very long and consistent history of justices' involvement in political activities, and for ruth bader ginsburg campaign strikes me as small potatoes compared to the histora of such involvement. i know the issue has been raised but i haven't seen those people who criticized ginsburg acknowledge the historical record and take that into account in setting her statements in historical context. >> guest: i think -- i mean, as a factual matter, you are clearly correct about john jay, about charles hughes, andd william douglas. mentioned douglas earlier when this came up. times have changed. the place of the supreme court in modern life is, as the justices all acknowledge, when they are nominated, when they're confirmed, they try to be more cut off from day-to-day political events. i don't bring any great naivete to this whole subject. b i recognize that supreme court decisions are often deeply political in their nature, but there is a tradition that is of many decades standing -- and it's really decades now -- that justices should try to stay out of the day-to-day electoral politics of the country.
