nbc 10's jim rosenfield joins us with details. jim? >> more than a dozen lawsuits have already been filed but this is the first wrongful death suit in the derailment that killed eight people and hurt hundreds more. the suit was filed by the family of robert gildersleeve of baltimore, a father of two, vice president of the tech firm ecolab. you may remember this video we will show you posted online by his son mark in the days after the derailment. he pleaded for help finding his father who was still missing at the time. in the lawsuit, his family accuses amtrak of negligence and outrageous conduct. on may 13th amtrak train 188 jumped the tracks at double the speed limit in port richmond. the trains car went flying off those tracks. federal investigators still trying to figure out what caused the train's engineer to drive so fast there. more than one dozen derailment suits have been filed so far. congress has said $200 million is the most amtrak will pay for this crash no matter how many people win lawsuits against the railroad. many exp

. >> let's go to nbc 10's jim rosenfield who is following the breaking details. jim?as all been developing in the past 20 minutes or so. once again, it's two senior new york state officials who are telling nbc news that richard matt has been shot and is now dead. there are also reports that officers are now chasing the second escaped prisoner david sweat. today we learned more than 1,000 federal, state and local authorities moved their search about 30 minutes or so from the canadian border this was after state police said the escaped convicts left behind significant evidence in a hunting cabin in the area. both richard matt and david sweat have been on the run of course since they broke out of the clinton correctional facility upstate new york. back on june 6th about three weeks ago. again, nbc news reporting one of the escaped prisoners, richard matt has been shot and is killed and the search is on for david sweat at this hour. we will continue to monitor any

. >> nbc 10's jim rosenfield is here with new information on the story. >> today's news conference was very revealing. >> reporter: yeah. he is no longer a student at penn state and in his lawsuit, he claims hazing caused him to flunk out his freshman year. as a freshman he pledged kapp adel take roe. he says his soon to be brothers forced him and other pledges to drink so much alcohol they got sick. he says he was also punched in the face repeatedly for not showing up to a frat event. on another occasion he says he was burned with a cigarette. he says he called the university's hazing hotline but got no help. he went to the school's office of student conduct. eight months went by and finally he says he went to police. >> never intended to become a whistle blower but when i saw what was going on and the abuse that myself and others were repeatedly experiencing and that the university was totally ignoring, my documented allegations over several months they left me no choice but to go to the police before more people pledged and other innocent students got hurt physically and emotionally

i'm jim rosenfield along with renee chenault-fattah.strong storms moving through philadelphia right now. let's get right to nbc 10 first alert meteorologist sheena parveen with the latest. >> we have a tornado warning just south of philadelphia. it is moving into new jersey. this is an area where we expect it to really continue to strengthen as it moves in. now here's a look. we have philly international, gloucester city deptford gloucester ashland, all these areas in this tornado warning. it was just issued. this will go until 6:30 this evening. about 30 more minutes. i will loop this for you. we will look at the motion for paulsboro. you are right on the edge of where this tornado warning is issued. i will zoom out a bit. here you see the philadelphia area. i will get rid of some of the yellow boxes because these are severe thunderstorm warnings. we are just going to focus on that tornado warning across the area. again, this is the section where we do expect some extremely strong winds. paulsboro, you are in this area as well. west de
