christie smith is live at san francisco city hall where it all began. good morning. >> reporter: good morning to you, john. the u.s. supreme court is set to hear two distinct cases on gay marriage next week. the bay area is ready with marches and vigils planned. there is also a 12-year-old boy that reached out to chief justice john roberts to let him know about his own family here in the bay area in santa rosa. he and his sister, salina, are adopted. they have two dads. the family is committed to each other. looking to the u.s. supreme court to decide the legality of his parent's union as it will consider california's ban on same-sex marriage tuesday. wednesday, the court considers another case that challenges the federal defensive marriage act. in the la few family, 12-year-old daniel learned that justice roberts has two adopted kids of his own. he said he thought he would never have a family of his own.

city for the same sex spouse or domestic partners. this legislation supports our lgbt community here in san francisco's -- san francisco and counters what is very much a discriminatory federal tax policy. and it provides a higher level of equality for same-sex spouses and domestic partners who work for the city and county of san francisco. currently city employees with same sex spouses or domestic partners elected to add their spouse or domestic partner to the health plan and additional federal tax is taken out of their paycheck. the federal government views health insurance coverage provided by same sex or domestic partners employers to be taxable income. therefore city employees in these situations are taxed more than other city employees simply because their spouse is of the same gender. this discrimination in our federal tax code has cost individuals affected by this tax thousands and thousands of dollars each year. and the number of city and county of san francisco active members with same sex spouses and domestic partners is close to 400. san francisco has always been a leader in supporting our lgbt community. following the exampl

our statistics in the city of san francisco are higher. 75 percent of our jail population is a pretrial felony population. i think you have to put some numbers in context as to who is our inmates in san francisco city county jails. the population demography reflects 60 percent african american inside the county jail system, 21 percent white and 15 percent latino. we have done studies in the past that show that at least a 3rd of our jail population would be eligible for some form of pretrial release through programs that have been designed through pretrial release, they have been very effective. i know will looeng of our shop can report on figures. i can give you ideas of jail dates that have been avoided. the numbers are significant. supervised release, we saved 43551 jail days. for 2011, with court atable accountable was 88059 and o.r. is 25,000. county sheriff's have been empowered to be able to use their discretion for early release and to use our discretion to help reroute people into alternatives to incarceration with monitoring release. but in the program we have under crowding. o
