rubio: i haven't talked to the n.r.a. about it. i can tell you that every constitutional right we have could potentially through a court order be infringed upon. they can go into your property with a subpoena or with a search warrant. they can get your records through a subpoena. so that's why the due process at the front end is important. there has to be a standard that has to be met and this clearly creates the ability for states or incentivizes states to do so. because in the end, exidgent circumstances and public safety is one of the places we've made exceptions through due process for taking on a constitutional right of people. that's why we have subpoenas for documents. that's why we have the ability to conduct search warrants. so i don't think the standard for this is any less than it would be for any of the other rights. in fact, when you look at the permanent order, it requires clear and convincing evidence, and the burden is on those who are applying. not on the respondents. the respondent, the person who is the subject o
