the former san jose city councilman, who resigned after being charged with sexual abuse, is working toward a plea agreement. omar torres was supposed to enter a plea today, but it was postponed. the san jose spotlight is reporting his attorney says a plea agreement is in the works. police arrested torres last november in the wake of a sex crime accusation. he's now facing three child molestation charges. this week, council members filled his district three seat, appointing engineering executive karl salas. we continue to follow our breaking news in philadelphia. a plane crash there. the crash happened about three hours ago near a mall, the roosevelt mall. this is about three miles from the northeast philadelphia airport. we are learning that six people were on board. that includes a pediatric patient and their escort. this is a medevac type plane. the plane was heading to missouri. we do not know the condition of the passengers right now, but you can see the aftermath of that crash. that fiery ball right there near that mall. we continue to monitor the story. we'll bringou more information

nbc bay area's robert honda joins us now from san jose with the city with the answers city to that. this corner of san tomas expressway is where neighbors tell us a homeless encampment was set up until a city sweep this week, one of several sweeps in san jose in the past few days. people tell us they are grateful for the sweep, but also wonder when will the encampment come back? this is one of several encampments along san jose's coyote creek that was swept in the past few days. those in the encampment were given a posted notice, saying they had to clear out by today and warning that if they're camp, the personal property will be removed without further notice. it will keep you warm, i promise. but there are still plenty of occupants living there today. many were getting food and warm clothing from urge, the volunteer unhoused response group. bailey, confined to a wheelchair two years ago, shows the dilemma facing both sides. he acknowledges the city didn't kick him out because it didn't have a place to accommodate him, but he needs the encampment and its support. it's hard out here
