a judge ordering the release of rowan county clerk kim davis. t's taking place there as people gather outside of the jail which is in carter county and they're going to be holding a rally coming up at 3:00 p.m. eastern time. davis spent several days, five nights in jail, contempt for refusing to issue marriage licenses. her attorneys are scheduled to address the media coming up shortly. it was moments ago, though, that republican presidential candidates ted cruz and mike huckabee arrived to meet with davis. huckabee will attend the rally coming up this afternoon. earlier, msnbc's sarah dallof spoke with some of the protester there is to support davis. >> the law's the law. so i mean, if you do not want to obey the law and you think that's not right, maybe you should not be in office. >> i don't think she should have been sentenced to jail. i think she should have been issued a fine and had to resign her job. >> i don't think she should have put here in the first place. she's too good of a person. she's standing for what's right. >> msnbc's sarah

the fact that the deputy clerks put down rowan county clerk, instead of miss davis county clerk will affect at all. it is really a fairly nonsensical position to take. they are invoking a state law that says if a clerk or deputy clerk issues a marriage license that is contrary to law, in other words, people that are not eligible to be married. say they are under aged or they don't have the appropriate identifications and they are trying to trick the state in to doing it, and the deputy goes along with it. those are the kind of criminal penalties. they are conflating i think a wish and a hope. i believe the licenses are valid and i would be shocked if a federal court got involved in it. it is such a purely state law issue i imagine the judge bunning and sixth circuit will say go litigate that in state circuit court. >> is there a way to litigate it? who could bring -- who with would have standing to challenge these licenses? >> well, that's a good question. i reckon you could make an argument that she has standing since she's the elected office holder. obviously the folks that got mar

they have been altering it so that rowan county rather than kim davis' name appears on the line reservedlerk. plaintiffs have not alleged that the alterations affect the validity of the licenses. the plaintiffs are happy with the licenses. he said i don't find either that the alterations are impacting the court's decision to the deputies complied. it seems to be the court and the plaintiffs are saying they're okay with the alteration instead of kim davis' name being on the licenses they're using rowan county instead. so, if that holds, it sounds like that's a compromise that her legal team to this point would be willing to work with. all along they've said if she doesn't have to sign off on any of this that's the compromise she is looking for. the order says she can't in any way interfere with the deputy clerks doing their job and issuing these licenses to any couple who is eligible to legally get married. so we'll see if that compromise is good enough for her. if not, the judge said, if she violates the order, she could be facing fines and jail all over again. >> right. how does this ch

. >> jail, finds are on the table as rowan county could you clerk kim davis faces that federal judge in just about two hours. while he could throw the book at her, as an elected official she cannot be fired. supporters and opponents are already gathered outside the federal courthouse in ashland, kentucky waiting for are that hearing right now. the federal judge will ask davis to explain why she is defying the supreme court in refusing to issue marriage licenses to same-sex couples. her lawyers have argued that the state of kentucky has an obligation to accommodate her religious objections if it would be reasonable to do so. in the meantime, davis says she's not discriminating against anyone in refusing to issue those marriage licenses. >> you do not work in a religious institution. if you wish to discriminate -- >> i'm not discriminating because i'm not issuing licenses to anybody. >> davis says she's not disobeying the supreme court either because she's waiting for an appeal. however, a federal appeals court, and the u.s. supreme court, refused to lift a lower judge's order for her

the county clerk here in rowan county has refused to hand out those licenses. e is in jail, but her deputy clerks are handing out licenses. the first same sex cup toouple obtain a marriage license in this county showed up as soon as the doors were open. listen to what they had to say. >> we've had supporters here since the beginning from this county, from this community. and there are people who have been here every day since the beginning of this, every day out here protesting. you don't really realize the emotional charge to it and the hate until you see it up front, you know, up close. but we're trying not to -- we just want to really go get our license right now. >> reporter: william smith and james yates made their way through the throng of protesters to get their marriage license. they had been here five times before they succeeded today. the judge called five of kim davis's deputy clerks to the stand. five of them agreed they would issue the marriage licenses. the only deputy clerk who held out was kim davis's son, who is refusing to issue licenses to sam
