monte francis is live at the san francisco county jail with the new details. monte? >> reporter: well, marla, good evening. the associated press is reporting that the father of the victim plans to make a public plea for witnesses to come forward. a family member tells the a.p. that the father plans to speak tomorrow at 1:00. the suspect michael montgomery walked out of the jail here early this morning. he is back home in lodi but so far we have been unable to confirm that. montgomery was arrested late sunday night fol lug a fight between the fans not far from the ballpark and after police said montgomery made incriminating statements about the stabbing death of jonathan denver. he was being held without bail until late last night until gascon was looking into claims that montgomery could have been acting in self-defense. gascon also said his office has not gathered sufficient evidence to prove the case beyond a reasonable doubt. legal analyst steven clark says the fact that montgomery was' leased doesn't mean that he won't be later arrested and charged in the case. >
