ryan nobles is live on capitol hill for us this evening. ryan, good evening to you. my question is, the january 6th select committee announcing they will vote on another criminal contempt of congress referral for jeffrey clark. what can you tell us about that? >> yeah, don, this is a significant move by the january 6th select committee. this is the second time they have moved or planned to move on a criminal contempt referral for someone they issued a subpoena for and jeffrey clark they view as a key cog in this investigation that they have underway. clark was at the department of justice in the days after the november election leading up to the january 6th insurrection. hes the trump ally within the department of justice encouraging superiors to use the agency as a way to investigate these false claims of election fraud across the country. now, his efforts were rebuffed by then acting attorney general jeffrey rosen but still, they believe that clark could be a key link between the white house, these groups that were working outside of the white house, the trump camp

cnn's ryan nobles is on capitol hill. where do these potential forthcoming subpoenas stand and what's the committee expect when it comes to compliance of the six we just highlighted? >> reporter: yeah, so, victor and alisyn, at any moment, we could get news of a new round of subpoenas that have been issued by the select committee, the committee not being specific as to when we'll hear about the subpoenas but bennie thompson saying there's potential of as many as 20 names and we saw just 6 names issued yesterday. so, we're waiting for that to happen at any moment. but in terms of that group of subpoena targets that we saw yesterday, these are individuals who played a big role in peddling the big lie in between the november election and january 6th. and they are all people with very close ties to the former president, donald trump. and to your question about compliance, what we found throughout this process is people that are very close to the former president have been pretty defiant in their interactions with the committe

ryan nobles is with us. the committee met this morning. any movement on this?hing yet, but hopefully we'll see some of the members of the committee here in the next hour or so to get a readout as to what they talked about. but what we've learned from our reporting is that the situation with mark meadows is a little bit more complicated than it is with steve ban non. steve bannon attempted to say that he was protected by executive privilege which is the reason that he didn't come before the committee, but he wasn't even an employee of the executive branch at the time that the committee is interested about learning more. mark meadows was chief the staff. so perhaps his privilege claims are a little stronger. but still the committee believes that it is his responsibility to come before the committee and answer the subpoena and at least attempt to answer some of the questions that they have had before him. what the committee now will have to figure out exactly how do they compel that testimony. and of course they have said that criminal contempt is an avenue that t

cnn's ryan nobles joins me.do we know about the committee's thinking on this and how is it different from how it handled steve bannon's lack of cooperation? >> well, for one thing, we saw the january 6th select committee move very quick twhen came to steve bannon to quickly refer him for a contempt of congress when he defied their subpoena request. it's been a much more deliberative process. and the chairman of the january 6th select committee bennie thompson saying the committee is not officially decided they are ready to move to criminal contempt against meadows but he has signed a letter that they will send to meadows outlining all the things they expect of him and if he does not comply that they are ready to take that next step. the meadows situation is a little more complicated than bannon. bannon was not working in the white house or directly for donald trump at the time of the january 6th insurrection. meadows was in direct contact with the president in the executive branch. he believes that puts him unde

cnn's ryan nobles is on capitol hill. who are the targets of this latest round?e second day in a row that the january 6th select committee has issued subpoenas to a group of individuals hoping to learn more about what happened on january 6th. and this is an interesting batch of requests that they put out today. it focuses on these right wing extremist groups that were very prominent during the riots and chaos on january 6th. among them, the proud boys international. this is a subpoena of the entire organization as well as their former chairman, henry enrique tario. he was in and around washington, d.c. in the week leading up to january 6th, was very vocal in his opposition to the election results, and among the group's -- among the people, i would say, that were encouraging people to do whatever they could to interrupt the certification of the election results on january 6th. the committee wants to hear from the oath keepers, a para military militia group and its president, elmer stewart rhodes. oath keepers had big numbers, a lot of their members were here on ja

ryan nobles joins us now.on. so why is the committee moving forward with this vote to hold him in criminal contempt of congress? >> it's what happened behind those closed doors when clark appeared for the deposition. he basically didn't answer any questions. he told the committee he didn't have to citing executive privilege and attorney/client privilege because of his relationship with the former president donald trump. but the committee just isn't buying it. they believe that clark has no privilege protections and that he needs to answer their questions and provide the documents that they are looking for. that's why they are taking this step of referring him for criminal contempt to the justice department. the committee is set to meet on wednesday. they'll vote on a resolution from that committee. it will then be voted on, on the entire house floor. that could happen by the end of the week. it will be up to the department of justice to decide whether or not to prosecute. unlike the situation with steve bannon

our congressional correspondent, ryan nobles, is joining us.s is a former high-ranking justice department official who pushed then president trump's lies about the 2020 election, calling them fraud. tell us what happened. >> yeah, that's right, wolf. and the committee chairman, bennie thompson, said that he refused to answer any questions about the substance of the events leading up to january 6th. and the committee is reacting pretty harshly to that. the committee chairman putting out a statement in just the past few minutes that reads in part, it's astounding that someone who recently held a position of public trust to uphold the constitution would now hide behind vague claims of privilege by a former president, refuse to answer questions about an attack on our democracy, and continue to an assault on the rule of law. as prescribed by the house rules, i consider mr. clark's claim of privilege and rejected it. he has a very short time to reconsider and cooperate fully. and the question tonight, wolf, will the committee take the step of crimina

ryan nobles is outfront live on capitol hill. ryan, what does the committee think it can find out from these latest subpoenas? >> well, there is no doubt, erin, that the focus of this round of subpoenas is trying to get behind this group of individuals that were key in planning, executing, and raising money for these rallies that took place leading up to january 6th and then, of course, the rally that took place on january 6th. many of which, the attendees of that rally ended up here at the capitol on january 6th with the goal of interrupting the certification of the november election. and you mentioned the importance of stone and jones. they are obviously two of the bigger, more prominent names who had such a public role in raising money and convincing people to come here to washington, in addition to peddling the big-election lie. but the other three names are significant, as well. dustin stockton. his fiancee, jennifer lawrence. and then, the third person, who is currently the spokesperson for the former-president donald trump.

let's get straight up to capitol hill and ryan nobles who has this breaking news for us. you know? >> reporter: this is reporting our team learned exclusively and now the select commit and the committee has confirm. the former chief of staff is cooperating with the select committing and is handing over documents and is prepared to sit for an interview with the committee. the chairman bennie thompson releasing a statement saying, quote, mr. meadows has been engaging with the select committee and has produced records for the committee and will appear for an initial deposition. this is a major change in the approach between these two parties. meadows initially engaged with the committee when the subpoena first came down but then began stonewalling them to the point where the committee threatened to move to a criminal contempt referral against meadows if he didn't comply. that seems to have been what changed the conversation in both the committee and mark meadows have found common ground where he is willing to hand over documents and answer questions about what he knows as it

of northern virginia and fairfax county, punch up fairfax county because i am going to bring in ryan nobless? >> reporter: yeah, that's right, jake. we do have an update now. some of these precincts are starting to trickle in. nine of the 247 precincts have reported terry mcauliffe now at 109,000 votes. glenn youngkin, just over 42,000 votes. and to john's point, it's really the percentage here that we have to watch in terms of the mcauliffe campaign because fairfax county is where they have the most available votes that they can get in all of virginia. and when that first batch of votes that came in that were all early votes and vote by mail, we saw the mcauliffe campaign with around 74% of the vote that had come in. this next round of votes that came in that came from voters that voted today, we saw that number start to trickle down from 74% to just a little more than 71%. that's not a good sign for the mcauliffe campaign as they go on into the night. now, one optimistic sign for the mcauliffe campaign is that we are not done counting all the early votes. they were somewhere in the range

let's go to our congressional correspondent ryan nobles. ng to drag this fight out? >> yeah, they are, wolf. and that's going to come to a flash point tomorrow in washington, d.c.'s district court and that's where a judge is going to hear arguments from trump and his associates and their attempt to defend executive privilege, and keep secret some-700 documents that the committee ask inis interest getting from the national archives from the trump administration during the time around the january 6th insurrection. trump's lawyers arguing they believe these documents are nothing more than a political witch hunt. that the committee's already decided they are going to conclude the president is responsible for what happened on january 6th and they believe each individual document should be reviewed by the court before it's handed over to the january 6th committee. now, this judge could make a decision on the release of this information from the bench tomorrow at the end of this hearing. of course, the committee believes they should have access to

we have ryan nobles for the latest. ryan? >> we see this new round of subpoenas from the select committee, a clear direction in which they're heading. this is a group pretty prominent on january 6 involved in the riot that day, members of the proud boys, the oathkeepers, and the qanon group called the first amendment pritorian. they're trying to get as much as they can between these groups trying to get information, information that was peddled by the former president and his associates in the days after the november election, this concerted push to bring people here to washington on january 6, and then the last piece of all of this, the riot itself. people breaking into the capitol with the express purpose of interrupting the democratic process. what the committee is trying to find is whether or not there are direct connections between each level of what happened on january 6. that's another reason why you see them interested in people like alex jones and roger stone. these were the provocateurs that were trying to encourage

our congressional correspondent ryan nobles is putting it all together for us. ryan, what are you learning? what's the latest? >> reporter: wolf, this committee has already issued 35 subpoenas to people close to former president trump. today their committee chairman telling cnn they're prepared to issue even more this week and they're also attempting to get mark meadows, the former chief of staff to comply with the subpoena request. the chairman saying he is signing a letter with the list of demands they have for meadows. tonight the january 6th slikt committee is weighing its options trying to find a way to compel former white house chief of staff mark meadows to come forward and share what he knows about the events leading up to the capitol insurrection. the committee has been frustrated with his lack of cooperation. last friday meadows blew off a scheduled deposition, leading the committee chair bennie thompson and vice chair liz chain nay warning that the next steps may be referring him to the justice department department for criminal contempt. it may force

ryan nobles is out front live on capitol hill. so, ryan, what more are you learning about these six subpoenas? >> well, there is definitely a connection between all six of these individuals, erin, and that's really that timeframe after the november election leading up to january 6th. each one of these people played some role in peddling this narrative that somehow the 2020 election was stolen from donald trump. and as a result, everyday americans should be outraged by it and take action. and what we are seeing in the information that they released today, these subpoenas that they issued, the letters they sent to these individuals is that they want to know information, for instance, about the messaging around this stop the steal rhetoric that was being peddled by the former president. it was a bit of a surprise to see bill stepien, the former-campaign manager, listed as someone who was under subpoena because he didn't really take that big of a public role after the november election leading up to january 6th. but according to the su

cnn correspondent ryan nobles is here.ig development. >> reporter: there's no doubt about that, and while the committee seems hopeful about what they could learn from mark meadows, they are offering up caveats. they said meadows has agreed to sit for a deposition. he has agreed to hand over documents but they will assess his level of cooperation after he sits down for that deposition. so what does that tell us? well, there really still seems to be a disagreement between what the committee views as potential topics that may be covered under executive privilege, and what mark meadows views as topics covered under executive privilege. meadows is different than steve bannon, different than jeffrey clark, the former doj official set to be referred for criminal contempt starting tomorrow here on capitol hill but it is a big difference between the two of them have responded to the subpoena and the way meadows is now responding. it's to the point now where the committee believes there is enough engagement and cooperation that they
