what more are you learning, ryan?ht, judge kelly has said that he will indeed accept the partial verdict. we will be finding out how the jury found on some of the counts shortly. right now defense lawyers are having a private conversation. one of the defense attorneys had objected to taking the partial verdict, meaning they wanted to hold off and wait until everything had come back, let the jury deliberate on these other remaining accounts. what judge kelly said he is going to take that partial verdict. the jury will come back into the room. the counts they've reached a conclusion on, they will then deliver their verdict on, at which point we could have a situation where the judge tells them to go back and continue deliberating those outstanding counts. it seems as though the jury is pretty locked up on those charges. so you know, i think this is going to be the big -- this is going to be i think for the most part the big moment here on these partial counts because if they haven't reached conclusions on the other ones

ryan, what do you have? that fifth defendant, dominic pezzola has been found not guilty of the top charge of seditious conspiracy, and the judge has declared a mistrial on the outstanding counts. i wouldn't say that dominic pezzola was considered that much of a win, given that he has huge criminal exposure, and overall this is a huge victory for the justice department, securing four out of five of the top charges, and significant criminal exposure against all five defendants. arguably i think there might even be some smiles at the prosecutor's table because on appeal it's going to be a lot easier for them to make the case that the jury considered this very diligently and looked at these charges very carefully. they didn't just throw the book at everybody. they looked carefully at what the evidence shows, and what they concluded is there was not enough evidence to support a guilty verdict against that top defendant or one of the five defendants, dominic pezzola, and he was that individual who smashed open the

abc7news reporter ryan curry looks at the results. ryan: bart ridership continues to struggle. the bay area cancel says if ridership doesn't return to what it was, the area -- the agency could never recover. >> the system is facing a financial hole that is hard to fill and without it we could lose the bart system. ryan: bart is averaging between 100000 and 150,000 riders on a weekday. before the pandemic they were averaging around 450,000. many stopped working and -- commuting and working from home. with the pandemic under control, ridership still struggles. 45% of people surveyed are choosing not to ride bart over safety concerns. 17% describe bart as safe. >> people are hesitating to get on board because they have fear or they don't want to experience these conditions. ryan: bart announced changes to its police system. officers are patrolling more often but the survey was done after bart made the announcement and people still don't feel safe. >> if they feel safe and secure, we will see a lot of people come back. ryan: the bay area council says bart is a massive part of the e
