ruth bader ginsburg, the thurgood marshall of the women's rights movement has frequently said too far too fast the court would have done better to pool narrowly. my argument is based i hope on principle but it is also based on looking at what roe won. it is controversial. people have friends have attacked me for it but you can argue that roe is responsible for the radicalization of the republican party. rockefeller republicans are things you read about in museums now and you can make an argument that but for roe you never would have had ronald reagan and wouldn't have the level of kookdom that you have in the republican party now. it is not a straight line but roe helps radicalize the party, energize a previously quiescent movement of social conservatives, not a straight line, there are people who argue with some persuasiveness that that might have happened otherwise but i think the far better argument is that roe did things in the political system -- of corseted. before roe both sides could fight it out. >> guest: couldn't say the same thing about brown? and the court finally woke up

ruth bader ginsburg and stephen breyer. both of them are very interesting justices on the united states supreme court. there are friends from the katrina days. both were well-known liberals before joining the bench. ginsburg was the aclu g-- generl council and breyer had a been kennedy's chief counsel and they had solid reputations on the court of appeals and knew them and i helped them. so when president clinton called me in 1993 to ask my views on who he should nomination to the supreme court, i suggested ginsburg and breyer because i was sure he would pick the most left wing nut cake he could find. they were certainly not the nominees i would have chosen, had i been president. but as the ranking member on the senate judiciary committee at the time i thought it was important to try to work with the white house to dial back the problems with the confirmation process. and the bitterness that was existing and the rancor he escalating for so long and president clinton nominated justices ginsburg and breyer. both had smooth con
