ross? >> good to have you on today, simon. so we finally got it, the deal announced, agreed between xstrata it and glencore. it's a $90 billion merger. it will be called glencore xstrata. the shareholders are getting a 50% premium to where the shares were wednesday. 2.8 new shares for each xstrata share they hold. xstrata ceo will lead with glencore ceo will be the president and deputy ceo. the chairman holds on to his previous post. in terms of stock price today, we saw reaction last week. glencore international trading higher today up six points to 467. xstrata stock down to 1,229. john foley, the greater china bureau chief at reuters, thanks very much indeed for joining us. i see standard life this morning. they said they're going to vote against this deal. is there enough for xstrata shareholders, bear in mind mergers have a 20% or 30% premium? >> well, you said there was a 15% premium earlier. it's a bit cheap for can companies to say that because that's comparing glencore's shares tod

ross mirkarimi returns to court today to try to win the right to see his son. hollyfield is live at the hall of justice with the latest. >> reporter: sheriff ross mirkarimi has said not being able to see his son has been crushing. today he's going to try and different tactic. he's going to ask the family court to allow him to see his 2-year-old son or at least have supervised visits. the criminal court judge issued a stay away order mirkarimi hasn't been allowed to see his family since he was charged january 13th. he asked the criminal court to lift the stay way or the judge said no. legal experts say mirkarimi might have a better chance in family court where the goal is to preserve the family and see a family reconcile its differences. >> ultimate question for the judge, the family law court judge is, really the best interests of the child. sometimes they do grant supervised visits. that -- if the child is being traumatized by being separated from one parent that is a way to minimize that damage. >> reporter: mirkarimi has pleaded not guilty to three misdemean

sheriff ross mirkarimi will be back in family court today trying to convince a judge he should be allowed to visit his son despite the domestic violence charges against him. amy hollyfield is live in front of superior court with more. >> reporter: this will be his second time in court on this issue. he was here on friday and he got choked up friday when talking about his son theo. >> i miss my son terribly and he misses me. i have to go. >> reporter: today he will be back. hoping a judge will decide today on his request to see his son. the criminal court judge put a stay away order in place and mirkarimi was charged last month and that prohibits him from going near his wife and child. eliana lopez, his wife, says she thinks her husband should be allowed to see their child. while this issue is discussed in family court today the criminal case continues to build. prosecutors just filed paperwork asking that mirkarimi's ex-girlfriend be allowed to testify against him. she filed a police report last month saying that he pushed her up against a wall and bruised her when they were dating three

ross mirkarimi has convinced a judge to let him see his son once again. anne makovec tells us those visitation rights come with some strict conditions. anne. >>> reporter: this is the court order released within the past hour. it says that ross mirkarimi will be able to see his son theo for two hours each weekday and up to six hours on a weekend day. those visit will have to be arranged by another couple. it's a mutual friend couple of theirs. mirkarimi is obviously thrilled. he says he is going to see his son this afternoon. >> i get to see my son. and i can't tell you how excited and grateful i am. this has been a torturous process. >> reporter: now, today's process includes an orientation where mirkarimi and his wife eliana lopez talk separately with a mediator about what's best for their son. then the mediator come up with the plan that the judge approved after a criminal court denied the request last month. lopez, when -- who ross mirkarimi is accused of grabbing and bruising on new year's eve, says of the visit between the father and son this aftern

an important phase in sheriff ross mirkarimi's trial starts today.o start deciding what evidence will be allowed. christie smith joins us live in san francisco with details. a key piece of video evidence. >> reporter: that's right. the judge has to consider a couple of key pieces of potential evidence including a statement made by a neighbor and also videotape shot by a neighbor of san francisco sheriff ross mirkarimi's wife ely anna lopez and whether they will be allowed. mirkarimi is charged with three misdemeanors including domestic vie lan violence battery. it shows a bruise on her arm saying her husband had done something similar but the defense says she was speaking as someone concerned about a potential custody issue and not necessarily as a crime victim. and they describe the neighbor's statement as hearsay. lopez and mirkarimi have gone on to say any abuse is not true, that hearing starts at 10:00 but a judge has said that mirkarimi doesn't necessarily have to attend. reporti ining live, christie sm. >> a scary start for people at an oakland

ross mirkarimi, well-known in san francisco. why are there so few reporters coming forward? in public a long time, not a lot of the voices. >> interesting question. mirkarimi was a member of the board of supervisors for seven years, plastic bag ban in san francisco, he was one of the founding members of the california green party, worked for max gonzalez when he was running for mayor, he's been around for a while. there's been a lot of silence and that's making some of the victims' advocates upset about it. clearly from the get-go, he's innocent until he's proven guilty. >> belva: there's been no trial. >> he's plead the not gritty to three charges involving this incident. his wife has said publicly her husband has not done it. the only high-profile person who's come around is art agnos. it's a very difficult case for public officials. the mayor of san francisco and the board of supervisors might be called upon at some point to judge his fate. they could try to remove him from office. they legally should stay out of it. >> belva: the whole issue of domestic violence has rise

ross mirkarimi will return to family court. anne makovec is in san francisco where prosecutors are adding to their witness list for mirkarimi's upcoming trial. good morning, anne. >> reporter: that's right. of course there was a similar family court hearing last week when he was asking to see his son. we understand he and his wife have been meeting with mediators independently to come up with some sort of mutually agreeable visitation schedule. this morning the judge could either accept or deny that plan that they are coming up with. this is going to happen in just a few hours here at 9 a.m. this morning's hearing in family court comes after a similar motion was twice denied in criminal court mirkarimi is barred from seeing his wife or son right now. this hearing is about only his son. his wife does support mirkarimi's request to see their son. mirkarimi was arrested on january 13 charged with domestic violence battery, endangering a child and dissuading a witness. he is accused of grabbing and bruising his wife's arm in front
