the fact is the special counsel gave a subpoena to sam nunberg to testify before a grand jury. is is even after nunberg talked to investigators. so why? why would the special counsel want to put him before the grand jury? >> it's not at all peculiar that after you speak to a federal investigator, they want to memorialize that not just in their spiral notebooks but also in front of the grand jury. the grand jury has far more authority to have that testimony used at trial. you can compel the witness to be consistent, if not truthful at a trial if it comes in the future. you can impeach that person with their testimony if it's somehow inconsistent. it also has the advantage of having a first-hand account told by a witness in front of the grand jury when their role is to assess credibility, to decide if they should indict. >> also no lawyer in the room for a grand jury. if you have a witness you think you can get to, it might be better to do it in that setting than a one-on-one interview. i'm trying to look at beyond the soap opera here and at the facts. >> it's hard. >> it is hard.

that both people who have been interviewed by the special counsel, that includes sam nunberg and others in the administration, believe that mueller's focus is increasingly on business dealings. that's partly their supposition but also based on the kinds of questions, as nunberg was saying. the kinds of questions they're being asked by the special counsel. that does not mean they're reaching conclusions. when you do a grand jury scene that, a you don't pull people to the grag just for the hell of it. there has to be some substance or plenty leads you down path. >> and he's already talked to the fbi for five and a half hours on. so the question is, what is it that he said that made them want to call him back before the grand jury? and he doesn't really know the answer. he doesn't want to go through and hand over all these documents which by the way, everyone in the white house who currently worked there. the convenience of having to turn over e-mails. let's remind folks. what is the a speenl a is. it is a legal demand. >> you have to obey the law. otherwise you pay the price. here's anoth

but the thing about sam nunberg, i've known him for many years. i've been kind of dealing with him in various ways as a journalist, this is really what he is like this. is his m.o. he kind of studied under the tutelage of roger stone, the notorious republican operative, and has always seen politics in some sense as performance art for its own sake, as roger stone once said. he really loves the attention. he loves the political stunts, the showmanship. and when i talked to nunberg last night, he was out essentially celebrating his day of nonstop media attention. he thought it was a great day for him. >> and mckay, i don't want to dwell on sam nunberg too much other than to illustrate in fact how much donald trump doesn't have the best people and will continue to not have the best people in the white house. but he kept complaining yesterday about this subpoena is so oppressive because he kept saying "i have a life." and he kept saying "i have other work to do." two questions. does he in fact have a life? and does he have any other work to do at all?
