rosemary connors is live with more on the breaking decision. >> reporter: jim's delaware's department of justice cleared the four officers within the past hour or so coming some eight months since that deadly shooting. wilmington police killed jeremy mcdole in the wheelchair last seventh, call to the scene for reports of a man firing a gun. according to the police when officers arrived, he repeatedly refused to raise his hands and reached into the waistband. at that point, the officers opened fire. police say they found p a reinvolver on the man and had gun residue on his hands. the family denies that, and the department of justice concluded that criminal charges could not be brought against the officers, however, the doj did recommend removing one of the officers involved from the force because of, quote, extremely poor police work. within the past 15 minutes, we reached out for response, and the city official told us that it disagrees with the department of justice's criticism of the officers involved. reporting live from the digital operations center, i'm rosemary connors, nbc 10 n

nbc 10's rosemary connors reports on the soda tax debate. >> we believe that the period of pregnancy to age 5 is the most critical in a child's life. >> reporter: the importance of early education is what joanne fisher, of maternity care coalition, preaches. >> these are the hands. >> reporter: armed with signs supporting soda and sugary drink tax are making their voices heard at the meeting. the tax would fund universal pre-k in philadelphia. >> helping two generations here, children are going to get an important start but also their families, who need to get back in the workforce, who need to invest in their own education. >> reporter: fisher knows the need for pre-k too well. her organization runs the largest head start program in pennsylvania. she admitted, though, the tax won't resolve everything. >> i agree, we need a bigger program, more long-term and sustainable funding. but this is an important first step. >> we understand why there is the move to make those taxes. did have great success in new york. it did help increase revenue. it's something that the city could benefit fr

rosemary connors is live in norristown with more on today's testimony in court. >> reporter: this is a case of he said, she said, although, we never heard from bill cosby or andrea constand in person today. instead, it was their previous statements to police picked apart by the prosecution and defense. it's up to a jury to decide whether the once beloved comedian took advantage of the career advice, and it was said there was a understood sexual relationship and what happened in the night of question was nothing more than an intimate evening between two adults. defense claimed before the incident she was alone with cosby at a casino in connecticut laying in his hotel bed with him. the defense said after the allege assault, they continued to talk by phone and meet in person, and at one point, constand asked cosby for tickets to a show. the prosecution focused on constand's initial report to police, going over in detail telling detectives she was parolized, could not speak, and before she knew it, cosby put her hands up her shirt, down her pants, and placed her hands on him. constand cl
