now, last thursday heather mcguire moved in to sam helene's house because she was afraid gilberti was out to get her. >> brutalized her, stalked her, broke her down psychologically, broke her down physically. >> reporter: after gilberti was arrested the second time, helene says no one thought he'd be getting out of jail. >> did anyone call her to tell her he was out? >> no. >> reporter: tuesday morning sam helene goes to court himself to get a peace order against gilberti. he sees gilberti is out of jail and knows heather is home alone. trouble is on the way. while sam helene was in court getting that protective order phil gilberti comes to the house in aspen hill, kicks in the back door, goes inside, beats up heather mcguire, drags her out, puts her in her van, and then takes off. minutes later philip gilberti shoots and kills his wife inside that van and dumps her body in kensington. later that night, gilberti kills himself at a friend's home in rockville. now gilberti had an extensive criminal record in montgomery county. it goes back to the '80s. we tried to talk to judge hamilton
