tightening. democrats are running a little better in some places than they were before. so it's not at all impossible that it comes down to kansas. we don't know which party greg orman, the independent would caucus with. yes, kansas is a big deal. and kansas is really a central battleground this year in american politics. you also have a senate race and brownback in a lot of trouble in his race for governor. and chris kobach himself, the secretary of state, is in a very hard race. so i think a lot of us on election night are going to be watching kansas. >> yeah, and you talk about why brownback is in trouble and how that's hurting republicans in general. 3 million short of expectations. they can't pay for it, leaving a $1.3 billion hole in thei

senator, pat roberts.went down on the deadline day, and he spoke with the deputy, the state elections director who he says gave him instructions as to go about getting his name removed from the november ballot. taylor says he followed those explicit instructions and then asked the kansas elections director if his name would indeed be removed from the ballot and according to mr. taylor, he was told yes. he left having heard a yes from the director of elections. yes, your name has been removed from the november ballot. the following day, the kansas secretary of state announced that actually, no, chad taylor would not be allowed to with draw his name because he did not file his paperwork correctly? really. and then we get to the shrug. so his office now release add sworn affidavit from the elections director, from the guy that chad taylor told him, yeah, you have done it right, you are off the ballot, the sworn affidavit says, yeah, chad taylor did ask if his name would be removed from the ballot, but accordi

of the supreme court under john roberts. actually watching college football when they broke into the football game with the news that the chief justice had passed away and i think for all of us it feels like it was yesterday in many ways. now it's been more than nine years ago. john roberts had, of course, already been nominated to join the supreme court for sandra day o'conner. >> to bring to the subject not just because you're the general. i had to admit i googled before i came over here and came to the realization that you're almost the same age as the chief justice. of course, you distinguish yourself in practice. now of course with a somewhat different relationship. so i'd love to get any thoughts you might have from having now argued in front of the supreme court the roberts court both as solicitor general and in private practice. >> i'd be delighted to start the conversation off. one observation is that -- i guess i would say there are two ways in which the court, the roberts court, does reflect something fundamental
