the judge asked the s.e.c. what would be a sanction that you could live with if i do find him in contempt. one thing they left out and i think this is key for tesla shareholders, they did not say they are going to seek his removal as ceo. some people thought maybe they would do it. we should point out elon musk is in there right now and they said, meaning the s.e.c., will not seek his removal. they did say they wanted some sort of safeguards that he doesn't do this in the future, some sort of extra procedures. they also said they want a series of escalating fines. so that's kind of where we are right now. we are going to have to see when this thing is up. there's some talk inside the courtroom that the judge may go to the s.e.c. and elon musk's attorneys and say hey, guys, let's figure out where we're going to go with this. tesla's attorneys are arguing that they should throw out the s.e.c. settlement, that they should -- this thing needs to be completely reworded and essentially thrown out. i guess they want e

the s.e.c., which had an agreement with mr. musk, wants him held in contempt for violating they say that agreement by disclosing material information about tesla's delivery numbers musk is countering saying that's not material information that those numbers had been out there roughly in the past. the hearing has started and the lawyers for the s.e.c. have asked that he be held in contempt and the s.e.c. lawyer just said if mr. musk is held in contempt the s.e.c. will seek additional sanctions to ensure his future compliance with that agreement. that could include additional fines for any future violations and required reports about his compliance from tesla's lawyers. mr. musk according to the s.e.c. did not get a lawyer's permission to put out these tweets, and he wiwe know he lik tweet. that's why the s.e.c. is going after him and holding him for contempt of court. he entered the courtroom building a while ago and here's what he had to say it was brief but take a listen >> i have great respect

the s.e.c.argue he was in contempt of a settlement reached last year. joining us to discuss is craig trudeau, who covers tesla for us. craig, what exactly happened this time? craig: this is very similar to a post he sent in february. in that post, he said that the company was going to build about 500,000 cars this year. around that time, the in-house securities lawyer at tesla who was named to a position or hired as a result of a settlement with the s.e.c., reached out to musk and worked with him to quickly send out a follow-up tweet to clean that first one up, because it was inconsistent with past statements. there is a bit of a deeper story where musk himself sort of contradicted a written statement on an earnings call. but in any case, they tried to clean it up. the s.e.c. took notice and reached out to musk's lawyers and we found ourselves in this contempt of court fight. for musk to send this tweet over the weekend, it was very reminiscent of it. based on just context clues, it did not look

the elon musk s.e.c. saga continues. in early april, a u.s.th guys two weeks to resolve their differences. if they cannot negotiate, renegotiate, she said she would determine whether or not to hold musk in contempt or not. now they are asking for more time. in a joint letter, the deadline for their resolution on thursday, the tesla ceo and the s.e.c. said they had been unable to reach an agreement over musk's social media activity. joining us to discuss is dana hull. they have failed to reach an agreement, what is the latest? dana: they met and talked for an hour by phone, musk's attorney, the s.e.c. general counsel, they asked for more time, and the judge said yes. i think it is telling that they haven't received an agreement. they need to nail down, how does he use social media, how is it vetted, how is material information embedded ahead of time. emily: what is it that they need to back ahead of time? the: the issue is that judge was a clarified agreement that would make clear how his tweets are being reviewed, are they being reviewed ahead
