our jackie ward is live this morning from the san jose city hall with more. >> reporter: she was hoping to become the newest city councilmember here in san jose. but now her campaign is on hold after she admits to killing a pedestrian. she is best in the bay area for being the cofounder of the bay area women's march but on monday earlier this week just before noon, she hit and killed a pedestrian on blossom hill road. the victim was identified is 66- year-old tim starkey who was working as a handyman. he had just arrived and was outside his truck which was parked on blossom hill road. she was inside at the time of the accident. a neighbor alerted her to the tragedy. >> he was lovely. i was in shock. >> reporter: she is one of three candidates running for the election and a vacancy for district 10. in a statement released by her campaign she says she is, quote, heartbroken and deeply saddened by this tragic death and she is taking time to recover from the accident and grieve the loss of light. the victim's family told kpix 5, quote, his smile and humor were the favorite tools he brought

as we give you a lookout at the city of san jose, some sunshine breaking through. let's check in with mark. >> we are not done with that rain yet. we have another band moving into portions of the bay area starting to rain once again. the rainfall over the past 24 hours, the bulk of this falling earlier this morning. take a look at these numbers. the impressive. canfield over an inch. santa rosa, .44. san francisco, .43. san jose, not nearly as much. about a 10th of an inch. it is not over yet. even though we have a break in the rain in some places we have a little bit of wave developing offshore pushing onshore. here is the current coverage on the radar from the north bay, down toward san francisco and right near the immediate coastline. a few flooding reports from earlier this morning indicates a minor flooding. we have around nine to show you in this box here. mainly focused in san francisco and in the oakland area. here is the coverage right now, as you can see in portions of the north bay, and parts of marin county. it looks like there is one self focused in so

allows homeless people to sleep on public sidewalks or in city parks if there is no other shelter available. kpix 5's len ramirez is in san jose with reaction from the city. >> reporter: well the san jose housing department says it agrees with the court's decision that criminalizing homelessness and poverty is not a solution, but that perspective may be put to the test as more and more people appear to be moving into the parks and sidewalks of san jose. tents and piles of homeless people supplies are now sprinkled around st. james park as homeless people appear to be moving in to stay. at the same time the san jose police have stepped up patrols and appear to be questioning people sitting on benches. the city has been trying to clear out the park for years, but under a supreme court decision, there might not be much the city can do if homeless people decide to stay. >> it's a small victory. >> reporter: pastor scott wages ministers to the homeless in san jose and say it is court made the right decision to let stand a lower court ruling that allows homeless to stay in parks or sidewalks if there's no other shelter to stay. >> i

. >> bob redell joins us outside san jose city hall how this may better protect renters out there. bob. >> reporter: laura and scott, later today at city hall behind me, they're going to decide whether or not to approve new fines for landlords who operate within the city limits much. this is to encourage the property owners to follow the law when it comes to how they treat their tenants. landlords are required to provide a legitimate reason for not renewing a tenant's lease. the city is considering a fine of at least $500 for those landlords who don't follow that so-called just cause eviction rule. that's one of the fines that they're considering. some landlords say the new fines under consideration would create a financial burden for them and they believe the city should be focusing on the affordability crisis. not them. the san francisco supervisors rules committee approved new protections for them. currently they can evict them without cause unless the building is more than 40 years old. the new law that needs full board approval would extend no cause eviction protection to rent
