nbc 10's rosemary connors was there as well. rosemary, what happened in court. >> reporter: delvin barnes, he requested that the court appoint him a public defender to represent him. that hhppened today. and the judge scheduled the next hearing. as we expected, the family of the victim, carlesha freeland-gaither, they were not here. it was a very brief court proceeding. but i did speak with carlesha's grandmother within the hour and she tells many he that ultimately when all of this is over, she hopes to see the suspect put away for life. wearing a dark green standard issued jump suit, 37-year-old delvin barnes appeared before a judge for the first time to face federal kidnapping charns in the abduction of 22-year-old carlesha freeland-gaither on november 2nd. it was this surveillance video of the attack in germantown that sparked a three-day manhunt. how confident are you about the prosecution's case against mr. barnes? >> i'm just not going to comment at this time. it's an ongoing investigation. >> reporter: in addition to the

nbc 10's rosemary connors was one of the last reporters to talk to them. what have you learned?>> reporter: i spoke with carlesha's mother. she tells me she was briefed on today's developments and also says at this point moving forward she's going to be laying low, not doing too many interviews. she doesn't want anything to compromise this case. on day three of this round the clock investigation, the family is exhausted but they are not giving up. it's become a ritual for the family, every morning they return to the crime scene. today also involved meetings with philadelphia police and the fbi. investigators spent hours coming and going from this germantown neighborhood to talk to the mother of carlesha freeland-gaither. >> i believe she knows him. i don't believe it was a random kidnapping. >> reporter: she and other family members have wondered if the attacker could be an exboyfriend but these new images of a person of interest do not look like anyone she say they recognize. >> i don't know him. i can't not identify him. i don't know if there was a connection with my granddaug

nbc 10's rosemary connors was in that courtroom today rosemary?>> reporter: renee, two things happened. as you heard, the judge appointed a public defender to represent delvin barnes and the judge scheduled the next hearing. it will be friday. it's a detention hearing. that's when they figure out the terms of his custody arrangement, if bail will be set, for example. after the hearing let out today, i spoke to his attorney just outside of the courthouse. >> we represent our clients all the way through, including appeals and beyond. >> reporter: the court-appointed defense attorney gave brief comment as she was just assigned to the case thisç afternoon. her client, delvin barnes, appeared before the judge in a green colored jump suit, initially with his hands cuffed behind his back. today was the first time he was in court on federal kidnapping charges in the abduction of 23-year-old carlesha freeland-gaither. she is seen in this surveillance video struggling with her attacker on the night of november 2nd when she was snatched in germantown. >> ha

nbc 10's rosemary connors live this afternoon in northeast philadelphia. >> rosemary, that woman now lives in fear. >> she does. she is concerned for her life. i do want to update you on where police are in this investigation. just a few moments ago, i checked back with the lieutenant here at northeast detectives. he tells many he that within the next half an hour he expects a judge to sign off on an arrest warrant for this man. as you mentioned, i did speak to his wife earlier today. she says they've been married for 18 years. over the last three they've been going through divorce proceedings. she tells me she never expected it to come to this. >> he had threatened that he would put the car in the river and then he texted my daughter and said, you have two minutes and then he texted back and said it's done, lol. >> the final straw in a bitter divorce says the wife who does not want to reveal her identity. she tells me it was her husband who put their 1990 red corvette into drive and let it plunge into the delaware river yesterday. and she says that one night in june, he broke throug

rosemary connors is live with a look at what will unfold today. what can you tell us? >> reporter: this will be the first apopearance for delvin barnes. earlier this morning, i found out that the hearing is going to be moved to a larger courtroom than the one these kinds of proceedings are typically held in. that's because they are expecting a crowd, the press and possibly some of the victim's family members. as you can see from our video, the last time that we got a look at delvin barnes was last week after he was captured in maryland. he was brought to virginia whereas you mentioned he has been wanted on attempted murder and rape charges. he is accused of assaulting -- sexually assaulting a 16-year-old girl. investigators called him a predator. they say he is responsible for abducting carlesha freeland-gaither back on sunday, november 2. as you can remember, it was an extensive and exhausted three-day manhunt that led authorities to track down barnes in jessup, maryland. that's where they rescued carlesha. we have been talking to her family members over the past two

. >> rosemary connors is live with new information about this case. osemary, what have you learned? >> keith and jacqueline, within the past few minutes i got an update from the lieutenant who tells me that the warrant has been approved for the arrest of the husband. the arrest is related it aç protection from abuse order, a pfa order filed by his wife. police say he violated that pfa when he texted and called his wife yesterday threatening to siene their 1990 corvette into the delaware river. that's exactly what he did, according to police. they say that this is the culmination of a bitter divorce that's been going on for about three years. earlier today, i did talk to the wife on camera but she doesn't want her identity revealed. we spoke about how and when she learned of what her husband is accused of doing. >> i saw breaking news come across the news and it showed that a car was just down the tacony. i was on the phone. i hung up. i called 911 and i asked them if that was my car. they confirmed it was. >> reporter: the wife tells me this is not th

rosemary connors has the story. >> reporter: he may be a leader on the soccer field but 18-year-old jamesr off the field. the senior at radnor high school spent the weekend in jail after police arrested him on friday. the it says cellucci agreed to sell an undercover officer a quarter ounce of marijuana in exchange for $100. the alleged meeting place, the parking lot of this mcdonald's in wayne, the same spot where a cook at this fast food restaurant was arrested and accused of also selling to undercover cops this summer. in cellucci's case, police stopped the teen just down the street. officers found drug paraphernalia in his car. >> this is not a surprise to me at pull. >> this man pleaded guilty to running a drug ring in a handful of main line high schools. he's accused of selling to the undercover officer. no one answered the door at cellucci's house and the radnor school district tells us any student discipline matters are private. the 18-year-old soccer standout who has been recognized as a gifted player in the league is due back in court on thursday. >> this goes on in the district

rosemary connors is live at 30th street station. the rails are packed today? >> they are. things are moving along really fine. amtrak has had a few delays out at 30th street station here. nothing weather related. just usual delays they may see in the middle of the week. in terms of folks who staying at home for the holidays, today hasn't been too bad. they were home from work, they finished up on some last minute shopping. we caught up with a few of those procrastinators in the italian market. >> okay, it snowed, it's raining. it's a little slower than usual but we'll deal with it. >> the weather may be why there's still plenty of produce in the italian market. the crowds have come and gone. not all, but most did their shopping with the forecast in mind. >> i'm just picking up the last minute food for thanksgiving dinner, my potatoes, brussel sprouts and everything, and getting last minute stuff done so i can get out of this weather, actually. >> the rain don't even bother me. you have to do what you have to do. it's snowing and raining. as long as the snow ain't sticking.

nbc 10's rosemary connors joins us now. what is happening at that scene?>> reporter: jacqueline, police activity, crime scene investigators have returned to this area. they're sweeping up that shattered glass from the car, just making sure that everything is cleared out of here as they continue their investigation. meanwhile, the family, they are also on scene. carlesha's father and stepmother. within the past half hour i showed them the surveillance video of the abduction. it was an emotional moment. it's unlike any pain they've ever known. for carl freeland, his wife and his relative, it's almost unbearable to watch his daughter, 22 carlesha freeland-gaither struggled with her attacker before she was force nd into a car and abducte last night around 9:30 near coulter and greene street. >> whatever you all want, whatever you need. >> reporter: they tell me they feel desperate, they want carlesha to know she are not giving up hope, especially that the police have video evidence of the attack that happened just a few blocks away from their daughter's home.
